It has been a more than a month since we have subscribed the services of
KCAT to provide us with up to 20 mbps internet connection at the rate of
P1999.00 per month. During the said period, we have been provided with
unsatisfactory intermittent connection. Such is attested by the fact that we
have to call your technicians on a daily basis to resolve the issue. While the
technicians would cater to our complaints and resolve the same, it is
indisputable that the shoddy (if none at all) internet connection we have,
should not be the normal and acceptable service from your
company.
Considering there is a failure on your part to meet the services you offered
based on our contract, we would like to TERMINATE the same. Such is
justified under Article 1191 of the New Civil Code to wit:

Article 1191.
The power to rescind obligations is implied in reciprocal ones, in case
one of the obligors should not comply with what is incumbent upon
him. The injured party may choose between the fulfillment and the
rescission of the obligation, with the payment of damages in
either case.
Under the circumstances, we believe more than one (1) month of patience
for you to fulfill your obligation is within reason. Considering the failure
on your end to comply the same, we are now constrained to terminate
your services.
