Safety Instructions
Due to the potential hazards associated with any electrical instrument, it is
important that the user is familiar with the instructions covering the
capabilities and operation of the instrument. The user should ensure that all
reasonable safety precautions are followed and if in any doubt should seek
professional advice before proceeding.
The instrument is designed for use by suitably trained, competent personnel
in a controlled working environment and is intended for use as a Universal
Materials Tester.
Due to the nature of materials testing it is the responsibility of qualified
personnel, by virtue of their training, experience or instruction, to perform a
competent risk assessment of the potential hazards regarding moving parts
and sample testing and ensure that the users of the equipment wear
suitable protective clothing and hand or eye protection if these are deemed
necessary.
Testometric cannot be held responsible for any unauthorised modifications
to this equipment.

Warning
This unit contains hazardous live voltages. Under no circumstances should
the user try to prevent or restrict the movement of parts, either personally or
with the aid of foreign bodies. All ventilation slots must be kept clear.

Provision for lifting and carrying


When unpacking or moving this unit, extreme care is required owing to its
physical construction and weight.
It is recommended that accepted lifting and carrying procedures are
employed and that personnel wear the appropriate protective equipment
e.g. safety shoes.
If the unit is to be moved an appreciable distance or height, it is
recommended that it is moved via a suitable vehicle e.g. a fork lift truck.
Operating environment
This unit is intended to be used in a residential, commercial and light
industrial environment as laid down in EMC Directive 2014/30/EU with
compliance to harmonized standard EN61326-1 Emission and immunity
requirements.
The following are examples of locations in which the instrument might be
located: workshops, laboratories and service centres and locations which
are considered to be suitable for commercial or light industrial activity.

Climatic environment
The unit is intended to operate within the following conditions:
1. Temp 0-55 deg Celsius
2. Humidity 90% RH with no icing or condensation
3. Altitude <1000m above sea level.
The unit is intended to be stored in a temperature range of 0 to + 25 deg
Celsius in an atmosphere free from corrosive gases.

Electrical information
This unit complies with BSEN61010-1:2019 Safety Requirements for Electrical
Equipment for Measurement, Control and Laboratory Use.
The equipment must be permanently grounded using the earthing
connection on the supply cable.
Never detach electric connections while voltage is applied to them.

PAT testing
For the purposes of PAT Testing, Testometric machines are classified as Class
1 stationary equipment or appliances. The intended use of Testometric
equipment is in low-risk environments where devices are not frequently
relocated.
The requirements and frequency of visual inspection, combined inspection
and testing is normally determined by the end-user.
Important information regarding PAT Testing:
1. Testometric 500 type machines use an earth bonding method on the
motor drives so the drive complies with EMI (Electromagnetic Interference)
requirements. This bonding method can mean that the earth leakage test
performed during an electrical PAT test can display readings slightly above
the upper acceptance level. Please note that this is not an indication of
faulty equipment. If you require more information please contact
Testometric.
2. Flash testing is not required on this type of Class 1 equipment and should
never be performed as part of an electrical PAT test because of the risk of
damaging sensitive electronic devices and components.

Electrical Connections
250/350/500 Models with single phase supply
The single phase models are all supplied with a power cable with a 10A
rating. The supply to the equipment must use a correct earth grounding
connection.
If circuit breakers are in the supply circuit then Type D are recommended.
The power requirement for the machine will be indicated
on the back of the machine. This should be verified before
connecting the AC supply.
Single phase modes use a circuit breaker for AX power
input protection.
FS Models with 3 phase supplies
FS models use 3 phase 415v supplies and should be protected externally
with the following Type D rated circuit breakers:
FS models up to 600kN rated at 16A/phase 415v.
models 1000kN rated at 25A/phase 415v.
FS models up to 600kN are supplied with a 16A/phase 5 pin (3P + N + E) plug
fitted.
FS models 1000kN are supplied with a 32A/phase 5 pin (3P + N + E) plug
fitted.
WARNING! Insulation/Flash testing involves high voltages and should not be
carried out on this type of equipment as damage to electronic devices could
result .

