JOINT-AFFIDAVIT OF WITNESSES

We, RODEL L. BASILIO, CHRISTOPHER L. BASILIO,

RUTCHIE L. BASILIO, CHRISTIE L. BARTOLOME, IAN D.
LALISAN, HENRY D. LALISAN, REGINA L. AYOP, RIZALDY L.
AYOP, RODERICK L. LALISAN and MARGIE L. LALISAN, all of
legal age, Filipinos and residents of Poblacion, Alabel, Sarangani
Province, after having been duly sworn to in accordance with law,
hereby depose and state;

2. That, herein affiants are Indigenous People belonging to

Aklan tribe living in the heart of Alabel, Sarangani Province. They are
the children of Pedro Lalisan and Francisca Laraño as well as the
defendants in the case of Unlawful Detainer and Attorney’s Fees with
Civil Case No. 15-194-A.

3. That, herein affiants are the actual occupants of Lot 130, Pls-
219 situated at Purok Maharlika, Poblacion, Alabel, Sarangani
Province since birth until present. Their predecessors have occupied
the said parcel of land since 1949. They cultivated the said land and
planted several trees and coconut trees. They built their ancestral
home and houses in the said parcel of land.

4. That, sometime in the year 1976, their father, Pedro Lalisan

lent his title property so the Free Farmers Cooperative Incorporated
(FFCI) may secure a loan amounting to P47, 900 to Development
Bank of the Philippines. Said load was intended to purchase Corn
Sheller and Mill in favor of the FFCI. It did not redound to Pedro
Lalisan’s benefit nor to his family.

5. That, herein affiants came to know of the said loan when a

representative from Development Bank of the Philippines came to
talk to our father regarding the subject parcel of land. The
representative assured our father that a 1 hectare portion of the

parcel of land will be sold which was enough to pay the remaining
balance of the loan. Our father consented but appeared to be
deceived when the whole property containing an area of 116,082
square meters was sold in an auction sale. It should be noted that the
loan was only P47, 900 and the property was almost 12 hectares.

6. That, this auction sale, however, never came into knowledge

of our father. He was not notified neither any of our family.

7. That, what was worst was DBP even took possession of the
purchased Corn Sheller and Mill of the FFCI.

8. That, herein affiants was not notified of the auction sale more
so the redemption period. Our parents, Pedro Lalisan and Francisca
Laraño, died without us informing the status of the subject parcel of
land. This subject parcel of land is the only property left to us. This is
where we live and spent our lives since birth.

9. That, while it is true that some defendants signed the

Memorandum of Agreement, it was due to coercion, intimidation,
harassment and deception. Our houses were even demolished just to
instigate fear to us. In fact, a case was filed before the Lupong
Tagapamayapa in regard the matter.

10. That, it was Thelma B. Dacera, the mother and Attorney-in-

Fact of the plaintiffs who were negotiating to our family and she even
sent a Letter to the Notary Public who notarize the Agreement that its
terms had to be changed and cancelled to reflect the real intention of
the parties.

11. That, herein affiants have not received the Final Demand to
Vacate as alleged by the parties. It was not received by any of the
defendants in this case.

12. That, We are executing this affidavit to attest to the veracity

of the foregoing facts and statements and for whatever legal purposes
this may serve best.

10. IN WITNESS WHEREOF, We have hereunto set our hands
