EU/US Bilateral Safety Agreement Preparation for Transfer of Oversight


for Holders of FAR 145 Repair Station Certificates
This Information Notice contains information that is for guidance and/or awareness.
Recipients are asked to ensure that this Information Notice is copied to all members of their staff who may have
an interest in the information (including any ‘in-house’ or contracted maintenance organisations and relevant
outside contractors).

1. Introduction
1.1 Further to IN-2011/078 and IN-2012/045, the Bilateral Safety Agreement took effect on 1 May
2011. The agreement requires the transfer of oversight of FAR 145 Repair Station Certificates
held by Part 145 approved organisations from the Federal Aviation Administration to the
National Aviation Authority in the State where the organisation is located. This transfer must
take place within two years of the entry into force of the agreement.
1.2 UK CAA is intending to begin the transfer process in April 2012 and to have all approvals
transferred by October 2012.

2. Preparations for Transfer


2.1 In order to make transfer as straightforward as possible and ensure the scope of approval on
certificates remains adequate for your business needs, organisations are requested to begin
making arrangements for transfer.
2.2 Application
2.2.1 Form SRG 1744 and relevant fee should be submitted to Applications & Approvals (A&A).
A&A will acknowledge receipt of this. A table of fees is set out in Section 3 of the form.

2.3 Maintenance Organisation Exposition Supplement
2.3.1 Organisations are requested to begin to prepare a new Maintenance Organisation Exposition
Supplement, which is required to show how a maintenance organisation complies with the
bilateral agreement. When requested, the Supplement should be submitted to the assigned
CAA regional office for review. Requests for submission will be made following the FAA audits
conducted between April and October 2012. Organisations that have already been audited will
be contacted separately regarding the submission of their Supplement.

2.4 Review of Certificates
2.4.1 When transfer is made, the FAA will issue a new FAR 145 Repair Station certificate based on
the ratings on the current EASA Part 145 Scope of Approval.
2.4.2 Organisations are requested to review their current Part 145 and FAR 145 certificates and
notify A&A of any anomalies such as aircraft types that fall into EASA Annex II category. The
CAA will discuss these cases with the FAA.
2.4.3 If the review reveals that the FAR 145 ratings exceed the Part 145 certificate, application will
need to be made to increase the PART 145 scope of approval if the organisation wishes to
retain the capability on the FAR 145 approval following the transfer.
2.5 Organisations with Multiple Certificates
2.5.1 Organisations that hold multiple FAR 145 certificates covering several sites may wish to
consider using this opportunity to merge the certificates into one, which includes all additional
fixed locations. Organisations wishing to do this should indicate on the Form SRG 1744 that a
variation is required and include the relevant variation fee and an FAA Form 8310-3.

3. Applications for New UK Based FAR 145 Approvals


3.1 Applications for new UK based FAR 145 approvals made since 3 August 2008 remain on hold
as the role of the Transportation Security Administration (TSA) in the initial approval process
remains under discussion within the United States Government.
3.2 The CAA will be able to progress applications that were made by organisations before 3
August 2008. The CAA will be contacting affected organisations regarding their applications.
3.3 If the FAA has started investigating an application, organisations may wish to discuss with
their FAA Principal Inspector if it is in their best interest to transfer the investigation to the UK
CAA before the initial approval is granted.