Unpacking and Initial Setup
1. Remove all packing material and place the testing machine on a level
bench.

2. If using an external PC refer to X Series Ethernet Configuration to


establish communication between testing machine and PC.

3. Switch on the PC and tester.

IMPORTANT:- Ensure that the power saving option for the monitor is
disabled in Windows (already configured on machine with built in
PC).

4. If using a built in PC, skip this step.


Insert the supplied USB memory device.
Open the analysis folder and run the setup.exe application.
You must ensure the PC has sufficient privileges to have the WinTest
Analysis EC software installed and configured.

See Administrative Privileges, software installation and software


operation.

5. If your testing machine has an integrated UPS (Uninterruptible Power


Supply), please ensure this device has been powered up.

Please see Uninterruptable Power Supply (UPS) provision on


equipment

6. Run WinTest Analysis EC by double clicking on the WinTest Analysis


EC icon shown on the desktop.

Disable firewall for “Tester” ethernet port (Windows Defender)


During the WinTest Analysis EC installation an attempt to create firewall
exceptions for the “Tester” ethernet port can be made.

This is done by pressing the Add winTest EC to


Windows Defender Firewall Rules button

This will only be successful with Windows


Defender.

If using other Windows security applications it will be necessary to create


exceptions manually.

Configuring firewall ports
Administrative privileges will be required in order to change security
settings.
Firewall ports 6000, 6001, 6002 and 6003 must be open in order for WinTest
Analysis EC to communicate with the testing machine. By default these
ports will be open and available for use.
It may be necessary to apply a rule in order to open these ports.
1. Select “Start Menu” -> “Settings” -> “Update & Security”
2. Select “Windows Security” -> “Firewall & network protection”.
3. Select “Advanced Settings”.
4. Select “Inbound
Rules” -> “New Rule”
5. Select “Port” and
then press “Next”

6. Select “UDP” and


“Specific local ports”

7. Enter 6000-6003 to
indicate the port
range and press
“Next”

8. Select “Allow the

Methods Library
On initial running of WinTest Analysis EC you will be presented with the
Methods Library dialog.

Here you can choose to install test method templates, predefined test
methods for use with the supplied fixtures and standard test methods
related to your industry.

Select the required test method(s) and press the Add button to transfer to
the WinTest Analysis EC list.

Press the Import button to transfer the list of test methods into WinTest
Analysis EC.

Press the Close button to return to WinTest Analysis EC.

The Methods Library can also be accessed by pressing the Import button in
the File menu.

Basic Testing
1. Pressing the Application Menu button in the top left
corner of the screen will allow access to a number of
options including the Front Panel.

2. Check the load cell


capacity displayed on the
control panel is the same as
the load cell connected, e.g.
1000kgf. If there is more
than one load cell the
machine will automatically
detect the connected load
cell.

3. Move the crosshead to a suitable position to attach the grips by


pressing UP or DOWN. Press the red STOP button to stop the testing
machine. Press the RUNNING MAN button to switch on jog mode,
adjust the speed by pressing the + / - buttons.

4. Attach the grips using the pins provided.

5. Move the crosshead to the test start position.

This can be done by pressing the UP and DOWN buttons.

or

Click on the Abs distance and specifying the required distance. The
machine will then automatically move to the desired position.

6. The test mode is toggled between Tension and Compression by


pressing the dumbbell / platens button.

7. Set the control panel to the required test speed by clicking on the
speed indication box and entering the speed e.g. 100 mm/min.

8. The force and extension units can be changed by selecting the force
unit box e.g. N, kgf or lbf for example.

9. Press ↷ to alter the sample break detection (0 is off, 9 is the most
sensitive).

10. Press the Scales button to tare (zero) the force reading.

11. Insert the test sample and clamp the grips.

12. Press Fm to select/deselect peak force hold during a test.

13. The test can then be conducted by pressing the ► button.

Procedure for creating a new test method
1. Press the Test Methods button and then select
Create Method.

2. Select the test method you


wish the new method to be
based on.

