Subject: -Information Requirement regarding nomination of Technical Committee member/National


Standards Committee member for Automobiles Division of SDC/PSQCA Karachi.

Dear Sir,

Please refer to your letter No. PSQCA/SDC/ATC-13/2016 dated 05-04-2016 on the subject captioned
above whereby nomination for National Standard Committee and Technical Committee member is
required with a pre-condition that the nominee must be an Engineer/Master in Science in particular
fields and should be acquainted with standards.

May I take this opportunity to draw your kind attention to Pakistan Standards Rules, 2008 notified
through SRO 46(KE)/2008 dated May 14, 2008. Para 4 of Pakistan Standards Rules, 2008 establishes
rules to constitute National Standards Committee. Following lines are quoted from para 4 of said rules:

“4. National Standards Committees.-(1) The Authority shall constitute National


Standard Committees for activities relating to articles, products or processes
as deemed necessary. Each National Standard Committee shall comprise of
the following, namely :-
(a) all chairpersons of the concerned technical committees;
(b) up to five representatives of concerned government agencies and public
sector;
(c) up to five representatives of manufacturers or their associations;
…..”

The Rule 4(1)(c) clearly established that National Standards Committee will comprise of upto five
representatives of manufacturers or their association among others. The rule does not mention any
qualification of such representatives. Therefore, I am obliged to state that the qualification
requirement of representatives of manufacturers in your above mentioned letter is illegal.

Furthur regarding constitution of Technical Committee the Pakistan Standards Rules, 2008 establishes
rules in Para 6. Following Lines are qouted from para 6 of said rules:

“6. Technical Committee.-(1) The Technical Committees shall be appointed by


National Standards Committee or if necessary by the Authority for the
preparation of a particular standard or group of standards. They shall include
concerned officers of the Authority and representatives of various interests
such as consumers, regulatory and other Government bodies, industry,
scientists, technologists and testing organizations and may also include
consultants, but consumer interests shall, as for as possible be protected. An
officer of the Authority who is the member of the Technical Committee shall
act as the Secretary of the Technical Committee…”
The Rule 6(1) clearly establishes that technical committee shall include representatives of industry
among others. Here also the rule does not mention qualification requirmenets of such representatives.
Again for Technical Committee the qualification requiremetn for representatives of industry is illegal.

It would be pertinent to mention here that in past the rules have been followed as such and
representatives from industry were part of National Standards Committee and Technical Committees.

After making above submissions, we request you to withdraw qualification pre-conditions for
nominations for National Stanndards Committee and Technical committee so that we may proceed
furthur for nominations.
