Summary

1. Summary of Progress – April, 2020:


Total length of project is 47.60km from km 250.000 to km 298.000 with total cost 546.05Cr.
Appointed Date was 16/12/2019and scheduled date of completion of construction is15/06/2023(with
1278 days construction period).
Cumulative Physical progress is 4.3% (approx.).Financial progress is 2.29%.
Slow progress in land acquisition, with 42% pending acquisition. Out of the portion handed over
(27.319 km.), there has been land acquisition issues, with stoppage of work by Local Village Council,
due to non-payment of Compensation & such issue has been brought to notice of Authority for urgent
mitigation.(Refer Letter No-“ABCI/SITE/AE/NH54/PKG-6/2019-20/24” Dtd. 22-1-2020, & ref. letter “
ABCI/SITE/AE/NH-54/PKG6/2019-20/27” Dtd. 30.1.2020 regarding stoppage of works by Local
Village Council, Thingfal due to land issues.

2. Current Issues & Recommended Actions by AE:

1) Non Political Force Majeure event due to pandemic COVID-19:With effect from 12th March
2020, new Inner Line Permits were stopped & Bulk ILP curbed by State of Mizoram in view of
pandemic of COVID-19 thereby stopping any new ILP to state. From 22March2020, vide directive of
Home Dept. Govt. of Mizoram, lockdown was in force as preventive measure to curb spread of
COVID-19 pandemic from 22-March’20 to 29-March’20.Thereafter, vide directive of Hon’ble
Prime Minister of India,on24thMarch’20,lockdown from 25th March 2020 to 17th May, 2020 is
in force nation-wide to curb the spread of the pandemic situation. On account of this non-
political Force Majeure event, cascading impact is on Project Timeline and necessary revision of
Baseline Work Programme is required to address how to minimize the Time Impact, without
altering the Project Completion date(SCD).Revision of Work Program is in progress.
2) ROW handover: As on 31stJan. 2020, the total available stretch for Contract Pkg-6 is
approx. 27.319 Km. out of 47.60 Km. (58%). Hence, as per handed over stretches, sequential
construction plan has been prepared for Available ROW & Contractor will put in all efforts to
achieve project targets accordingly. However, in case of delayinreceiving90%of ROW,there could
be impact on Construction Sequence & project progress may be impacted.
3) Utility Shifting: Contractor has apprised regarding shifting of Utilities vide Cl. 9.2 as a separate
agreement. The same needs to be finalized in consensus with Authority/Authority Engineer, at
earliest to enable Contractor to proceed for current construction works(Earthworks)in time to
reach consecutive milestones of project. Contractor was conveyed of estimate approved by
NHIDCL for shifting of utilities prepared by the concerned utility owning department vide letter
no. NHIDCL/BO- Aizawl/2019-20 /221 dated 23-10-2019, which is based on the DPR alignment
of the project. However, this approved cost estimate is not final and subject to change as the
actual cost for shifting of utilities will depend on work done as per the final approved Plan &
Profile by contractor.

4) S poil bank location finalization, approvals: For ongoing earth works, the location, with
adequate capacity for surplus soil dumping appropriately, & in compliance with statutory norms,
the finalizations need to be processed expeditiously .As on date, design of Spoil Bank is being
revised & will be resubmitted for due approval of A.E. As instructed by Executive Director
(Projects), RO Aizawl, NHIDCL, during his visit to Site between 19th - 20th March’20, EPC
Contractor will identify other spoil bank locations, get NOC/permission from concerned Village
Council President/Revenue Authority and submit the design of these Spoil Banks for approval by
AE. However, all activities in Sl.No.4) are impacted adversely due to Lockdown for COVID-19
pandemic.

11. Status of Utilities shifting

 The contractor has informed Authority’s Engineer regarding existing telephone poles and optical fibre cables which are required to be
shifted/relocated for construction of project and requested to take up the matter to concerned utility owning department for the needful
action vide our letter no ABCI-BHARTIA JV/KOL/NHIDCL/NH-54/PKG-6/2019-20/1098 dated 21-11-2019.

 The contractor has requested the utility owning department-PHE department & P&E dept. for cost estimate for removal of existing
hindering water pipeline and electric pole vide our letter ABCI-BHARTIA JV/Site/AE/NH-54/PKG-6/2019-20/02 and ABCI-
BHARTIA JV/Site/AE/NH-54/PKG-6/2019-20/03 both dated 18-11-2019 respectively.

 Further Contractor apprised Authority’s Engineer that shifting of utilities will be considered as a separate agreement necessitating as
per Clause 9.2 of Contract Agreement vide our letter ABCI-BHARTIA JV/KOL/NHIDCL/NH-54/PKG-6/2019-20/1082 dated 19-11-
2019.

 Contractor was conveyed of estimate approved by NHIDCL for shifting of utilities prepared by the concerned utility owning
department vide letter no. NHIDCL/BO-Aizawl/2019-20 /221 dated 23-10-2019, which is based on the DPR alignment of the project.