3. Your new test method must be given a unique name.

4. Select the Test Type from the drop down list.

5. The Sample Type selection will offer all relevant sample type options
for the test type selected.

You will then be able to


defined the sample
dimensions.

wish to view or input
individual specimen
dimensions before each test.
These dimensions will be
added to the calculations list

6. By selecting the Calculations tab the calculations for the test method
can be selected.

Choose the calculation number (1 to 30) and then press the Edit
button.

Up to 30 columns can be selected by using the scroll bar. Units default


to the SI system but can be changed individually or globally by
selecting either the Metric or Imperial keys.

Certain calculations require one or two additional parameters such as


Force @ Elongation and Secant Modulus.

7. Selecting the Chart Setup tab will allow the user to define graph axes
etc. The use of Auto will override any minimum and maximum values
and automatically re-scale as necessary.

8. The Tester Setup tab requires the configuration of parameters such as


Load Cell, Grip Offset (compression testing), Sample Break,
Crosshead Limits and Start Position.

Grip Offset ensures all heights are measured relative to the


compression platens touching one another.

Grip Offset is configured by slowly running the platens together and


applying a small compressive force of approximately 30 N to ensure
the platens are parallel. The Grip Offset should then be set to the
current ABS distance.

Once the Grip Offset has been configured, the crosshead Upper Limit
and Lower Limit can be configured.

Note : For tensile based testing Grip Offset is not normally required.

For destructive testing it will be necessary to define a Sample Break


condition. A number of options are available dependent on the
sample characteristics.

Setting the Machine SBD to 9 achieves the highest sensitivity, setting


to 1 is the lowest sensitivity.

Setting the Machine SBD to 0 turns the break detection off.

Note : For non-destructive testing such as cyclic and step testing it is


common to turn the break detection off.

9. To store the test method press the OK button. The method will then
be added to the list for future use by selecting the Blank Page icon to
create a new test series.

Test references
WinTest Analysis EC allows the creation of both batch references and
sample references.
Batch references are items of text entered which refer to all the samples
tested. Batch references appear on the test report as shown in the example
below.

Performing Tests
1. Select a test method from the
methods available.

2. Press the New or Open button in the bottom right corner to create a
new test series or open an existing series of data.

3. The left pane allows entry of Test Headings, Batch References,


Parameters, Sample Break and Comments by selecting the
appropriate option at the bottom of the pane.

4. Press the Start Test button in the bottom left corner of the screen to
access the Real Time Window.

5. Insert the test piece into the fixtures and press the ► to run the test.

6. Press the ✔ button to end the test. The selected test results will be
calculated and data will be automatically saved.

7. If Auto Return is enabled in the test method; the crosshead will now
return to the Test Start Position.

The crosshead can be manually returned to the Test Start Position


by pressing the Start Position button

8. Pressing the Report Page button will return to the Test Analysis
screen.

Sets the force readout to zero

The calibration check function is a useful confidence check


on the current state of the system. When the button is
selected, the force reading will display 50% of the load cell
capacity (usually in N or kgf). If the reading exceeds +/- 0.5%
error, the system could be out of calibration – refer to
troubleshooting section.
Sample Break Detection (0 -off to 9- most sensitive).The break
detection system monitors the rate of change of force during
a test and stops the tester crosshead when force fall off is
detected.
IMPORTANT:- As materials react differently under test
conditions, the level at which break detection operates can
be adjusted by increasing or decreasing this figure.
For example: When testing single thread yarn, the BREAK
DETECTION needs to be set at its most sensitive so that the
system detects a small fall-off in force value. When testing
fabric, the BREAK DETECTION needs to be set to a low
number so that the crosshead does not stop as each
individual thread breaks.
Selecting ‘0’ disables the sample break detection.
Zeroes an extensometer if fitted.

Selects/deselects an extensometer if fitted.

Enters the WinTest Analysis EC software

Exits the software and returns to the operating system

Password protected access to Factory settings.

