This resolves the complaint for parricide filed by Spouses Ma.


Eleanor Enriquez and Lorenzo Enriquez, respectively against Miguel
Pearson.

Complainant on the above entitled case aver that respondent, last


August 25, 2015, in their residence at 1501 Swallow Drive, White
Plains, Quezon City, stabbed multiple times his wife, daughter of the
complainants, Laura Pearson, while she was resting in their bedroom.

In respondent’s counter-affidavit, he claims to have left the house at


around 5:30 in the morning to go to Navotas Port. He left Laura at
home because she was not feeling well.

When he came home, he alleged that he did not notice anything


unusual so he continued with his routine and dressed down for bed.
When he went inside their room to go to bed, he was taken aback by
the vision of his wife offered when he found her lying dead covered
in her own blood and stabbed.
On the other hand, the parents believed that the husband had issues
with their daughter because he kept on pushing that she was
sabotaging their marriage.

They also submitted affidavits to support his bad behavior towards


the complainants during family gatherings. One affidavit even
impliedly confirms that Miguel had temper management issues. As
stated, last August 24, 2015, Susan Dimagiba affirms that spouses had
an argument. She heard Miguel shout at Laura accusing her of not
thinking about their future and refusing to adopt a child and make a
family with him. The argument ended when Miguel received a phone
call and walked out of the room with a threat that they were not yet
finish with the discussion.

On respondent’s defense, he submitted the affidavit of the concierge


Angela Rubio alleging under oath that he was with Eloisa Magdalena
the whole night of August 25, 2015 wrapping up at around 12
midnight of August 26, 2015. He did not deny the argument he had
with the victim the night before but emphasizes that he will never,
under any circumstances, hurt his wife whom he loved.

Due to the collaborating witnesses on the motive and probability of


the husband being guilty beyond reasonable doubt, the prosecutor
rests his resolution with the finding of probable of cause against
respondent, Miguel Pearson.

WHEREFORE, in view of the foregoing premises, it is respectfully


recommended that Miguel Person y Schultz, be charged with the
crim of parricide and that the attached information be approved for
filing in court.
