QUESTION OF PRIVILEGE
OF REP. BATAOIL
Recognized by the Chair on motion of Rep.
Binay, Rep. Leopoldo N. Bataoil from the Second
District of Pangasinan spoke about the need to
protect and conserve Baybayin and to recognize the

importance of writing in the development and
preservation of civilization; this, as he adverted to the
start of the academic school year 2012-2013 and the
nationwide implementation by the Department of
Education (DepEd) of the mother tongue-based
multilingual education system.
After noting that the Philippines does not have
its own system of writing as it merely uses what its
colonizers taught it to use, he said that he authored
House Bill No. 2011 declaring Baybayin as the
national script. He stressed that the country should
have its own system of writing to allow it to compete
with the progressive Asian and Middle East nations
which have their own style of writing.
Rep. Bataoil then cited the efforts of the
government and the private sector in propagating the
use of Baybayin and expressed hope that the present
generation of Filipinos will revive, use, and teach it
as part of its cultural heritage.

Rodriguez stated his support for Baybayin and
manifested his desire to interpellate Rep. Bataoil.
MANIFESTATION OF REP. PADILLA
Recognized by the Chair, Rep. Carlos M. Padilla
manifested his wish to be part of any study on the
alphabet used by the Isinay tribe of Nueva Vizcaya in
the 1590s, as it could have been Baybayin.

Romualdez recognized Rep. Erico B. Aumentado who
Romualdo denounced the plunder of funds for the Quedancor
Romulo Swine Program (QSP) implemented by the
Sacdalan Quedancor-Iloilo District Office and the use of his
Salimbangon name by unscrupulous and criminal elements in
Salvacion regard thereto. After citing the noble mission of the
Sambar QSP to improve the quality of life of rural folk, he
San Luis detailed how the said office anomalously accredited
Sarmiento (C.) BIRKS Agricultural-Livestock Corporation as the
Sarmiento (M.) sole input supplier for the program; illegally released
Singson (E.) loan proceeds to it; and irregularly entered into a
Suarez compromise agreement with it instead of filing
Sy-Alvarado criminal charges against it. He also discussed how
Tan BIRKS was guilty of nondeliveries or under-
Tañada deliveries of inputs and how he was made to appear
Teodoro in a Commission on Audit (COA) report as being
Teves part of those who issued payments to it. He stressed
Tieng that QSP management committed fraudulent acts that
Ting COA should have first looked into to ascertain the
Tinga involvement of the board of directors.

INTERPELLATION OF REP. GUNIGUNDO
Reps. Gunigundo and Ungab discussed why the
European Union and the United States filed a case
with the World Trade Organization (WTO) against
the Philippines regarding its discriminatory classifi-
cation of excise taxes; and why the Philippines did
not invoke Article XIII of the General Agreement on
Tariff and Trade (GATT) which allowed some lee-
way for developing countries in protecting the local
industry.

islation thereon, he and his colleague dwelt specifi-
cally on alcohol products. They discussed the WTO-
compliant tax structures, the price tiers, and corre-
sponding tax rates; and the need for actual market
studies or price surveys by the Bureau of Internal
Revenue (BIR) and the Department of Finance
(DOF) aside from the consultation with stakeholders.

Rep. Binay acknowledged the presence in the
Session Hall of guests of Reps. Tomas V. Apacible

QUESTION OF PRIVILEGE OF REP. BELLO
Rep. Bello urged the Body to stand by the rights,
especially to a speedy and impartial trial, of Mr.
Temogen “Cocoy” Tulawie whom he referred to as
the symbol of human rights in Sulu. He said that the
local government had been consistently trying to
silence said leader for speaking vehemently against
human rights violations incurred by the military in its
attempt to contain the Abu Sayyaf; protecting
individual liberties and taking a stand against
institutionalized discriminatory religious profiling;
raising his voice against the increasing incidence of
sexual crime and violence against women that
involved sons of influential families and the civilian
emergency forces in Sulu; and criticizing the Sulu
governor for making warrantless arrests and violating
civil liberties. He added that in 2009, Mr. Tulawie
was charged with multiple frustrated murder for a
bombing incident that injured several people
including the governor.
Subsequently, Rep. Bello stressed the need to
defend the rights of many other human rights
advocates who continue to languish in jail and to

condemn the growing global trend of repression and
criminalization of the defenders of the poor, the
marginalized and the powerless.