Changing Units
By selecting the force unit on screen the unit system will toggle between
kgf, N and lbf. When operating in kilograms and Newtons the testing
machine will use millimetres as the distance units. Inches will be
automatically selected for distance measurement when operating in
pounds.
The force units shown on the testing machine will be dependent on the
load cell currently connected. For example a 1kgf load cell will operate in gf
and cN, a 100kgf load cell will operate in kgf and N and a 5000kgf cell will
operate in kgf and kN.

Changing Speed
Clicking on the test speed will display the speed
change control.
The required speed can then be defined by
pressing the relevant buttons
The maximum speed available on the machine
is also indicated on screen.

Changing Upper and Lower Crosshead Limits


Clicking on the upper or lower limits will display
the control to allow the adjustment of the
limits.
New limits can be entered by pressing the
appropriate buttons on the control.
The maximum upper travel limit and minimum
lower travel limit will be displayed

System Menu
WinTest Analysis EC is able to operate in many different
languages including French, German, Spanish, Italian,
Dutch, Czech and Russian

As part of WinTest Analysis EC’s compliance with CFR21


Part 11, WinTest Analysis EC allows the construction of user
accounts to support the audit trail facility.

The audit trail records all user activities relating to the


electronic data stored by WinTest Analysis EC. Pressing this
button will allow users with the appropriate privileges to
view the audit trail

Allows configuration of ASCII output, golden sample


tolerances, sequence calculations and statistics

WinTest Analysis EC stores the test methods and test data


in a default location. It is possible to change this location
and enables a more secure location such as a network drive
to be used for storage of data.

The data backup facility enables the safe keeping of test


data by taking a copy of the database and storing it in an
alternative location

Allows the configuration of communication parameters


between Tester and PC or any other compatible serial
device and the PC

The custom calculation facility allows the construction of


calculations that are not already available as standard

Although most facilities within WinTest Analysis EC use


complimenting colours., it is also possible to apply
alternative colours to most areas of the software.

Test Menu
Tests are conducted for a new or existing series. Note that
the crosshead should previously have been returned to the
correct start position.

Any calculations newly introduced will be recalculated.


Calculations involving the line of best fit or a manually fitted
straight line fit will also be recalculated.

Copies the test results into the clipboard. The data can
then be pasted into software supporting the tabulated data
format

Chart Menu
Allows the chart parameters to be configured

Where calculations require a region of trace to be defined


before the result can be calculated, pressing this button will
allow this region to be defined

Copies the chart image into the clipboard for pasting into
other software packages

A region can be defined in the chart area and a magnified


representation of the area will be provided for display and
printout.

Returns the chart to the original state, cancelling any


magnification etc

Peaks and troughs can be shown on the graph by


specifying a % tolerance and % drop. Alternatively, the
peaks and / or troughs to be used for calculations can be
defined manually.

Allows the creation of trend lines on the graph window

Annotation can be placed on the chart indicating a point of


interest. These annotations can also be edited for operator
comments

Overload

Overtravel protection is provided by factory set


internal travel limits based on the Absolute
Overtravel measurement system which will stop the
crosshead at the limits of travel.
Impact protection will stop the crosshead if the
grips or fixtures are brought into contact
Impact accidentally on crosshead return i.e. when fitting
larger grips and not re-setting the crosshead limits.
Note:- Impact protection does not offer full
protection and care should always be exercised to
avoid impacting the grips and/or load cell.
The sample break detection system is designed to
stop the crosshead from moving if a sudden drop in
Sample Break force is detected the sample break icon will be
Detection displayed and the testing machine will stop. The
sample break condition is cancelled by pressing the
End Test button.
If a fault condition occurs this will be indicated by
the drive icon being displayed.
Drive Protection To reset the motor drive, press the emergency stop
button down and release and repeat (two times in
total) Recheck motor drive status.
This condition may occur if running up to high
force at slow speed or when holding a high force.
For such applications it is recommended that
forces are limited to 50 % of the machines capacity
Under normal testing conditions the force value will

