BJP Rath yatras postponed, Calcutta High Court division bench puts a stay on the order of the single

bench

The ‘Rath Yatra’ programme or the campaign for the Lok Sabha elections in 2019 of the BJP which was
scheduled to take place from Saturday has been postponed again by an order passed by a division
bench. The division bench led by Chief Justice Debasish Kargupta has put a hold on the Saffron Party’s
‘save democracy’ rath yatra and asked the single bench to review its order while hearing the plea filed
by the TMC Government led by Mamata Banerjee and asked the single bench to examine the district
intelligence reports by the State Authorities before taking a decision.

A single bench led by Justice Tapabrata Chakraborty had allowed the BJP to organise rath-yatra against
the denial of the three senior most officers of the state. It had rather asked the state authorities to
provide proper security and ensure law and order is kept. The three officers had denied permission to
the BJP on the grounds of communal tension on December 15, to which the BJP decided to appeal at the
Calcutta High Court.

BJP most likely plans to appeal the decision of the division bench in the Supreme Court but it is to be
noted that the delay is indefinite as of now as the courts will soon be going on a two week winter recess.

BJP had scheduled three rath-yatrs across the state as a part of its campaign for the lok sabha elections
of 2019 to be held on December 28, 29, 30 in Cooch Bihar, Sagar Island, and Tarapith respectively.
