PURPOSES"

Secjtien i. Title - These Rules shall be known and cited as the Implementing Rules and
Regulations of Republic Act No. 10121 also known as the Philippine Disaster Risk Reduction
and Management Act of 2010 (PDRRM Act of 2010),

Section 2. P u r p ose —These Rules are hereby promulgated to prescribe the manner,
procedures and guidelines for the implementation of the PDRRM Act of 2010, to facilitate
compliance therewith, and achieve the objectives thereof.

Section 3. D e clat alien of Policy - It is the policy of the State to:

(a) Uphold the people's constitutional rights to life and property by addressing the root
causes oi' vulnerabilities to disasters, strengthening the country's institutional capacity
For diisaster risk reduction and management, and building the resilience of local
cornrnunities to disasters including climate change impacts;

(b) Adhere to and adopt the universal norms, principles, and standards of humanitarian
assistance such as the Universal Declaration of Human Rights, UN Guiding Principles
and Guidelines on Internal Displacement and Durable Solutions, Convention on the
Elimination of Discrimination Against Women (CEDAW), Convention on the Rights of
the Child and tHe global ef'fort on risk reduction as concrete expression of the country' s
commitment to overcome human sufferings due to recurring disasters;

(c) Incorporate internationally accepted p r inciples and guidelines o f d i saster risk


management in t h e c r eation and i mplementation of' nationa'I, regional and iocal
sustainable development and poverty reduction strategies, policies, plans and budgets;

(d) Adopt a di s a ste~ risk reduction an d m a n agement a p proach t ha t i s h o l istic,


comprehensive, i ntegrated, a nd proactive i n l e ssening t h e socioeconomic and
environmental impacts of disasters including climate change, and p romote t he
involvement and participation of all sectors and all stakeholders concerned, at aII
levels, especially the local community;

(e) Develop„promote, and implement a comprehensive National Disaster Risk Reduction


and Management Plan (NDRRMP) that aims to strengthen the capacity of the national
government and t h e l ocal government units (LGUs), together with partner
stakeholders, to build 'the disaster resilience of communities, and - to institutionalize
arrangements and measures for reducing disaster risks, including projected climate
risks, and enhancing disaster preparedness and response capabilitiies at all levels;

(f) Adopt and implement a coherent, comprehensive, integrated, efficient and responsive
disaster risk reduction program incorporated in the development plan at various levels
of government adhering to the principles of good governance such as transparency
and accountability w i thin t h e c o ntext o f p o v erty a l leviation and envirom
nental
protection;

(g) Mainstream disaster risk reduction and climate change adaptation and mitigation in
development processessuch as polic y formulation, socioeconomic development
planning, budgeting, and g overnance, particularly In t h e a r eas o f e n v ironment,
agriculture„water, energy, health, education, poverty reduction, land-use and urban
planning, and public infrastructure and housing, among others;

(h) Institutionalize the policies, structures, coordination mechanisms andprograms with


continuing budget appropriation on disaster risk reduction from national down to focal
levels towards building a disaster-resilient. nation and communities;

(i) M ainstream disaster risk reduction into th e p eace process and conflict resolution
approaches in order to minimize loss of lives and damage to property, and ensure that
communities in conflict zones including Internally Displaced Persons (IDPs) can
Immediately go back to their normal lives during periods of intermittent conflicts;
(j) Ensure that disaster risk reduction and climate change measures are gender
responsive, sensitive to indigenous knowledge systems and cultures, and respectful of
human rights;

(k) Recognize the local risk patterns across the country and strengthen the capacity of
LGUs for disaster risk reduction and management through decentralized powers,
responsibilities, and resources at the regional and local levels;

(I) Recognize and strengthen the capacities of LGUs and communities in mitigating and
preparing for, responding to, and recovering from the impact of disasters;

(rn) Engage the participation of civil society organizations (CSOs), the private sector and
volunteers I n t he gov e r nment's disaster r i s k re d u ction p r o grams towards
complementation of resources and effective delivery of services to the citizenry;

(n) Develop and strengthen the capacities of v u lnerable and marginalized groups to
mitigate, prepare for, respond to, and recover from the effects of disasters;

(o) Enhance and Implement a program where humanitarian aid workers„communities,


health professionals, government aid agencies, donors, and the media are educated
and trained on how they can actively support breastfeeding before and during a
disasterand/or an emergency; and

(p) Provide maximum care, assistance and services to Individuals and families affected by
disaster, implement emergency rehabilitation projects to lessen the impact of disaster,
and facilitate resumption of normal social and economic activities,

SectIon 4. - Scope of Appiicstion - These Rules provide for the development of policies
and plans and the implementation of actions and measures pertaining to all aspects of
disaster risk reduction and management, including good governance, risk assessment and
early warning, knowledge building and awareness raising, reducing underlying risk factors,
and preparedness for effective response and early recovery. These shall apply to all levels
of government, civil societies, private sectors and all other DRM stakeholders.
Section 1 = Whenever used in these FLules, the following shall refer to;

"Adaptation" - the adjustment in natural or human systems in response to actual or


expected climatic stimuli or their effects, which moderates harm or exploits beneficial
opportunities.

(b) "Capacity" - a combination of a i l s t r engths an d r e sources available within a


community, society or organization that can reduce the level of risk, or effects of a
disaster, Capacity may include Infrastructure and physical means„ institutions, societal
coping abilities, as w ell a s h u man k nowledge, skills, tools, systems, processes,
appropriate t echnologies and c o llective attributes such a s s o cial r e lationships,
leadeirshlp and management. Capacity may also be described as capability.

(c) "Civil Defense" — diisaster preparedness and prevention activities, other than military
actions, geared towards the reduction of loss of life and property brought about by
natural and human-Induced disasters. Civil Defense may also be referred to as Civil
Protection.

(d) "Civil Society Organizations" or "CSQs" - non-state actors whose aims are neither to
generate profits nor to seek governing power. CSQs unite people to advance shared
goals and interests. They have a presence in public life, expressing the interests and
values of their members or others, and are based on social, ethical, cultura'I, scientific,
religious or philanthropic and other considerations. CSQs include non-government
organizations (NGOs), professional associations, foundations, independent research
ilnstitutes, community-based organizations (CBOs), faith-based organizations, people' s
organizations, social movements, and labor unions.

"ClimateChange" — a change in climate that can' be identified by changes in the mean


and/or variability of Its properties and that persists for an extended period typically
decades or longer, whether due to natural variability or as a result of human activity.