Trouble Shooting
Crosshead Cannot be Driven
• Check speed is not set to 000.00mm/min (or 00.000in/min)
• Check that the machine is powered up and that the Emergency Stop
button’s red led is on.
• Check that the force display is active and the force reading changes
when a small force is applied to the load cell.
• Check there is no Cell Impact condition. Note that this condition can
occur if a high negative force has not been zeroed, by depressing the
Tare button, prior to running the crosshead in tension mode. It is
important to note that the button should NOT be used to remove any
positive force reading after the specimen has been fixed in the grips.
The operator should always confirm that the force reading is near zero
before specimens are loaded, so that any pre-loading of the specimen
when the grips are tightened is accounted for during the test.
• Check the load cell is connected. (If the load cell is left unplugged the
force system can temporarily drift into an OVERLOAD condition.)
• Check Sample Break Detection (SBD) setting and confirm that the
setting is not oversensitive for the type of material being tested.
• Check that the displayed speed is correct.

Force Reading Static or Incorrect


• Check load cell is connected.
• Check load cell wires and connections .
• Check load cell for damage.
• This condition can be investigated further by checking the pre-tare
reading. A reading outside of +/- 10% of cell range indicates that the
cell could be damaged. To check pre-tare value, depower and
repower the machine. (Switching mode between Tension and
Compression will also display the Pre-Tare value). The pre-tare force
reading should be < +/- 10% of cell range. The pre-tare figure for each
load cell is normally set so that the pre-tare force with the appropriate
grips is as close to zero as possible. If this is not possible the force
should be within +/- 5% of the cell range.
• Loss of load cell data due to memory corruption. This condition can be
checked by performing a Calibration Check function by pressing the
button on the control panel. The Force reading should be 50% of the
capacity of the load cell. The calibration figure is set with the
appropriate grips attached to the load cell (variation in cal.
approaching 0.5% can occur if the appropriate grips are not attached.
• If there is a suspicion of memory corruption then a system re-format
may be necessary and the Service agency will have to be contacted.
To help with this the system settings can easily be copied onto the
clipboard for pasting into another application, then printed out or e-
mailed etc. Click on the key button on the Front Panel then click on

View, then Copy, then OK. Exit the control panel and paste the
settings into the desired application. The system re-format back to
factory settings can also be done using the diagnostics program.
• Contact Service agency for further details.

No Extension Readings
If there are problems with an extensometer
Check that it is selected/de-selected using the select/deselect Extensometer
button.
• Check device is connected to the correct input/output socket on
the rear panel of the machine.
• Ensure extensometer is fully closed onto setting stops before
commencing a test.
• Ensure extensometer and/or transducer (if fitted) are set to operate
at the desired gauge length before commencing a test.
• Ensure that the extensometer clamping faces are not slipping on
the sample, thereby reducing the overall extension reading. If
slippage is suspected it should be possible to adjust the position of
the knife edges so that they are fully closed and clamped
throughout the test.

No Communication with PC
Make sure the LAN cable is connected to the LAN connection on the testing
machine and PC.
If the LAN connection on the PC is already used then check that the LAN
cable is connected to the USB LAN adapter.
Refer to the X Series Ethernet Connection to make sure the ethernet
connection is configured correctly
Refer to the Disable firewall for “Tester” ethernet port (Windows Defender)
to make sure an exception is made with the firewall.

ABS Distance Measurement
The machine absolute position can be checked by removing the fixtures and
measuring the Spigot to Spigot or Platen to Platen distance.

Machine Settings
On pressing the Key button WinTest Analysis EC offers a number of options
as shown below.
Most options are password protected and should be used only by
Testometric personnel and approved agents.

View
Selecting View will display
the machine parameters
stored onboard.

Calibration Check Record


On each occasion that the Pointing Finger button is pressed; WinTest
Analysis EC will report the calibration check figure for the load cell
connected. This should show 50% of load cell capacity and also the error.
This data is also stored in the calibration check record which can be
accessed by pressing the Calibration Check Record button.

