PSG EXHIBIT 6.

GUIDELINES FOR PREPARING CONSTRUCTION


MANAGEMENT OR DESIGN-BUILD GUARANTEED
MAXIMUM PRICE PROPOSALS
The Guaranteed Maximum Price (GMP) proposal is developed at the phase specified
in the Agreement for Construction Management Services or Agreement for
Design/Build Services.

The GMP proposal should be bound in a three ring binder with cover, dividers, and
documentation, in the following tabulated order:
Proposal Booklet Cover - Cover must contain, at a minimum, the
title "Guaranteed Maximum Price Proposal", the project name,
project number, date of submission, and construction managers'/
design-builder's name.
TAB - A: Transmittal letter (including confirmation of project team (see
attached letter format)
TAB - B: Table of Contents
TAB - C: Project Description and Additional Documents (Exhibit A of the
Agreement): Provide required information found on the attached Tab
C.
TAB - D: GMP Summary (Exhibit __ of the Agreement): Provide a summary
of the total GMP cost using the Tab D format attached.
TAB - E: List of Documents and Specifications: Provide a recital of the
specific Construction Documents, including drawings, specifications,
and all addenda thereto, used in preparation of the GMP proposal,
(project manual(s), drawings by sheet number & date (revised
dates), etc.)
TAB - E1: Qualifications, Clarifications, and Assumptions: Provide a
summary of all qualifications and assumptions included in the
specification listing. At the minimum, the information shall be
grouped by CSI category. If possible identify specific CSI
specification number.
No qualifications or exceptions may be introduced that conflicts with
the requirements of the General Terms & Conditions, Construction
Contingency use, or Staffing/General Conditions Costs as described
in the Agreement.
TAB - E2: Exclusions: Provide a summary of all exclusions included in the
specification listing, plus any exclusions not related to the
specifications, by CSI category. No qualifications or exclusions may
be introduced that conflict with the requirements of the General
Terms & Conditions, Construction Contingency use , or
Staffing/General Conditions Costs as described in the Agreement.
TAB - E3: Proposed Substitutions, Modifications, or Variances: Provide
this information if applicable.
TAB - E4: Record of Value Engineering Items: If applicable, provide a

record of all previously accepted or rejected Value Engineering items.


Provide this information in the format of attached Tab E4.

cost/savings in the GMP format including critical dates for inclusion in

Tab - F1: Major Elements of the GMP
a. Guaranteed Maximum Cost of the Work, detailed by each
subcontract, trade, or bid division, including all quantities and
unit prices.
b. Contingency, calculated as a fixed percentage of the Cost of
the Work.
c. Guaranteed Maximum Staffing Costs, detailed by expense
category and coded to Article 4.2(a)(1) of the Agreement.
d. Guaranteed Maximum General Conditions Costs – including
bonds & insurance – detailed by expense category and coded
to Article 4.2(b)(1) of the Agreement.
e. Guaranteed Maximum Overhead & Profit, calculated as a fixed
percentage of the (4) items listed above less bonds &
insurance.
Tab - F2: Schedule of Values
Provide a draft Schedule of Values using the CSI format, organized
according to anticipated bid packages and including quantities, unit
prices, and cost extensions. Provide a reconciliation to/with the GMP
and previous estimates if those proposals or estimates were
organized or broken down differently.

Tab - H: Bidding Phase Outline

Include list of variances from University standards and procedures, if
any, include a statement of why the variance has occurred, benefits
of or justifications for the proposed variances and the impact of the
proposed variance on the cost, schedule or quality of the Project.
Tab - K: Long-Lead-Time Items (if applicable)
Include a list of long-lead-time items, including any restocking
charge or other similar charges
Tab - L: Self-Performed Work
List those portions of the Work the CM/D-B proposes to perform with

its own force and the Work the CM/D-B proposes to perform with
Subcontractors hired by the CM/D-B.

A directory including all proposed contractors, subcontractors, and

TAB B: TRANSMITTAL LETTER

Construction Manager's Letter Head

Reference: GMP PROPOSAL for ___

The undersigned, (Name), proposes and agrees, if this GMP Proposal is accepted, to
enter into an agreement with the University and to perform and furnish all Work as
specified or indicated in the Contract Documents for the construction phase for
Contract Price for the construction phase and within the Contract Times indicated in
this GMP Proposal and in accordance with the other terms and conditions of those
Contract Documents.