QUESTION OF PRIVILEGE OF REP. SAR-
MIENTO (M.)
Recognized by the Chair upon Rep. Binay’s
motion, Rep. Mel Senen S. Sarmiento informed the
Body of his appointment as a member of the United
Nations Secretariat of the International Strategy for
Disaster Risk Reduction (UNISDR) advisory group
of parliamentarians. He explained the goal of the
body, which is to ensure the building of disaster-
resilient communities.

On motion of Rep. Binay, there being no
objection, the Body adopted Senate Bill No. 3146 as
an amendment to House Bill No. 4330, reviving the
observance of Arbor Day.
QUESTION OF PRIVILEGE
OF REP. MARIANO
Next recognized by the Chair upon Rep. Binay’s
motion, Rep. Rafael V. Mariano condemned the
militarization of the districts of Timog Quezon and
Bondoc Peninsula in Quezon Province as a result of
the implementation of Oplan Bantay Laya and Oplan
Bayanihan of the Armed Forces of the Philippines
(AFP). Initially, he cited statistics regarding human
rights violations in the province and details of the
experience of some human rights victims therein
including civilians, fisherfolk, farmers, and farm
workers.
Speaking in Filipino, Rep. Mariano then stressed
that the interests of marginalized sectors fighting
against landgrabbing and land conversion conflicted
with those of public and private groups who wanted

to develop the area commercially. He stressed that
the government should pull out the eight battalions of
soldiers and Special Forces thereat and immediately
conduct an investigation thereon.

Rep. Ungab explained how the proposed tax structure
could still be considered progressive and reiterated
one of the main objectives of the Bill which was to
curb the bad habits of Filipinos.

provide employment, and invest in the alcohol as
well as cigarette industries, Rep. Ungab explained
that the Bill is intended to level the playing field and
encourage new entrants and the economic
development of the country would not be hampered

Sponsor reiterated that the Bill wants to curb
smoking; clarified that he was not aware of any
group advocating the control of the tobacco industry
nor of any grant given to fund tobacco-related
illnesses and stressed that the Bill was neither anti-
alcohol nor anti-tobacco as it merely aims to regulate
the habit of smoking and drinking whether the
consumers were rich or poor.

At this point, Rep. Ungab cited government
studies on the profile of the 55,000 tobacco farmers
in the country which included their personal
characteristics and the tobacco varieties they planted.
When Rep. Magsaysay (M.) reiterated her argument
that displaced tobacco farmers would suffer
decreased income, Rep. Ungab reiterated as well that
tobacco farmers could still plant tobacco for local
and export markets and the Bill provided for
agricultural inputs, training, and programs for
alternative sources of livelihood and crop
cultivation.
Thereafter, the two Members deliberated on
import regulation of cigarette and alcohol; alignment
of other government resources for universal health
care in case of revenue shortfalls from tobacco and
alcohol products; adverse effects of the Bill on low-
income consumers and locally produced low-grade
tobacco; possible funding of the DOH by anti-
tobacco lobby groups; and opposition to the Bill of
Members from tobacco-producing provinces. They
also debated anew on the tax and price disparity
between new and old industry players.
Rep. Magsaysay (M.) explained at this point that
she was asking questions that she was not able to
raise in the hearings of the Committee because it had
fast-tracked the measure. Rep. Ungab explained in
turn that the original bill proposed by Rep. Joseph
Emilio A. Abaya was only approved at the
subcommittee level; and that House Bill No. 5727
was prioritized because it was certified as urgent by
the President and was in the agenda of the
Legislative-Executive Development Advisory
Council (LEDAC).

With the permission of the Chair, Rep. Neptali
M. Gonzales II stated that House Bill No. 5727 was
already reported out by the Committee on Rules and
was already being discussed on the floor; thus, it was
pointless to discuss the Committee process.

government for diseases arising from smoking and
drinking, as well as on projected revenues from
alcohol price increases.

imported and local tobacco leaves in local cigarettes
and the effect of the former on the health of smokers;
the effect of the two-tier tax structure on tobacco
farmers; and the amount of taxes that can be
collected from tobacco and alcohol products. Rep.
Suarez sought the assurance of the Sponsor regarding
alternative livelihood assistance for farmers and
expressed hope that the House version of the Bill
would not be watered down.
INTERPELLATION OF REP. REMULLA
Recognized by the Chair, Rep. Jesus Crispin C.
Remulla asked on the rationale for adopting a two-
tier rather than a unitary tax system; the percentage
of national taxes that the so-called “sin taxes” would
constitute; and the inclusion of gambling in the
measure.
Reps. Remulla and Ungab then debated on the
relationship between revenues and decline in demand
or consumption, on one hand, and smuggling, on the
other hand. They also discussed the primary aims of
the Bill to curb smoking and raise revenues