"Community-Based DisasterRIsk Reduction and Management" or "CBDfMM" - a


process of disaster risk reduction and management in which at risk communities are
active'ly engaged in the identification, analysis, treatment, monitoring and evaluation
of disaster risks in order to reduce their vulnerabiiitles and enhance their capacities,
and where the people are at tHe heart of decision-making and implementation of
disaster risk reduction and management activities.
"Complex Emergency"— a form of humain-induced emergency in whichthe cause of'
the emergency as well as the assistance to the afflicted is complicated by intense level
of political considerations.

"Contingency Planning" - a management process that analyzes specific potential


events or emerging situations that might threaten society or the environment and
establishes arrangements in advance to enable timely, effective and appropriate
responses to such events and situations.

"Disaster" - a serious disruption of the functioning of a community or a society


involving widespread human, material, economic or environmental losses and impacts,
which exceeds the ability of the affected community or society to cope using Its own
r esources. Disasters are often described as a r e sult o f t h e c o mbination of: t h e
exposure to a hazard; the conditions of vulnerability that are present; and Insufficient
capacity or measures to reduce or cope with the potential negative consequences.
Disaster impacts may Include loss of life, injury, disease and other negative effects on
human, physical, mental and social well being, togethel with damage to property,
destruction o f a s s ets, l os s o f s e r v ices, s ocial and e c onomic d i sruption a n d
environmental degradation.

"Disaster Mitigation" - the lessening or limitation of the adverse impacts of hazards


and related disasters. Mitigation measures include but not limited to the engineering
techniques and hazard-resistant construction but includes as well as Improved
environmental policies and programs ahd public awareness.

"Disaster Preparedness" - the knowledge.and capacities developed by governments,


professional response and recovery organizations, communities and Individuals to
effectively anticipate, respond to, and recover f'rom - the impacts of likely, imminent
or current hazard events or conditions. Preparedness action is carried out within the
context of disaster risk reduction and management and aims to build the capacities
needed to efficiently manage all types of emergencies and achieve orderly transitions
from response to sustained recovery. Preparedness is based on a sound analysis of
disaster risk, and good linkages with early warning systems, and includes such
activities as c o ntingency planning, stockpiling of equipment and suppli
es, the
development of arrangements for coordination, evacuation and public information, and
associated training an d f i el d e x ercises. These must b e s u p ported b y f o r mal
institutional, legal and budgetary capacities.

"Disaster Prevention" - the outrightavoidance of adverse impacts of hazards and


related disasters. It expresses the concept and intention to completely avoid potential
adverse impacts through action taken in advance such as construction of dams or
embankments that eliminate flood risks, land-use regulations that do not permit any
settlement' ln h i gh-risk zones, and seismic engineering designs that ensure the
survival and function of a critical building in any likely earthquake.

(m) "Disaster Response" - the provision of emergency services and public assistance
during or immediately after a disaster in order to save lives, redure health impacts,
ensure publicsafety and meet the basic subsistence needs of the people affected.
Disaster response Is predominantly focused on Immediate and short-term needs and is
sometimes called "disaster relief".

"Disaster Risk" - the potential disaster losses in lives, health status, livelihood, assets
and services, which could occur to a particular community or a Society over some
specified future time period.
"Disaster Risk Reduction" - the concept and practice of reducing disaster risks through
systematic efforts to analyze and manage the causal factors of disasters, including
through reduced exposures to hazards, lessened vulnerability of people and property,
wise management of l and and th e e nvironment, and i mproved preparedness for
adverse events.

(p) "Disaster Risk Reduction and Management" - the s y stematic process of u s ing
administrative directives, organizations, and o perational skills and c apacities to
implement strategies, policies and improved coping capacities in order to lessen the
adverse impacts of hazards and the possibility of disaster. Prospective disaster risk
reduction and management refers to risk reduction and management activities that
address and seek to avoid the development of new or increased disaster risks,
especially if risk reduction policies are not put in place.

"Disaster Risk Reduction and Management Information System" - a specialized


database which contains, among others, information on disasters and their human
material, economic and environmental impact, risk assessment and mapping and
vulnerable groups,

Disaster Victims — persons or group of persons who have been adversely affected by a
natural or human-induced hazard who have to leave their habitual places of residence
due to exiting or impending threats, damaged shelter u~nits, with casualty among
immediate family members or those who remained in their habitual places of origin
when still habitable but whose main sobrce of income or livelihood had been damaged~
a nd are experiencing hopelessness and difficulty in c oping or r esponding to t h e
onslaught ofthe hazardous events on their own resources.

"Early Recovery" — multidimensional process of recovery that begins in a humanitarian


setting. It is guided by development prinopies that seek to build on humanitarian
programmes and catalyze sustainable development opportunities. It alms to generate
self-sustaining, nationally-owned, resi'lient processes for p o st-crisis recovery. It
encompasses the r estoration of b asic services, livelihoods, shelter, governance,
security and rule of law, environment and social dimensions, including reintegration of
dispiaced populations.

"Early Warning System" — the set of capacities needed to generate and disseminate
timely and meaningful warning information to enable individuals, comrnunltles and
organizations threatened by a hazard to prepare and to act appropriately and in
sufficient time to reduce the possibility of harm or loss. A people-centered early
warning system necessarily comprises four (4) key elements: knowledge of the risks;
monitoring, analysis and forecasting of the hazards; communication or dissemination
of alerts and warnings; and local capabilities to respond to the warnings received. The
expression"end-to-end warning system" is also used to emphasize that warning
systems need 'to span all steps from hazard detection to community response.

"Emergency" - unforeseen or sudden occurrence, especially danger, demanding


immediate action,

(v) "Emergency Management" - the organizationand management of resources such as


volunteers„ funds, donations, food and non food items, temporary/evacuation centers,
and responsibilities fo r a d d ressing al l a s pects of emergencies, i n p a r t icular
preparedness, response and initial recovery steps.

(w) "Exposure" - the degree to which the elements at risk are likely to experience hazard
events of different magnitudes.

(x) "Geographic Information System" - a database which contains, among others, geo-
hazard assessments„ information on climate change, and climate risk reduction and
management.

"Hazard" - a dangerous phenomenon, substance, human activity or condition that may


cause loss of life, injury or other health impacts property damage, loss of livelihood
and services, social and economic disruption„or environmental damage.

Internally Displaced Persons (IDPs) or Persons Displaced by the Disaster — are persons
or groups of persons who have been forced or obliged to flee or to leave their homes
or places of habitual residence, In particular as a ~esult of' or in order to avoid the
effects of n a t ural o r h u m an-induced disasters, and w h o h av e n o t c r ossed an
internationally recognized State border.

