Ms. Ortiz’s case

Different companies have their own policies which are usually guided by the laws that exist in

the state. Although Ms. Ortiz has a right to claim that the company has discriminated her, the

company sticks to its policies that it does not accept applicants using any drugs whether it is

illegal or under medication as seen in this case. The company therefore has the right to know the

medical condition of a potential employer to assess if one can fit in the work environment

Despite medical cannabis being legal in some states in the US, most of them have ruled

that the law can only applied during prosecution in crime but not in other cases like employment.

If Ms. Ortiz finds out that other people have been affected before, she can create a platform

where they can come together and fight for their right of not being subjected to tests when one

has a medical condition due to privacy concerns.

Although this will affect marketing in the town, the owners are supposed to comply with the new

expression will be affected by the right to safety of commuters overrides it. However, those

affected cab seek for an injunction from the court that can allow them to propose other options

like lighting the signs at wee hours when traffic is low or not lighting the signs is the light is the

major cause of obstruction to the motorists. If the billboards are removed or turned off, an

unconscionable contact will be affected as the Municipality will be working in favor of the

superior party who are the motorists and they have not considered those involved in the business.

Oregon Euthanasia case

If the doctors administer the drugs before adoption of the Death with Dignity Act, it will be a

violation of the federal law. Despite it being adopted, there are certain procedures that need to be

followed in its administration, failure to which one may be charged by the misuse of the drugs.

Only residents of Oregon qualify for this act otherwise, one may be accused of crime by federal

government. A licensed physician basing his practice on the Oregon law cannot prescribe the

drugs in any other state whether if the patient involved is from Oregon or not. It may lead to

prosecution by the Federal State.

Clarita’s case

Clarita has to ensure that Juanito certifies his dog before renting it out. If the two should

mutually agree on the conditions, they will enter into a stud dog bilateral contract that will allow

breeding to take place. Juanito should keep both dogs as male dogs find it hard to adopt to a new

environment especially if they have not bred before which can hinder the breeding process. This

In case one of the dog is infertile, the agreement will not be completed as Juanito will not

process.

decide not to complete the transaction and change his cell phone number so that he cannot be

traced making Alfonso to lose half of his cards.

A contract should contain an offer, the acceptance, considerations in place, mutual

obligation, and competency and in some circumstances it should contain a written evidence. This

transaction fulfills the requirements of a transaction except for the written evidence as the

business is being conducted online.

Linda’s case

Juanita offers Linda an express contract which she agrees wholly as Juanita promise that the new

product line is of high quality. Juanita in this case acts as the sales agent of the product she

applies to Linda from the way she describes the product. After the effects took toll on Linda’s

body, it is clear that there has been a breach in the contract with Juanita. She deceives Linda to

using the product and does not warn her of its side effects. Linda can sue the saloon and claim

for compensation for using products which can lead to physical damage. The salon on the other

hand could seek for solution from the company producing the product to explain the effects of

the product.

Angel’s case

Alma should pay for the repair that is being done on his garden as the waste that comes from the

creek also affects her. If the company agrees to lower the cost due to the fact that Alma’s brother

cannot help her, then Angel can pay for the whole service.

In future, if Alma wants Angel to divert the waters, it is her obligation to compensate

Angel having benefitted from the service. Angel can sue Alma if she fails to compensate as she

had to do repairs for the whole extension of the creek which affects Alma too.

Angel does the work without a consent from the Municipality which is in contrast with

the law and she can be sued for this.

Karla’s case

Jewelry has a low rate of depreciation thus Karli needs to sell them at a price just lower than the

initial one. But if she does not have other options on how to raise money, she will have to agree

and take Luisa’s offer of $2500.

If Karla declines to sell of the clothes after a second thought, Luisa can claim she had a

contract if both of them had previously agreed on the price. If Luisa calls and does not get an

answer, the agreement has not been completed as it should involve two parties. Even if she sends

the money, Karla has already made up her mind not to sell the clothes thus the agreement will be

regulations. However, it will limit practicing his profession as he is seeking funds to start his

own business thus, he is supposed to work on different jobs to easily raise the capital. The

exclusive rights depend on the company one works with and can be applied outside the PR

market.

Both the clauses prevent exercise of free profession by people in this company. To

develop programming skills, one has to work on different projects and this may be limiting him.

If either or both the clause are cancelled, the contract will become null based on the terms and

conditions. If hired in the US this would change as he will have the freedom to exercise

profession as directed by the constitution.

Red Cross case

Before giving them out, the volunteers should confirm from the owners of these four items if

they did it out of free will. They should ask if Mr. Rivera had left the ticket in the trouser

intentionally or he had forgotten. If intentionally, they would have made the contract and it will

be donated to the organizations. They should do this also for Ms. Gonzalez, the Jewelers and

Monica Puig and then keep back those which have been donated willingly.

The Red Cross have an obligation to give out recommendation letters to the volunteers

and the like on their social media page as a sign of appreciation for the whole process. This will

motivate them and they can come back to volunteer some other time. If they do not, they may

have less motivation of volunteering again in some other event.
