does not include sales, use, value-added taxes, or shipping costs, unless otherwise agreed in the applicable agreement executed by the
authorized parties for you and Pure Storage. By accepting this Quote and purchasing the Product, you acknowledge that the End User of the
Products agrees to be bound by the terms and conditions of the Pure Storage End User Agreement, which may be found here:
http://www.purestorage.com/agreements/Pure_enduser_agreement.pdf (or other agreement for the subject matter executed between Pure
Storage and the End User), except to the extent the Products are third party Products. End User's use of third party Products will subject to
such third party's applicable end user terms. By accepting this Quote and purchasing the Product, you confirm that your purchase is based
only on currently available Products, features and functionality, and that you have not relied on the future availability or announcements of
unreleased products, features, and/or functions in your purchasing decision.

To ensure timely fulfillment when Product availability is limited, Pure Storage reserves the right to fulfill an order with higher performing and/or
higher capacity equipment at no additional charge to the authorized reseller or the End User for such increased performance or capacity.
Determination of whether to fulfill an order with higher performing and/or higher capacity equipment is at Pure Storage’s sole discretion. Unless
otherwise identified in this Quote, an Evergreen Subscription commences upon shipment of the Product (and for Evergreen Subscription
renewals, upon receipt of the Purchase Order.)

Expired Evergreen Subscription renewals means that an End User’s Evergreen Subscription has expired/lapsed. Pure Storage has the right to
charge a Reinstatement Fee of up to 20% of the entire Evergreen Subscription and/or the full amount of back support in order to bring the
support contract current.