(aa) "Land-Use Plannlngi"' - the process undertaken by p u blic authorities to i dentify,


evaluate and decide on different options for the use of land Including consideration of
long-term economic, social and environmental objectives and the Implications for
different communities and interest groups, and the subsequent formulation and
promulgation of plans that describe the permitted or acceptable uses.

(bb) "Mitigation" - structural and non-structural measures undertaken to limit the adverse
impact of natural hazards, environmental degradatio in, and technological hazards and
to ensure the a b ility of a t - r isk communities to a ddress vulnerabilitles aimed at
m inimizing the impact of disasters. Such measures include, but are not l i mited to,
hazard-resistant construction and engineering works, the formulation and
imple
mentation of plans, p rograms, projects an d a c t ivities, awareness raising,
knowledge management, policies on land-use and resource management, as well as
the enl'orcement of comprehensive land-use planning, building and safety standards,
and legislation.

(cc) "National Disaster Risk Reduction and Management Framework" or "NDRRM


Framework' - provides for comprehensive, all hazards, multi-sectoral, inter-agency
andcommunity-based approach to disaster risk reduction and rnanagernent.
(dd) "National Disaster Risk Reduction and Management Plan" or "NDRRMP" - the document
to be formulated and implemented by the Office of Civil Defense (OCD) that sets out
goals and specific objectives for reducing disaster risks together with related actions to
accom
plish these objectives.

The NDRRMP shall provide for the identification of hazards, vulnerabilities and risks to
be managed at the national level; disaster risk reduction a ind management approaches
and strategies to be applied in managing said hazards and risks; agency roles,
responsibilities and lines of a uthority at al l g overnment levels; and vertical and
horizontal coordination of disaster risk reduction and management in the pre-disaster
and post-disaster phases and the budgetary resources to implement the plan. It she' ll
be in conformity with the NDRRM Framework.

"Post:-Disaster Recovery" - the restoration and improvement where appropriate, of


facilities, livelihood and living conditions of disaster-affected communities, Including
efforts to reduce disaster risk factors, in accordance with the principles of "build back
better"

"Preparedness" — pre-disaster actions and measures being undertaken within the


context of disaster risk reduction and management and are based on sound risk
analysis as well as pre-disaster activities to avert or minimize loss of life and property
such as, but not l i mited to, community organizing, training, planning, equipping,
stockpiling, hazard mapping, insuring of assets, and public i nformationand education
initiatives.

"Private Sector" - the key actor in the realm of the economy where the central social
concern and process are the mutually beneficial production and distribution of goods
and services to m eet t h e p h ysical needs of h u man b eings. The private sector
comprises private c o rporations, h ouseholds an d n o n profit i n stitutions serving
households.
(hh) "Public Sector Employees" — al'I persons In the civil service.
"Rehabilitation" - measures that ensure the ability of affected communities/areas to
restore their normal level of functioning by rebuilding livelihood and d amaged
Infrastructures and increasing the cornrnunities' organizational capacity.

"Resilience" - the ability of a system, community or society exposed to hazards to


resist, absorb, accommodate and recover from the effects of a hazard ln a timely and
efficient manner, Including through the preservation, and' restoration of its essential
basic structures and functions.

(ikk) "Response" - any concerted effort by two (2) or more agencies, public or private, to
provide assistance or intervention during or immediately after a disaster to meet the
life preservation and basic subsistence needs of those people affected and in the
restoration of essential pub'lic activities and facilities.

"RIsk" - the combination of the probability of an event and its negative consequences.
Also, the probability of harmful consequences, or expected losses (deaths, injuries,
properties, livellhoods, economic activity disruption or environment damage) resulting
from (nteractions between natural, human-induced hazards and vulnerable conditions.

(mm) "Risk Assessment" — a methodology to determine the nature and extent of risk by
analyzing potential hazards and evaluating existing conditions of vulnerability that
together could potentially harm exposed people, property„services„ livelihood and the
environment on whichthey depend. Risk assessments with associated ~
risk mapping
include: a review of the technical characteristics of hazards such as their location,
intensity, frequency and p r obability; th e a n alysis of e x posure and v u lnerability
including the physical, social, health, economic and environmental dimensions, and
the evaluation of the effectiveness of prevailing and alternative coping capacities in
respect to likely risk scenarios.

"Risk Management" — the systematic approach and practice of managing uncertainty to


minimize potential harm and loss. 7t comprises risk assessment and analysis, and the
implementation of strategies and specific actions to control, reduce and transfer risks.
It is widely practiced by organizations to minimize risk in investment decisions and to
address operational risks such as those of business disruption, production failure,
environmental damage, social impacts and damage from fire and natural, hazards.

"Risk Transfer" - th e p r ocess o f f o r mally o r i n f o rmally s hifting t h e f i nancial


consequences of particular risks from one party to another whereby a household,
community, enterprise or state authority shall obtain resources from the other party
aRer a disaster occurs, in exchange for ongoing or compensatory social or financial
benefits provided to that other party.

(pp) "State of Calamity" — a condition involving mass casualty and/or major damages to
property, disruption of means of livelihoods, roads and normal way of life of people in
the affected areas as a result of the occurrence of natural or human-induced hazard.
"Sustainable Development" - development that meets the needs of the present
wIthout compromising the ability of future generations to meet their own needs. It
contains within it two (2) key concepts: (1) the concept of "needs", in particular, the
essentlali needs of' the world's poor, to which overriding priority should be given; and
(2) the idea of limitations imposed by the state of technology and social organizations
on the environment's ability to meet present and future needs. It Is the harmonious
integration of a sound and viable economy, responsible governance, social cohesion
and harmony, and ecological integrity to ensure that human development now and
through future generations is a life-enhancing process.

(rr) " V olunteer" — individual/person or group who for reasons arising from their socio-
developmental, business a nd corporate o rientation, c ommitment o r conviction,
contribute time, service, and, resources whether full time or part time base to a just
and essential social development cause, mission or endeavor in the belief that their
a ctivity Is m u t ually meaningful and b eneficial to p u blic i nterest as w ell a s t o
themselves.