 Vide letter No-NHIDCL/PMU-Lunglei/Tech/Pck/5/01 Date-7-03-20, by GM (Projects), NHIDCL, PMU – Lunglei, Reg. Utility
Shifting addressed to the Deputy Commissioner (CALA), Lunglei District, it was mentioned that urgently Utility shifting is required
for water pipelines & electric lines & that E in C of P&E Department & PHE Department had forwarded estimates in this regard and
as Funding Agency (JICA) has categorically mentioned that no revision / change in estimate is permissible, in referenced letter it has
been indicated that Utility Owning Departments to adhere to their earlier Estimates as submitted for the execution of Utility Shifting,
as indicated earlier by MD, NHIDCL, during review Meeting of 27-2-20 at New Delhi & also MD, NHIDCL having written to IAS
Chief Secretary, Government of Mizoram in this regard.

 On 17th March 2020, a Joint meeting was held between Power & Electricity Dept, Authority Engineer, & EPC Contractor regarding
approved estimate & revised estimate yet to be submitted by Power Maintenance Div-II, Lunglei . Modality formulated with Joint
Inspection done; with reference to outcome of Jt. Inspection, estimate based on actual is to be prepared by Utility Owning dept.
(Power & Electricity Dept.) and on approval of same by Supdt. Engineer, Lunglei Power Circle, further course of action to be taken
up.The submission of this estimate by P&E Dept. (as decided on 17th March’20 Joint Meeting) is awaited at time of reporting for this
MPR (30-April 2020). In view of prevailing pandemic situation, there has been delay in receiving the Estimate from P&E Dept.To
expedite the resolution of matter, EPC Contractor requests Authority to facilitate for a tripartite agreement between
Authority, Utility owning department & Contractor regarding all applicable terms & conditions for the necessary shifting of
utilities by the Utility Owning department, to prevent any scope increase in future for reasons not attributable to Contractor.

16. Monitoring of Operations & Maintenance Obligations

Maintenance of Project Highway: Pursuant to clause 4.2 of the Contract Agreement the contractor has informed
the Authority regarding maintenance obligation of existing road which is in much dilapidated condition causing
severe discomfort to the road users, prior to Appointed Date; vide our letter ABCI-BHARTIA
JV/KOL/NHIDCL/NH-54/PKG-6/2019-20/1193 dated 09-12-2019. The Authority’s engineer has already
submitted an estimate for maintenance works vide their letter ICT/840/MIZ (PKG-6)/NHIDCL/SS: 008 dated
16-12-2019. Revised Estimate of Maintenance of Project Highway also submitted by A.E. Sanction of estimate
is awaited from Authority in this regard.
To ensure the Maintenance of roads as Essential services, during current lockdown in force for COVID-19
prevalent nation-wide, vide instruction of Deputy Commissioner’s Office, Lawngtlai District, dated 27th March
2020, only Emergency basis works viz. for landslide etc. will be permitted. Effective 17 th April’20 as per
permission granted by Ministry of Home Affairs, Government of India & State Government, construction
activities have resumed at Site Pkg-6.

17. Critical Issues & Action Log

Impact of COVID-19 Pandemic Risk Event as Non-Political Force Majeure event: Ample resources both
men and machineries have been already mobilised and functioning at site. However, due to nation-wide
lockdown for COVID-19 pandemic, the situation of workforce, & machinery, construction materials have
been disrupted adversely with: -
-Inner Line Permits (ILP) for State of Mizoram being stopped for New workers & Bulk ILP being stopped,
vide circular of Govt. of Mizoram since 12.3.20. As on date of reporting (30th April’20), the ILP is not being
permitted for out of state labour & no new ILP is being granted, to prevent spread of pandemic.
- Order by Government of Mizoram (Police Headquarters): Aizawl a lockdown was called from 22nd March
2020 to 29th, March 2020 vide their Order No PHQ/IGP(L&O)/73/COVID-19/2020/1095, dated 21st March
2020.
- Order by Hon’ble Prime Minister, Government of India for 37 Day lockdown period nationwide with effect
from 25th March 2020 & is currently ongoing nationwide in force till 17th May 2020.
- Workforce limited in number & only activities pertaining to emergency maintenance is being taken up. -
Supply chain disruption, material, labour and other resources badly affected.This adverse impact on supply
chain, labour & other material resources affecting progress of works since 12th March 2020 till date (as
on date of reporting) continues as pandemic is prevailing nation-wide.
- As on 17th April’20, permission was accorded by directive of Ministry of Home Affairs Government of
India & State Government to resume construction activities whereby work restarted.
However as per guidelines stipulated during prevalence of COVID-19, all necessary restrictions are in force
& being duly followed by EPC Contractor.With the social distancing norms, restriction on number of
people working in group, restriction on transport, Inner Line Permit, supply chain disruptions, all have
contributed to markedly slowing the project progress from 12thMarch 2020 to till date (30th April 2020).
