CASE I:

Instructions: 1) Assume that you are the lawyer of FOREVER and was directed to
prepare a Position Paper by the court. Following the format: FACTS,
ISSUE/S and DISCUSSION, state the position of your client.

2) Assume that you are the judge of the case, prepare a ruling based on
the same facts and issue/s.
FOREVER is a public health facility under the administration of the Department of
Health. Since 1960, it has occupied a portion of a parcel of land known as Lot A. In
1969, Spouses Bernabe purchased from Mr. Santos Lot A where portion of which is
occupied by the facility of FOREVER. Spouses Bernabe sent demand letters to
FOREVER and that FOREVER was given until April 30, 2000 to vacate the premises.
Despite the lapse of the period, FOREVER refused to vacate. On May 14, 2000,
Spouses Bernade filed a Complaint for Ejectment against FOREVER. In their
Answer, FOREVER alleged that since they had been in possession of the property for
more than 40 years, the case for ejectment is not proper.

CASE II.
Instructions: Answer the questions. Cite rulings and provisions of law, if any.
DPWH constructed underground tunnels on the property of Mr. ROJAS without his
knowledge and consent and without any expropriation proceeding. DPWH contended
that it constructed an easement on the property. Was there taking of the property of Mr.
Rojas? Is Mr. Rojas entitled to just compensation?
