RESOLUTION
This resolves the Motion for Reconsideration (MR) filed by ex- PO1 Omar L
Lagahi (Movant), seeking the reconsideration of dropped from the rolls (DFR) order
issued severing his employment effective March 10, 2011 as published under
ORPHRDD Special Orders No. 345 dated March 18, 2011.
Records show that movant while assigned with the RMG3 now (RMFB3), was
further detailed at Group Combat Support Coy, but failed to report for duty from May
12, 2009 July 28, 2009, or a period of seventy eight (78). Records further show that
prior to his DFR, RMG3 received report from Tarlac PPO dated September 16, 2009
that movant with two (2) other suspects got involved in an alleged frustrated
murder/shooting incident. On September 23, 2009, movant was placed on restriction
on camp (RMG3 Hqs) for his pending investigation of the alleged frustrated murder.
However, on the following day (September 24, 2009), movant left the camp premises
without permission from the Officer-in-charge and refused to report back for duty.
Such acts clearly show that subject PNCO intended to discontinue his service as a
police officer. Thus, he was subsequently DFR. Hence, this MR raising the following
grounds:
This Office finds that the MR is not meritorious. It does not raise valid ground
to warrant the reconsideration of the DFR order sought to be reconsidered, aside
from the fact that it was filed outside the reglementary period.
SO RESOLVED.