(ss) "Vulnerability" - the characteristics and circumstances of a cornrnunity, system or


asset that make it susceptible to the damaging effects of a 'hazard. Vulnerability may
arise from various physical, social, economic, and environrnentai factors such as poor
design and construction ot buildings, inadequate protection of assets, lack of public
information and awareness, limited official recognition of r isks and preparedness
measures, and disregard for wise environmental management.
('lt) " V u lnerable and Mafglnallzed Gloups — IncIudes Individuals or gloups of people 'that
face higher exposure to disaster ris'k and poverty including, but not li mited to, women,
especialiy pregnant women, youth, children especially orphans and unaccompanied
children, elderly, differently-abled people, indigenous people, the disadvantaged
families and individuals living in high risk areas and danger zones, and those living in
the road right-of-ways and highly c o ngested a reas v u lnerable t o i n d ustrial,
environmental, health hazards and road accidents. Induded Into the exposures of
poverty are the marginaiized farmers and fisher folks,

Section i. N a t ional N sasttar Nak R eduction and Nanaciament Coundl - The present
National Disaster Coordinating Council or NDCC shall henceforth be known as the National
Disaster Risk Reduction and Management Council, hereinafter referred to as the NDRRMC or
the National Council.

Section R. Compoal ition - The National Council shall be headed by the Secretary of the
Department o f N a t ional Defense ( DND) a s C h airperson w ith th e S ecretary o f t h e
Department of the Interior and Local Government (DILG) as Vice Chairperson for Disaster
Preparedness, the Secretary of the Department of Social Welfare and Development (DSWD)
as Vice Chairperson for Disaster Response, the Secretary of the Department of Science and
Technology (DOST) as Vice- Chairperson for Disaster Prevention and Mitigation, and the
Director-General of the National Economic and Development Authority (NEDA) as VIce
Chairperson for Disaster Rehabilitation and Recovery. Other members of the Council are:

(a) Secretary of the Department ofHealth (DOH);


(b) Secretary of the Department of Environmentand Natural Resources (DENR);
(c) Secretary of the Department ofAgriculture (DA);
(d) Secretary of the Department ofEducation (DepEd);
(e) Secretary of the Department of Energy (DOE);
(f) S ecretary of the Departmentof Finance (DQF)„
(g) Secretary of the Department of Trade and Industry (DTI);
(h) S ecretary of the Department of Transportation and Communications (DOTC),'
(i) Secretary of the Department ofBudget and Management (DBM);
(j) Secretary of the Department of Pubiic Works and Highways (DPWH);
(k) S e cretary of the Department of Foreign *f'fairs (DFA);
(I) S e cretary of the 'Department of 3ustice (DQ3)',
(rn) Secretary of the Department of Labor and Employment (DOLE);

(x) Chairperson, Housing and Urban Development Coordinating Council (HUDCC);
(y) E x ecutive Director of'the Cli mate Change Office of the Climate Change Commission;
(z) President, Government Service Insurance System (GSIS);
(aa) President, Social Security System (SSS);
(bb) President, Philippine Health Insurance Corporation (PhilHealth);
(cc) President of the Union of Local Authorities of the Philippines (U'LAP);
(dd) President of the League of Provinces of the Philippines (LPP);
(ee) President of the League of Cities of the Philippines (LCP);
(ff) P resident of the League of Municipalities of the Philippines (LMP);
(gg) President of the Llga ng Mga Barangay (LMB);
(hh) Four (4) representatives from the CSQs;
(ii) One (1) representative from the private sector; and
(jj) A d m inistrator of thee QCD.

In case of the CSO and private sector representatives, the National Council shall
provide for the guidelines of selection and screening thereof.

Section 3. Pemelrs and Functlans - The National Council, being empowered with policy
making, coordination, integration, supervision, monitoring and evaluation functions, shall
have the following responsibilities:
Develop a NDRRM Framework which shall provide for comprehensive, all-hazards,
multi-sectoral, inter-agency and community-based approach to disaster r Iiisk reduction
and management. The Framework shall serve as the principal guide to disas'ter risk
reduction and management efforts in the country and shall be reviewed on a five (5)-
year interval, or as may be deemed necessary, in order to ensure its relevance to the
times;

Ensure that the NDRRM Plan is consistent with the NDRRM Framework;

(c) Advise the President on the status of disaster preparedness, prevention, mitigation,
response and rehabilitation operations being undertaken by the government, CSOs,
private sector, and volunteers; recommend to the President the declaration of a state
of calamity in areas extensively damaged; and submit proposals to restore normalcy in
the affected areas, to include calamity fund allocation,'

Ensure a multi-stakeholder participation in the development, updating, and sharing of


a Disaster Risk Reduction and Management I~formation System and Geographic
Information System-based national risk map as policy, planning and decision-making
tools;
Establish andh/or strengthen a comprehensive, all hazards national early warning and
emergency alert system to provide accurate and timely advice to national or local
emergency response organizations and to the general public through diverse mass
media to include digital and analog broadcast, cable, satellite television and radio,
wireless communications, and landline communications;

Develop appropriate risk transfer mechanisms that shall guarantee social and
economic protection and increase resiliency in the face of disaster;

Monitor the development and enforcement by agencies and organizations of'the


various laws, guidelines, codes or technical standards required by the Act;

Manage and mobilize resources for dlshsier risk reduction and management including
the NationalDisaster Risk Reduction and Management Fund;

Provide necessary guldhelines and procedures, and monitor the Local Disaster Risk
Reduction and Management Fund (LDRRMF) releases as well as utilizatlon, accounting
and auditing thereof;

Develop assessment tools on the existing and potential hazards and risks brought
about by climate change to vulnerable areas and ecosystems ln coordination with the
Climate Change Commission,'

Develop vertical an d h o r izontal coordination mechanisms for a more coherent


imple
mentation of disaster risk reduction and management policies and programs by
sectoral agencies and LGUs;

Formulate a national institutional ca ipability building program for disaster risk reduction
and management toaddress the specific weaknesses of various government agencies
and LGUs, based on the results of a biennial baseline assessment and studies.

(m) Formulate, harmonize, and translate into policies a national agenda for research and
technology development on disaster risk reduction and management;

In coordination with the Climate Change Commission,formulate and implement a


frameworkforclimate change adaptation and disaster risk reduction and management
from which all policies, programs, and projects shall be based;

Constitute a t echnical management group composed of representatives of the


abovernentioned departments, offices, and organizations, that shall coordinate and
meet as often as necessary to effectively manage and sustain national efforts on
disaster risk reduction and management;
Task the OCD to conductperiodic assessment and performance monitoring of the
member-agencies of th e NDRRMC, and the Regional Disaster Risk Reduction and
Management Councils (RDRRMCs), as defined in the NDRRMP;

Coordinate or oversee the implementation of the country's obligations with disaster


managem

Section 4. Authority of the Chairperson - The Chairperson of the NDRRMC may call upon
other IinstrumentaHtles or entlti ies of the government and non-government, civic and private
organizations for assistance In terms of the use of their tacilities and resources for the
protection and preservation of life and properties in the whole range of disaster risk
reduction and management. This authority includes the power to call on the reserve force as
defined in Republic Act No. 7077 to assist in relief and rescue during disasters or calamities.

