effect of harmonics on the power system voltage. It is used in
low-voltage, medium-voltage, and high-voltage systems. It is

Reportorial Requirements
 DUs shall submit its Distributor’s
Compliance Monitoring Report using the
prescribed template (Annex “A”).

• The Report shall specify, but not limited to,
the following:
a) Standard or the prescribed technical
specifications, performance
standards, financial standards or
other requirements of the PDC;
b) Measurements by which the
compliance of the reporting entity
with the Standard will be assessed;

c) Self-assessment and certification of
the reporting entity concerning its
degree or level of compliance with the
Standard; and

 The DU shall assess the applicability of the
Standard to its Distribution System(s). If the
Standard is applicable, the self-assessed degree
or level of compliance shall be indicated in the
Report. The degree of compliance with the
Standard can be:
 Full Compliance - Complies with all the requirements
of the Standard; and
 Non-Compliance - Not in compliance with one or more
of the requirements of this Standard but has definite
plan and schedule to correct all violations or complete
all requirements;
Reportorial Requirements
 Where the DU is in full compliance with the non-
recurring Standard, the DU shall submit any proof of
compliance in lieu of the required supporting
information and/or documents. However, should
there be any amendments to the required
supporting information and/or documents, these
shall submitted as part of the Report.
 The non-recurring Standard is a Standard that
requires establishment of policies, procedures and
systems to comply with technical standards. Table 2
indicates the recurring & the non-recurring Standard.
Reportorial Requirements
 Where the Standard is not applicable to
the reporting entity or the reporting entity
is not in full compliance with the Standard,
the reporting entity shall explain the
reasons for such conditions.

 The DU entity shall ensure that supporting
information and/or documents to justify its self-
assessment of compliance w/ the Standard are
readily available for verification & inspection by
the ERC, through the DMC. These shall include
documentations containing procedures, records,
reports, programs, plans, actions taken or to be
taken & other information that demonstrate the
compliance of the reporting entity with the
Standard.

 TheDistributor’s Compliance Monitoring
Report shall be certified by the authorized
person of the reporting entity and shall be
submitted under oath to the ERC, through
the DMC.

4.2.1 Reporting
 A reporting entity shall submit to the ERC
not later than May 31 of each year, the
Distributor’s Compliance Monitoring
Report (in hard and electronic copies),
indicating its performance for the
preceding calendar year against the
minimum Standards provided in the PDC.

4.2.2 Self-Assessment
 A reporting entity shall conduct self-
assessment through periodic monitoring of
its compliance with the Standards of the
PDC and provide in a form and manner
and at such times as may be requested by
the ERC, Distributor’s Compliance
Monitoring Report under oath as set out in
Section 4.2.3 of these Rules.

4.2.3 Record Keeping
 A DU shall maintain records of compliance
and shall be available anytime for
inspection.

A DU shall maintain detailed records of all


technical and economic evaluation
conducted to comply w/ the requirements
set out in Chapter 6 the PDC.

 All submitted reports shall be kept by
the DMC and made available to the
ERC upon request for a period of five
(5) years.

4.2.4 Compliance Audit
 The ERC, through the DMC, shall conduct
annual Compliance Audit in random
manner, including spot inspections, to
monitor compliance of the reporting entity
with the Standards of the PDC.

 The DU will be provided with a 60-day
notification and all the necessary
documents required by the Audit Team.

 The Audit Team will review the DU’s evidence of
compliance with all the applicable Standards of
the PDC with the technical personnel of the
reporting entity and as required, provide
additional information to clarify data previously
supplied to the Audit Team.

 Interviews supplied to the Audit Team, in


conjunction with evidence provided, will be the
basis in validating compliance with the PDC.

 At the end of the Compliance Audit, the
Audit Team shall conduct exit briefing with
the reporting entity to discuss the
preliminary audit findings and feedback
from the reporting entity.

4.2.5 Budget
 Budget for the conduct of the monitoring
and Compliance Audit by the ERC,
through DMC, shall be included in the
annual budget of the DMC.
Final Provisions

 5.1 Administrative Sanctions


Violation of these Rules shall be subject
to the imposition of fines and penalties in
accordance with the “Guidelines to
Govern the Imposition of Administrative
Sanctions in the form of Fines and
Penalties Pursuant to Section 46 of
EPIRA”, as amended.
Final Provisions

• 5.2 Separability
If for any reason, any provision of these
Rules is declared unconstitutional or
invalid by final judgment of a competent
court, the other parts or provisions
hereof which were not affected thereby
shall continue to be in full force and
effect.

• 5.3 Repealing Clause
Any rule or regulation inconsistent with the provisions of these
Rules is hereby repealed and modified accordingly.

• 5.4 Effectivity
These Rules shall take effect immediately upon publication in a
newspaper of general circulation in the country and upon posting
electronically.

Philippines Law Center-Office of the National Administrative
Register (UPLC-ONAR) and all concerned Distribution Utilities.