Installation
1. Remove all external packing materials.
If the machine has a built in PC take particular care with the PC
assembly.
2. Level the tester side to side and front to rear, using a spirit level on the
top platen, by adjusting the leveling feet on the bottom of the tester
using a 24mm spanner. Tighten the locknuts when the tester is level.
3. Swing the PC Assembly (if supplied) to a comfortable viewing position
at the side of the tester and tighten the red locking lever.
4. Insert the four black DIN load cell plugs into the four sockets at the
bottom rear of the tester.
5. The voltage can be set for 110 or 220V and this is shown on the
switched mains input socket. Check that the voltage selector is
correct for the local voltage before connecting the tester to the mains
ac supply. The maximum power is 1200W so the tester can be run
from a regular socket outlet.
6. If the testing machine has a built in PC, switch on the tester and PC
the system will automatically boot up into WinTest Analysis EC.
If using your own PC. Connect the PC to the machine with the LAN
cable provided, then switch on the machine and the PC. The WinTest
Analysis EC software should be installed on the PC using the
installation instructions contained in the user handbook.
7. Select the UP direction to run the moving platen up and the packing
material between the platens can then be removed.

Administrative Privileges
Software Installation
When installing WinTest Analysis EC on PC’s that are part of a network it will
be necessary to make sure full administrative privileges are granted.

Software Operation
You will need to enable the Show hidden files, folders and drives option
from within Folder Options.
WinTest Analysis EC uses the following location for storing application data,
program settings and user data :-
\ProgramData\winTest Ethercat\
It is essential that all users have full read, write and modify privileges to the
folders stated.

Preventative Maintenance
General mechanical inspection is recommended every 12 months.
All moving mechanical parts should be periodically checked for lubrication.
A light oil should be applied to items such as ballscrews, guide rods, grip
parts etc.
Grip faces should also be checked for wear.
Load calibration and servicing is recommended annually; please contact
Testometric or your local agent to arrange.

Uninterruptable Power Supply (UPS) provision on equipment
If the AC supply to the machine and computer system is unstable or subject
to power outages then a UPS is recommended.
A UPS is also recommended if long term testing is being performed.
The APC Back UPS Pro 900 is a 900VA rated UPS that will provide back-up
power to the machine and computer system during brief power outages
and is not intended to power the machine for normal operation.
For single phase machines, the UPS will stabilise and regulate the AC power
to the machine and computer system and also, by constantly monitoring
the AC supply, begin a controlled shut down of the computer system during
a prolonged power outage. This requires the UPS to be connected to the
computer via the USB interface (cable provided) and with the correct drivers
installed on the computer.
For 3 phase machines, the UPS is connected to one phase of the AC supply
that supplies the machine electronics and can also be used to provide
power to the computer system. The UPS should also be connected to the
computer via the USB interface (cable provided) to begin a controlled shut
down during a prolonged power outage.
Powering the testing machine and PC
1. Switch on the testing machine by pressing the On / Off switch on the
rear of the machine

WinTest Analysis EC Viewer
Viewing of test results and graphs in a remote situation is possible by using
the WinTest Analysis EC Viewer contained on the supplied USB memory
device.
Note: The WinTest Analysis EC data must be stored in a shared network
location to allow the WinTest Analysis EC Viewer access.

WinTest Analysis EC Viewer installation


1. Navigate to the Viewer folder on the USB memory stick
2. Run the Setup.exe application

Configuring WinTest Analysis EC Viewer


The location of the WinTest Analysis EC test data must be defined within the
viewer.
1. Run the WinTest Analysis EC Viewer
2. Ensure the File menu is selected and then press the WinTest File
button
3. Navigate to the location of the WinTest database file.

Note: It will be necessary to tick the Unhide files and folders option in
the Tools/Folder Options menu to gain access to the wintest
database file

Operation of WinTest Analysis EC Viewer


Once the WinTest Analysis EC File location has been defined you will then
be able to view test data by pressing the New / Open button in the File
menu.
WinTest Analysis EC Viewer will only allow the viewing of test data and curve
data, it is not possible to modify or delete data using the WinTest Analysis EC
Viewer.