Section 5. Duties Ca Responsibilities of the National Council members

Section 6. Meetings of the National Council —The National Council shaH meet regularly
every quarter on dates and place to be determined by the said council. The Chairperson of
the Council may call for a special meeting as the need arises. The CouncH shall formulate
internal rules for its meetings.

RULE 4- RKGXONAL M S A STER RXSK REDUCTXON AND MANAGEMENT

Section 1. Regional Disaster Risk Reduction and Management Councils -The current
Regional Disaster Coordinating Councils shaH henceforth be known as the Regional Disaster
RiskReduction and Management Council
s (RDRRMCs).
Section 2. Composition - The Civil Defense Officers of the OCD who are or may be
designated as Regional Directors of the OCD shall serve as chairpersons of the RDRRMCs.
Its Vice Chairpersons shall be the Regional Directors of the DSWD, the DIL6, the DOST, and
the NEDA. The RDRRMCs shallbe composed of the executives of regional oÃces and field
stations (at the regional level] of [the] government agencies that are members of the
National Council,

Section 3. Functions and responsibilities- Except for the policy making function of the
NDRRMC, the RDRRMCs shall likewise carry out coordination, integration, supervision,
monitoring and evaluation functions covering Regiona'I Council Member Agencies and the
Local Disaster Risk Reduction Management Councils (LDRRMCs) within their jurisdictions.
The RDRRMC shall a'Iso be responsible in ensuring risk-sensitive regional development plans,
and ln case of emergencies, shall convene the different regional line agencies and concerned
institutions and authorities.

3.1. The RDRRNC Chairperson may tapthe facilities and resources of other government
agencies and' private sectors, for the protection of life and properties in pursuit of
disaster risk reduction and management.

3.2. T h e R D R RMCs s h el l c o n stitute a technical working group composed of


representatives of the member agencies that shall coordinate and meet as often as
necessary to effectively manage and sustain regional efforts o n d i saster risk
reduction and management.

Section 4. M e e 5 ngs and Secretariat - The RDRRMC shall meet regularly every quarter
on dates and place to be determined by the Regional Council. The Chairperson of the
Council may call tor a specia'I meeting as tfie need arises. The existing regional offices of
GCD sha~ll serve as secretariat of the RDRRMCs. The CouncH shall formulate internal 'rules
for Its meetings.

Section 5. Opematiens Center —The RDRRNCs shall establish an operating facility on a 24-
hour' basis, to be known as the Regional Disaster Risk Reduction and Management
Operations Center (RDRRMGC).

Every member agency of the RDRRNC shell establish its respective Emergency Operations
Center (EOC), subject to exemptions granted by the Regional Council, and shall designate a
focal officer I'or DRRM.

(MMBRRMC) - In keeping with the provisions of Republic Act No. 7924 designating Metro
Manila as a special administrative region, the MNDRRMC shall, be chaired by the Chairperson
of the Metro Manila Development Authority (NMDA), It shall also have an organizational
structure similar to t hat o f t h e RDRRMCs to be composed of the executives of MMDA
departments or offices and/or regional offices or field stations operating In the National
Capital Region. OCD Civil Defense Officer designated as Regional Director of the National
Capital Region shall serve as the RDRRMC's Vice-Cha,irperson on Disaster Preparedness or
such other functions as may be determined by the MMDRRMC Chair.

All other national government agencies operating in NCR shall be members of the
MMDRRMC.

Section 7. A u t e nemeus Region in Muslim Mindanee (ARMM) - In t h e case of the


ARNM, the RegionalGovernor shell be the RDRRMC Chairperson. The RDRRMC - ARMM may
likewise have four (4) Vice Chairpersons comprising of «he Secretaries of the DSWD-ARNN
for Disaster Response, the DILG-ARMM for Disaster Preparedness, and the DOST-ARMM for
Disaster Mitigation and Prevention, and the Executive Director of the Regional Planning and
Development Office (RPDG) for Disaster Rehabilitation and Recovery. The RDRRMC-ARMM
shall formulate Internal rules for Its meetings.

Section 8 . O t h e r e n t i t ies -
RDRRMCs may invite o ther c oncerned institutions,
organizati
ons, agencies and instrumentalities ln the private and public sector when deemed
necessary to perform their mandate.
R ULE 5 — LOCAL DISASTER RISK REDU CT ION AN D M A N A G E M E N T
COUNCILS

Section i . L ocal Disaster Risk Reduction and Management Councils- The existing
Provincial, City, and M u n icipal Disaster Coordinating Councils shall henceforth be k n own as
the Provincial, City, an d M u n icipal Disaster Risk Reduction and M a nagement Councils. The
Barangay Disaster Coordinating Councils shall cease to exist and its powers and functions
shall henceforth be assumed by the existing Barangay Development Councils (BDCs) which
shall serve as the LDRRMCs in every barangay.

Section 2. Composition - As may be determined by the LDRRMC, it shall be composed of,


but not limited to, the following:

(1) The Local Chief Executive, Chairperson;

(2) The Local Planning and Development Officer, member;

(3) The Head of the LDRRMO, member;

(4) The Head of the Local Social Welfare and Development Office, member;

(5) The Head of the Local Health Office, member;

(6) The Head of the Local Agriculture Office, member;

( 7) The Head of the Gender and Development Office, member ;

(8) The Head of the Local Engineering Office, member;

(9) The Head of the Local Veterinary Office, member;


(10)The Head of the Local Budget Office, member;

(11)The Division Head/Superintendent of Schools/District Supervisor of the DepED, member;

(12)The highest-ranking officer of the Armed Forces of the Philippines (AFP) assigned in the
area, member;

(13)The Provincial / City D i r ector/Component City/ M unicipal Chief of t h e P h ilippine National


Police (PNP), member;

(14)The Provincial Director/City Municipal Fire Marshall of th e Bureau of Fire Protection


(BFP), member;

(15)The President of the Liga ng mga Barangay, member;

(16)The Philippine Red Cross (PRC), member;


(17) Four (4) accredited CSOs, member; and

(18)One (1) private sector representative, member.

2.1. The LDRRMC is encouraged to include the following as its members:

Section 3. Criteriafor @Sos and private'sector representative - The criteria for the
selection of CSOs and the private sector representation in the LDRRMC shall adhere with the
guidelines to be issued by the National Council for said purpose, including accreditation and
operational mechanisms or processes.

