Complaint U/s 138 of the Negotiable Instruments Act, 1886.

Sir,
The above named complainant most respectfully submits as under:-

1) That opposite party 1 is the sole proprietorship firm of Opposite Party no.
2 and he is authorized and responsible for the all the acts, deeds &
omissions done for on behalf of the Opposite Party No. 1.

2) That you Opposite Party No. 2 as proprietor of Opposite Party no. 1,


purchased Oak Dew Spring Water 1 litre, 192 cases from the complainant
amounting to Rs. 23,060/- against which Bill No. 400 dated 0509.2015
was issued to the opposite parties.

3) That the opposite parties against the said bill issued following two
cheques to the Complainant for which the complainant is holder in due
course for consideration:-

a. Cheque no.007966 dated 29.03.2016 amounting to Rs.11,530/- of


Uttarakhand Gramin Bank, 422, Unchapul Branch, Kaladungi Road,
P.O. Kathgharia, District Nainital.
b. Cheque no.015070 dated 10.05.2016 amounting to Rs.11530/- of
Union Bank of India, RAV Public School, Haldwani, Distrit Nainital.

4) That as per the assurance made by Opposite party No. 2, the complainant
produced the said cheques with his Bank, State Bank Of India, PBB Vasant
Vihar, Dehradun on 10.05.2016, which were returned by the bank vide
memo dated 11.05.2016 of my client unpaid with the following
endorsements:-

a. Cheque No. 007966 dated 29.03.2016 amounting to Rs.11530/- with


the endorsement ‘02-Exceeds arrangement’.

b. Cheque No. 015070 dated 29.03.2016 amounting to Rs.11530/- with


the endorsement ’01- Funds Insufficient’.

5) That in this respect it is also pertinent to mention here that earlier also on
the assurance of the Opposite Parties, the complainant produced cheques
no. 007966 of Uttarakhand Gramin Bank, dated 29.03.2016 for Rs.
11,530/- with his bank, which was returned by the Bank with the
endorsement “Exceeds Arrangement” on 30.03.2016.

6) That after which the complainant contacted the Opposite Party No. 2, who
assured the complainant to produce both the cheques on 10.05.2016 and
he will ensure payment of the same.

7) That bestowing faith upon the Opposite parties the complainant produced
the aforesaid cheques for the second time as stated above.

8) That thereafter the complainant tired to contact the Opposite Parties, but
they gave a deaf ear to the same on which the Complainant through Shri
Vaibhav Jain, Advocate send a legal notice dated 23.05.2016 to the
opposite parties through Regd. A.D. post.

9) That however the Opposite Parties malafidely get the said notices
returned. In this regard it is pertinent to mention here that the address on
which the said notice was send was the address of the office of the
Opposite Parties from which he is still working and the same is the last
known address of the Opposite Parties in the knowledge of the
complainant.

10) That the Opposite Parties has full knowledge of the contents of the said
notice and he malafidely so as to harass the complainant has not received
the said notice.
11) That the act of the Opposite parties/accused is punishable U/s 138
Negotiable Instrument Act.

12) That the cause of action arose under the jurisdiction of this Ld. Court and
this Ld. Court has jurisdiction to arose and adjudicate the above complaint.

13) That the complainant has left with no other relief other than to file the
present complaint before this Ld. Court.

It is therefore most respectfully prayed:-

1. The Opposite parties be directed to pay the Complainant the amount of Rs.
23,040/- towards payment due upon you alongwith Rs. 3300/- as cost of
the notice alongwith interest @ 24% p.a. from the date of raising of bill till
payment.

2. The opposite parties/accused be summoned and penalized U/s 138


Negotiable Instrument Act.

3. The Opposite parties be directed to pay an amount of Rs. 11,000/- as cost


of the litigation.

4. Any other relief as this Ld. Court deems fit and proper in the above
circumstances in favor of the complainant and against the Opposite Parties
be also granted.

correct and the same are liable to be read and understood as an integral

present complaint before this Ld. Court.
13. That the complaint of the complainant is liable to be allowed with all
reliefs claimed.