(CM's Name) accepts all of the terms and conditions of the Agreement Between the
University and Construction Manager, CM’s response to the "Notice for Professional
Consultants", and the Contract/Scope of Services for Pre-Construction Services. The
GMP Proposal will remain subject to acceptance for ______ calendar days after
received by the University. CM will sign and deliver the required number of
counterparts of the Contract with the bonds and other documents required by the
Contract Requirements for the construction phase within fifteen (15) days after the
date of University’s acceptance of the final GMP Proposal.

In submitting this proposal, CM represents, as more fully set forth in the Contract
for the construction phase, that:
 CM has examined and carefully studied the Contract Documents for the
construction phase and the following Addenda receipt of all, which hereby
acknowledged: (List Addenda by Addenda Number)
 CM has visited the site and become familiar with and is satisfied as to the
general, local and site conditions that may affect cost, progress, performance
and furnishing of the Work.
 CM is familiar with and is satisfied as to all federal, state and local Laws and
Regulations that may affect cost, progress, performance and furnishing of the
Work.
 CM has carefully studied all reports of explorations and tests of subsurface
conditions at or contiguous to the site and all drawings of physical conditions
in or relating to existing surface or subsurface structures at or contiguous to
the site which have been identified in the Contract Discounts for the
construction phase. CM acknowledges that such new reports may not be
complete for CM’s purposes. CM acknowledges that University and design
professional do not assume responsibility for the accuracy or completeness of
information and data shown or indicated in the Contract Documents for the
construction phase with respect to underground facilities at or contiguous to
the site. CM has obtained and carefully studied (or assumes responsibility for
having done so) all such additional or supplementary examinations,
investigations, explorations, tests, studies and data concerning conditions
(surface, subsurface and underground facilities) at or contiguous to the site
or otherwise which may affect cost, progress, performance or furnishing of
the Work or which relate to any aspect of the means, methods, techniques,

sequences and procedures of construction to be employed by CM and safety


precautions and programs incident thereto. CM does not consider that any
additional examinations, investigations, explorations, tests, studies or data
are necessary for the determination of this GMP Proposal for performance
and furnishing of the Work in accordance with the times, price and other
terms and conditions of the Contract Documents for the construction phase.
 CM is aware of the general nature of Work to be performed by University and
others at the site that relates to Work for which this GMP Proposal is
submitted as indicated in the Contract Documents for the construction phase.
 CM has correlated the information known to CM, information and
observations obtained from visits to the site, reports and drawings identified
in the Contract Documents for the construction phase and all additional
examinations, investigations, explorations, tests, studies and data with the
Contract Documents for the construction phase.
 CM has given design professional written notice of all conflicts, errors,
ambiguities or discrepancies that CM has discovered in the Contract
Documents for the construction phase and the written resolution thereof by
design professional is acceptable to CM, and the Contract Documents for the
construction phase are generally sufficient to indicate and convey
understanding of all terms and conditions for performing and furnishing the
Work for which this GMP Proposal is submitted.
 This proposal is genuine and not made in the interest of or on behalf of any
undisclosed person, firm or corporation and is not submitted in conformity
with any agreement or rules of any group, association, organization or
corporation; CM has not directly or indirectly induced or solicited any person,
firm or corporation to refrain from proposing; and CM has not sought
collusion to obtain for itself any advantage over any other CM or over
University.

1. GMP Proposal Schedule. CM will complete the Work in accordance with the Contract Documents for
the construction phase and accept in full payment for the Work items listed below, the following Unit Prices and/or
Proposal Prices, as applicable:

THE GMP PROPOSAL IS BASED UPON THE LUMP SUM PRICES,
ALLOWANCES, AND QUANTITIES LISTED HEREIN, ACTUAL QUANTITIES
MEASURED IN PLACE SHALL BE RECONCILED AS A CHANGE IN SCOPE IN
DETERMINING ACTUAL COST OF THE WORK.
IF THERE IS AN ERROR IN THE GMP PROPOSAL OR COMPUTED
TOTALS BY THE CM IT WILL BE CHANGED AND THE LUMP SUM AMOUNTS
WILL GOVERN.

2. Time of Completion.
2.1. CM agrees that the Work will be complete within ___ (___) calendar days
after the date when the Contract Time for the construction phase commences to
run as provided in The Contract Documents for the construction phase, and

completed and ready for final acceptance in accordance with The Contract

date of the Notice to Proceed.
2.2. CM accepts the provisions of the Contract for the construction phase as to
liquidated damages in the event of failure to complete the Work within the times
specified in the Contract.