Section 4. Functions-The LDRRMCs shall have the following functions:

(1) Approve, monitor and evaluate the implementation of the LDRRMPs and annually review,
test and develop the plan consistent with other national and local planning programs;

(2) Ensure the integration of disaster risk reduction and climate change adaptation into local
developmentplans, programs and budgets as a strategy in sustainable developm
ent and
poverty reduction;

(3) Recommend the implementation of forced or preemptive evacuation of local residents, if


necessal y; and

(4) Convene the local council as provided by the Act and these Rules.

Section S.Meetings and Quorum - The meetings of the Local Councilsshallbe held once
everythree months on dates and place to be determined by the body. The Chairperson of
the Local Council may call for a special meeting as he may deerri necessary. The Loca,l
Councils shall promulgate their r espective internal rules for t h eir m eetings. The Local
Disaster Risk Reduction and Management Office (LDRRMO), referred to in the succeeding
Rule, shall serve as the Secretariat.

RULK 6 - LOCAL DlSASTKR RISK RKDUCTION AND NANAG K M KNT OFFICK


(LDRRNO)

Section 1.Establishment of an ONea - There is hereby created~an LDRRMO in every


province, city and municipality under the Office of the Governor, City or Municipal Mayor,
respectively, an d a B a r a ngay D isaster Risk R eduction and Management Committee
(BDRRMC) inevery barangay to be headed by the Punong Barangay.

Section 2. Composition and Structure - The LDRRMOs shall be initially organized and
composedo f a DRRMO to be assisted by three (3) staff responsible for: (1) administration
and training; (2) research and planning; and (3) operations and warning.

2.1. T h e b u dgetary source, compensation and hiring procedure for the DRRMO shall
conform to the rules and policies of the CSC and the DBM, among others.
Section 3. Qua l i fications of the D R RN O fficer - Th e D R RM Officer provided under
Section 12 (b) of the Act shall have the fallowing qualifications:

(a) Must be civil service eligible,


(b) Must have a Civil Defense/DRM experience.

Section 4. FMnctions -The provincial, city and municipal DRRMOs or BDRRMCs, In


coordination with concerned national agencies and instrumentalities, she' ll perform the
following functions with impartiality, given the emerging challenges brought by disasters of
our times:

(1) Set the direction, development, implementation and coordination of disaster risk
management programs within their territofial jurisdiction.

(2) Design, program„and coordinate disaster. irisk reduction and management activities
consistent with the National Council's standards and guidelines;

(3) Facilitate and support risk assessments and contingency planni ing activities at the local
level;

(4) Consolidate local disaster risk information which includes natural hazards, vulnerabilities,
and climate change risks, and maintain a local risk map;

(5) Organize and conduct training, orientation, and, knowledge management activities on
disaster risk reduction and management at the local level;

(6) Operate a multi-hazard early warning system, linked to disaster risk reduction to provide
accurate and timely advice to national or local emergency response organizations and to
the general public, t hrough diverse mass media, p a rticularly radio, landline
cornrnunications, and techno'logies for communication within rural communities;

(7)Formulate and implement a compre'hensive and' integrated LDRRMP in accordance with


the natonal, regional and provincial framework, and policies on disaster risk reduction in
close coordination with the local development councils (LDCs);

(8) Prepare and submit to the local sanggunian through the LDRRMC and the LDC the annual
LDRRMO Plan and budget, the proposed programmi~ng of the LDRRMF, other dedicated
disaster risk reduction and management resources, andh other regular funding source/s
and budgetarysupport of the LDRRMO/BDRRMC;

(9) Conduct continuous disaster monitoring and mobilize instrumentalities and entities of the
LGUs, CSOs, private groups and organized volunteers, to u t iiize their facilities and
resources for the protection and preservation of life and properties during emergencies ln
accordance with existing policies and procedures;

(19) identify, assess and manage the hazards vulnerabilities and risks that may occur in their
locality;

(11) Disseminate information and raise public awareness about those hazards, vuinerabilities
and risks, their nature, effects, early warning signs anal counter-measures;

(12) Identify and implement cost effective risk reduction measures/strategies;

(13) Maintain a database of human resource, equipment, directories, and location of critical
infrastructures and their rapacities such as hospitals and evacuation centers;
(14) Develop, strengthen and operationallze mechanisms for partnership or networking with
the private sector„CSOs„and volunteer groups;

(15) Take all necessary steps on a continuing basis to maintain, provide, or arrange the
provision of or to otherwise make available, suitably-trained and competent personnel for
effective civil defense and disaster risk reduction and management in its area;

(16) Organize, train, equip and supervise the local emergency response teams and the ACDVs,
ensuring that humanitarian aid workers are equipped with basic skills to assist mothers to
breastfeed;

(17) Respond to and manage the adverse efFects of emergencies and carry out recovery
activities in t h e a f f ected area, ensuring that there Is an efficient mechanism for
Immediate delivery of food, shelter and medical supplies for women and children,
endeavor to create a special place where Internally-displaced mothers andchil dren can
find help with breastfeedlng, feed and care for their babies and give support to each
other;

(18) Within its area, promote and raise public awareness of and compliance with the Act and
legislative provisions relevant to the purpose of the Act„

(19) Serve as the secretariat and executive arm of the LDRRMC;

(20) Coordinate other disaster risk reduction and management activities;


(21) Establish linkage/network with other LGUs for disaster risk reduction and emergency
response purposes;

(22) Recommend through the LDRRMCthe enactment of local ordinances consistent wit'h the
requirements of' this Act;

(23) implement policies, approved plans and programs of the LDRRMC consistent with the
policies and guidelines laid down in the Act;

(24) Establish a Provincial/City/Municipal/Barangay Disaster Risk Reduction and Management


Operations Center,"

(25) Prepare and submit, through the LDRRMC and the LDC, the report on the utilization of
the LDRRMF and other dedicated disaster risk reduction and management resources to
the local Commission on Audit (COA) for provincial/city level and internal audit f' or
municipal and component city level, copy furnished the regional director of the OCD and
the Local Government Operations Officer of the DILG; and

(26) Act on other matters that may be authorized by the LDRRMC.

Section 5. The BDRRNC - Lt shall be a regular committee of the existing BDC and shali be
subject thereto. The punong barangay shall facilitate and ensure the participation of at least
two (2) CS O r e presentatives from existing and active community-based people' s
organizations representing the most vulnerable and marginalized groups in the barangay.

Section 6. Local QNiinance- The local sanggunlan concerned shall enact the appropriate
ordiinance to create the DRRMO including the al'location of necessary staffing/personnel and
budget.
Section 7. Xnformation and Public Awareness on Hazards, Vulnerabilitlies and Risks-
Each LGU shall provide an area within its jurisdiction where hazard maps and contingency
plans for major hazards are prominently displayed. ln addition, information shall also be
disseminated through the internet andi' printed materials such as newsletters, brochures and
pamphlets.
Public awareness s ihall also be undertaken through conduct of drills by the LDRRMO on a
regular basis.

