AFFIDAVIT OF GOOD FAITH/MERIT

WE, EMMANUEL SEGAFU, CABABA PANGA, DOLPING DIAMAN

and JIMBOY S. TAIRO, of legal age, married and residents of Purok B,
Kinam, Malapatan, Sarangani Province, after having been duly sworn to in
accordance with law, depose and state:
1. That herein defendants filed their Answer to the Complaint on 18
May 2018.

2. That, paragraph 15 of the said answer provides,

“It should be noted that Respondents have no claim or

interest whatsoever to the 6 hectares portion of land sold
by Severina Uayan (wife of Florencio Uayan) to Plaintiff
Ricardo Unda. Respondents have been recognizing and
giving due respect to the same. In return, Ricardo Unda
should also recongnize and give due respect to the
remaining portion of Lot No. 26 that respondents have
been continuously occupying and possessing since birth
until the present;” (Emphasis Supplied)

 3. That herein defendants made a typographical error when
“Lot No. 36” was mistakenly encoded as “Lot No. 26”. The
mistake was made in good faith believing fully well
that it was encoded as Lot No. 36.

4. That it was only on 06 August 2018 when the Hearing on the

Plaintiff’s Motion for Issuance of Injunction that herein
respondents knew of the typographical error.

5. That We execute this affidavit and to attest to the veracity of

the foregoing facts and statements and for whatever legal
purposes this may serve best.