Data Export
WinTest Analysis EC is able to output data in a number of formats for various
purposes.
ASCII and Access output for the transfer of data into 3rd party software
packages.
Excel output including combining data series from a common test method.
Adobe Acrobat (.pdf), Word and Excel output of standard test reports

ASCII Output
ASCII output is enabled by pressing the Edit ASCII Setup button in the
System Menu and then ticking the “Enable Auto Save” option.
Options are available for defining the ASCII file name, location and
customising the format of the data
The data will automatically be output to the chosen file on closing the test
series.

Access Output
Microsoft Access database tables can be generated by pressing the Export
to Access button in the File Menu.
The name and location of the Access database file must be defined and
then the test method can be selected for the Access database file.
The Access file generated is a flat file database design containing all the
data saved using the test method.

Excel Output (Combining Reports)


Excel files can be generated combining a range of data from one common
test method.
Pressing the Open button in the bottom right corner will show all the stored
data relating to the selected test method.
A range of data can then be selected using a combination of mouse, shift
key and CTRL key.
Press the Excel Export Results button to generate the Excel sheet in your
chosen location.

Pressing the ⏷will give additional options to define the interval for data,
include charts etc

Report to Word, Excel and .pdf


Pressing the appropriate button from the File menu will generate and save
an Adobe Acrobat, Microsoft Word or Microsoft Excel version of the WinTest
Analysis EC report. The appropriate Adobe, Word or Excel application will be
required to view and edit the generated reports.

Additional Load Cells
Additional load cells are supplied pre-configured with their specific
identification number and sensitivity parameters etc.

Connect the new load

Software Licence Agreement
Testometric Software licence agreement for all software described in this manual

Testometric provides the Software and the Program described in this manual incorporated in or embedded on
magnetic disk, tape, hard disk or other media and the descriptive material related to that Program in this manual
or in other documents strictly subject to the terms and conditions of this Licence Agreement.

By breaking the Seal on the package in which the software is provided and/or by entering, utilising, running, listing,
copying or otherwise manipulating the media, program, manual or other documentation other than for the
purpose of erasure or destruction as set out below you agree to be bound by all the terms and conditions of this
Licence Agreement.

If you do not agree to be bound by any one or more of the terms and conditions of this Licence Agreement you
must destroy the Software Package, manual and documents and erase the program and software from the media
on or in which it is incorporated or embedded.

Definitions

“Machine” means the single microcomputer, or PC on which you use the Software. Multiple CPU systems require
additional licences.

“Software” means the set media, documentation and related materials described in and supplied with this manual.

“Program” is a part of the Software and means the instructions, codes, messages or other information contained in,
or embedded on media, or any part of it.

“Testometric” means The Testometric Company Limited, Unit 1 Lincoln Business Park, Rochdale, England.

“Licensee” means the purchaser, if purchased for own use or, if purchased for company use, means that company
and its employees.

Licence

Testometric grants a non-exclusive Software Licence to Licensee to:

1. Use the supplied Program on a single Machine.


2. Where copy protection is not incorporated, copy the program into any machine-readable or printed form
for backup or modification purposes in support of licensee’s use of the program on a single machine.
Licensee may make only one (1) copy of the Program for such purposes. Copying of documentation and
other printed materials if prohibited. Disassembly, reverse compilation and reverse engineering of the
program of software is prohibited.

Terms

Software supplied by Testometric is copyright protected. Licensee agrees to uphold these copyrights.

This Licence Agreement enters into effect at the time you open or break the seal on the Software package, or
enter, use, run, list, copy or otherwise manipulate the program, and is effective until terminated.

Licensee may terminate this Licence Agreement at any time by destroying the Software together with all copies.
The benefit derived by licensee from the licence will terminate automatically if the terms of this agreement are
violated and Testometric may demand the return of the software immediately. Any such termination shall be
without prejudice to any accrued rights of the parties.

The licence is personal to licensee and may not be assigned to any other person, persons or company.

The right to “lend”, “hire”, “rent”, “sell”, or otherwise transfer the software in part or in whole is not granted to licensee.