Section 8.Linking Local Database with the National Database - The local databases on
human resources, equipment, directories and location of critical infrastructures and their
capacities, developed and complied by t h e NDRRMOs shall be l i nked with th e n ational
database maintained bythe OCD.

Section 9. Access to database - The database shall be accessible and available to


everyone subject to reasonable restrictions arising from legal and security requirements, if
any. Specific information may be obtained provided that a written request is submitted and
under the condition that proper citation, and reference is made.

RUlK 7 - 7HE QFFXCE QF CXVXL DEFENSE


Section i. Mandate - The Office of Civil Defense (OCD), as the implementing arm of the
hLational Council, shall have the primary mission of administering a comprehensive national
civil defense and disaster risk reduction and management program by providing leadership in
the continuous development of strategic and systematic approaches as well as measures to
reduce the vulnerabilities and risks to hazards and manage the consequences of disasters.

Section 2. The Administrator - The Adrninlstiator of the GCD shall also serve as Executive
Director of the National Council and, as such, shall have the same duties and privileges of a
department undersecretary. The Administrator shall be a universa'lly acknowledged expert in
the field of disaster risk reduction management and of proven honesty and integrity.

Section 3. Powers and Functions -The OCD shalt have the following powers and functions
in partnership and i n c oordination with member agencies and in consultation with key
stakeholders, as maybe applicable.

(a) Advise the National Council on matters relating to d isaster risk reduction and
management consistent with the policies and scope as defined in these Roles;

(b) Formulate the NDRRMP within six (6) months from the affectivity of these Rules and
provide leadership in the implementation of the Plan. It shall ensure that the physical
framework, social, economic and environmental plans o f c o rnrnunitles,cities,
municipalitiesand provinces are consistent with such pian. The Strategic National Action
Plan (SNAP) for Disaster Risk Reduction (DRR) adopted through Executive Order No. 888
shall be used as the strategic foundation and building block for the NDRRMP. The National
Council shall approve the NDRRMP„

(c) Identity, assess and prioritize hazards a ind risks in consultation with key stakeholders;

(d) Develop and ensure the implementation of national standards and standard operating
procedures (SOP) i n c a rrying out disaster risk r eduction programs Including
preparedness, mitigation, prevention, response and r ehabilitation works, from data
collection and analysis, planning, implementation, monitoring and evaluation. These
national standards and SOPs shai'I be developed alongside the NDRRMP;
(e) Review and evaluate t h e l o ca l D i saster Risk R eduction and Management Plans
(LDRRMPs), in coordination with concerned agencies and or instrumentalities, to facilitate
the integration o f d i saster r isk r e duction measures into t h e l o cal Comprehensive
Development Plan (CDP) and Comprehensive Land-Use Plan (CLUP),

Ensure that the LGUs, through the Local Disaster Risk Reduction and Management Offices
(LDRRMOs) are properly informed and adhere to the national standards and programs;
Formulate standard o p erating p r ocedures fo r t h e d e p l oyment o f r a p i d d a mage
assessment and needs analysis (DANA) teams, information sharing among different
government agencies, and coordination before and after disasters at all levels;

(h) Establish an Incident command system (ICS) as part of the country's existing on-scene
disasterresponse system, to ensure effective consequence management of disasters or
emergencies;

Establish standard operating procedures on the communication system among provincial,


city, municipal,, and barangay disaster risk reduction and i management councils, for
purposes of warning and alerting them and for gathering information on disaster areas
before, during and after disasters;

Establish Disaster Risk Reduction and Management Traini tltutes in such suitable
location as may Oa deemed appropriate, in accordance nr ~ au -- erein;

Ensure that all disaster risk reduction programs, projects and activities requiring regional
and international support shal il be in accordance with duly established inational policies
and aligned with international agreements;

Ensure that government agencies and LGUs give top priority and take adequate and
appropriate measures in disaster risk reduction and management;

(m) Create an enabling environment for substantial and sustainable participation of CSQs,
private groups, volunteers and communities, and recognize their rontributlons in the
government's disaster risk ireduction efforts;
(n) Conduct early recovery and post-disaster needs assessment institutionalizing gender
analysis as part of it;

Establish an operating facility to be known as the National Disaster Risk Reduction and
Management Gperations Center (NDRRMGC) that shall be operated and staffed on a
twenty-four (24) hour basis;

Prepare the criteria and procedure for the enlistment of accredited community disaster
volunteers (ACDVs). It shall include a manual of operations for the volunteers which
shall be developed by the OCD in consultation with various stakeholders;

Provide advice and technical assistance and assist in mobilizing necessary resources to
increase the overall capacity of LG'Us, specifically the low income and in high-risk areas;

Create the necessary offices to perform its mandate as provided under this Act;

Perform secretariat functions of the National Council, and


(t) Perform such other functions as may be necessary for effective operations and
implemetnation ofthe Act.
Section 4. Staffing requirements - The Gfflce of Civil Defense, in coordination with the
Department of Budget and Management and Civil Service Commission, sh iall come up with
relevant staNng pattern within thirty (30) days from approval of these Rules. The enhanced
'GCD organization shall be composed of competent and qualified technical personnel of
relevant offices as may be deemed necessary to effectively carry out its functions and duties
prescribed herein, subject to the approval of the Department of Budget and Management and
existing civil service rules and regulations

Section 5. Compliance with Salary Standardization Lam - The compensation and


emoluments of the officials and employees of GCD shall be in accordance with the Salary
Standardization Law and other applicable laws under the N ational Compensation and
Classification Plan.

RULE 8 - NATIONAL D ISASTER RISK REDUC T I ON. ANQ M A N A G E M E N T


TRAXNXXXII6 XNSTXTUTES

Section 1. Purpose - Pursuant to Section 9 (i) ot the RA10121, NDRRM Training Institutes
shall be established for the following purposes:

(a) Train public and private individuals, both local and national„ iln such subject as disaster
risk reduction and management, including emergency response, capacity-building
programs for the implementation of Section 14 of this Act;
(b) Consolidate and prepare training materials and publications of disaster ris'k reduction and
management books and manuals to assist disaster risk reduction and~ m anagem ent
workers in the planning and implementation of this program and projects;

(c) Conduct research programs to upgrade knowledge and skills and document best practices
on disaster risk reduction and management; and

(d) Conductperiodic awareness and education programs to accommodate new elective


officials and members of the LDRRMCs.