Licensee may not use, copy, modify or transfer the Software or documents, or any copy, modification or merged
portion, in whole or in part, except as expressly provided for in this licence agreement.

The program cannot be transferred via any media other than that on which it is supplied. It cannot therefore be
transferred via such media as telecommunication lines.

Licensee agrees to take all possible steps to protect the software from unauthorised use, reproduction or
distribution.

Limited Warranty

THE SOFTWARE IS PROVIDED AND LICENSED ON AN “AS IS” BASIS. LICENSEE ASSUMES RESPONSIBILITY FOR
SELECTION OF A PROGRAM TO ACHIEVE LICENSEE’S INTENDED RESULTS AND LICENSEE IS RESPONSIBLE FOR
INSTALLATION, USE AND RESULTS OF USE, EXCEPT AS IS HEREIN EXPRESSLY STATED, TESTOMETRIC MAKES NO
REPRESENTATION, GIVES NO WARRANTY AND ACCEPTS NO CONDITION OF ANY KIND WHATSOEVER EITHER
EXPRESSED OR IMPLIED, INCLUDING, BUT NOT LIMITED TO THE IMPLIED WARRANTIES AND CONDITIONS OF
MERCHANTABILITY AND FITNESS FOR PURPOSE (SPECIFIC OR GENERAL).

TESTOMETRIC DOES NOT WARRANT THAT THE FUNCTIONS CONTAINED IN THE SOFTWARE WILL MEET
LICENSEE’S REQUIREMENTS OR THAT THE OPERATION OF THE PROGRAM WILL BE UNINTERRUPTED OR ERROR
FREE.

TESTOMETRIC DOES NOT RECOMMEND USE OF THE SOFTWARE FOR LIFE CRITICAL FUNCTIONS OR FOR ANY
APPLICATIONS WHERE A SOFTWARE ERROR MAY CAUSE FINANCIAL LOSS, DAMAGE OR EXPENSE.

However, Testometric gives a limited warranty that the disks, tapes or other non-hardware media on which the
Program is embedded and supplied by Testometric, to be free from defects in materials and workmanship under
normal use for a period of ninety (90) days from the date of receipt by, or of delivery to, Licensee as evidenced by a
dated copy of Licensee’s proof of purchase receipt. In the event that the disks, tapes or other non-hardware media
are found to be so defective within the said period. Testometric will replace them free of charge, if they are
returned postage prepaid.

Testometric will also, AT ITS DISCRETION, by modification or alteration endeavour to remedy any Program errors,
attributable to Testometric, which are provable and demonstrable and reported to Testometric in writing within
the aforesaid period.

Limitations

UNDER NO CIRCUMSTANCES WILL TESTOMETRIC, THE AUTHOR, OR THE MANUFACTURER, DEVELOPER OR


SUPPLIER OF THE LICENSED SOFTWARE BE LIABLE FOR ANY CONSEQUENTIAL, INCIDENTAL, INDIRECT, SPECIAL
OR EXEMPLARY DAMAGES OR OTHER ECONOMIC OR PHYSICAL LOSS, EVEN IF TESTOMETRIC OR SUCH OTHER
PARTY(IES) HAS/HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES AND LOSS. UNDER NO
CIRCUMSTANCES WILL LIABILITY EXCEED THE PURCHASE PRICE OF THE SOFTWARE.

Indemnity

The Licensee shall indemnify Testometric in respect of any liability incurred by Testometric or the Software author
as a result of a claim brought by Licensee against Testometric directly or against a third party, for negligence,
breach of contract or product liability.

Governing Law

This agreement shall be construed, interpreted and governed in accordance with the Laws of England.

General

If any of the above provisions are invalid or unlawful under any applicable Law they are to that extent only deemed
omitted.

Some US states do not allow the exclusion of implied warranties and conditions or limitations of liability. In such
circumstances the above exclusions and limitations may not apply to licensee. This warranty gives the licensee
certain legal rights but licensee may also have other legal rights which vary from state to state.