Section 2. Trsininci Programs - The GCD may engage the expertise of the other National
Council member agencies and other training organizations accredited by the National Council.
It shall be inclusive in conducting, designing and developing the training programs, materi
als
and syllabus of' the Institute, to ensure that the training programme and resource materials
are supportive of the mandated tasks of the NDRRMC.

Section 3. L o c ation - Su itable locations for the establis'hment of said institutes shall be
determined in consultation with concerned stakeholders and with the approval of the National
Council.

Section 4. Org ianlzatIonal Structure - The organizational structure of the NDRRM Training
Institutes shall be developed by the GCD, subject to the approvai of the National Council, in
accordance with the existing laws, rules and regulations.

CSQs AND THE PRXVATE SECTOR
Section X. Accreditation -The government agencies, CSGs, private sector and LGUs may
mobilize individuals or o r ganized volunteers to augment their r espective personnel
complem ent and logistical requirements in the delivery of disaster risk reduction programs
and activities. T' he agencies, CSGs, private sector, and LGUs concerned shall take f ull
responsibility for th e e n hancement, welfare and protection of t h eir v olunteers, and shall
submit the l ist o f v o l unteers to t h e G CD, t hrough the LDRRMGs„ for accreditation and
inclusion in the database of community disaster volunteers.

A national roster of Accredited Community Disaster Volunteers (ACDVs), National Service


Reserve Corps (NSRC) under RA 9i63 or the National Service Training Program Act of 2001,
CSGs and the p r ivate sector shall b e m a inta'Ined by t h e G C D t h rough th e LDRRMGs.
Accreditation of volunteers and issuance of their identification cards shall be done at t he
municipal or city level.

Section 2. M o b ilization - M o b i lization of v o l unteers shall be i n a c c ordance with t h e


guidelines to be formulated by the NDRRMC consistent with the provisions of the Act.

Section 3. Capacity Building - Training for volunteers shall form part of the volunteer
mobilization activities of the N/R/LDRRMC and the BDC.

Section 5. Xnsurance for the ACQVs - Any volunteer who incurs death or Ingury while
engaged In any of the activities defined under the Act shall be entitled to compensatory
benefits and Individual personnel accident insurance. The government agency, CSG, private
sector or LGU which mobilizes the ACDVs shail be responsible for providing the latter with
insurance and necessary benefits.

formulate, promulgate and issue within three (3) months from the 5ffectivlty of' these Rules

from the government agencies, CSGs, private sector and LGUs.

EMPLOYEES
Section X. Xntagt'ation into the school curricula - The DepED, the CHED, the Technical
Education and Skills Development Authority (TESDA), in coordination with the GCD, the
National Youth Commission (NYC), the DOST, the DENR, the DILG-BFP, the DGH, the DSV/D
and other relevant agencies, shall integrate disaster risk reduction and management
education in the school curricula of secondary and tertiary level of education, including the-
National Service Training Program (NSTP), whether private or public, inrludlng forrnal and
non-formal, technical-vocational, indigenous learning, and out-of-school youth courses and
programs.

Section R. C o mmunity Education an d T r a ining- Th e N D RRMC, the R DRRMCs, the


LDRRMCs, the LDRRMGs, the BDRRMCs and the SK councils, in coordination with the National
Youth Commission (NYC), shall encourage community, specifically the youth, participation in
disaster risk reduction and management activities, such as organizing quick response groups,
particularly in identified disaster-prone areas, as well as the i nclusion of disaster risk
reduction and management programsas part of the SK programs and pro)ects. In the same
manner, they shall likewise encourage and involve the community, specifically t' he youth, in
the Disaster Risk Reduction Training either through actual conduct or as participant to the
said training.

Section 3. pducation and Training of pinpioyees of the p u biic Sector -The public
sector employees shall be trained in emergency response and preparedness with strong
focus on gender responsiveness, sensitivity to indigenous knowledge systems and respect for
human rights. Towards this end, the following guidelines are hereby established to ensure its
effective implementation and compliance:
(a) The Civil Service Commission shall issue a directive requiring all heads of government
departments and ag encies, including gqvernrnent financing institutions and local
governmentunits to conduct training on DRRMfor their respective personnel.
(b) A Train-the-Trainers approach shall be adopted for this purpose whereby member
agencies of the NDRRMC, including other government agencies and local government
units, shall organize and train their respective DRRM Core of Trainers who shall be
responsible in cascading the training to their regional/field level and/or LGU staff.

(c) A standard training design and instructional materials on DRRMshall be developed by


the DRRM Training Institute in accordance with Rule 8, section 1(b) of these Rulesand
shallbe impiemented by the CSC.

(d) Members of' the National Council which already conduct specialty and highly technical
skill courses may continue with the conduct of said training programs.

Section 1. Lmd Acieney during emergency - The LDRRMCsshall take the lead in preparing
for, respondingto, and recovering from the effects of any disaster based on the following
criteria:

(a) The BDC,if a barangay is affected;

(b) The city/municipal DRRMCs, if two (2) or more barangays are affected;

(c) The provincialDRRMC, ff two (2) or more cities/ municipalities are affected;

(d) The regional DRRMC,if two (2) or more provinces are affected„and

(e) The NDRRMC,if' two (2) or more regions are affected,

The NDRRMCand intermediary LDRRMCsshall always act as support to LGUs which have
the primary responsibility as first disaster responders. Private sector and civil society
organizationsshall work in accordancewith the coordination mechanism and policies set
by the NDRRMC andconcerned LDRRMCs.

Section R. The National Disaster Risk Reduction and Management Operations Center
(NDRRNOC) - The present NDCC Operations Center based in Camp General Emi~lio Aguinaldo
shall henceforth b e k n ow n a s t h e N a t ional Disaster Risk Reduction and Management
Operations Center or th e ND RRMOC, which shall serve as the Op erating Facility of'the
NDRRMC. It shall be operated and maintained on a twenty-four (24) hour basis by OCD staff
during normalsituation to be complemented by NDRRMC member agency representatives
whenever blue and red alert status are raised or as may be determined by the National Coundl
through GCD.

Section 3. The NDRRiviOC Care Functions - The NDRRMOC shall serve as the nerve center
for alert and monitoring, multi-agency and multi-level operational coordination, response and
resource mobilization and information management. To carry out its core functions, the Center
shall utilize support systems such a s e a r l yw a rning and e mergency broadcast system,
geographic information system and other spare-based technologies, incident command
system, rapid damage assessment and needs analysis,emergency logistics management,
public-private partnerships for emergency response, and humanitarian assistance coordination
mechanism.

Section 4. Sovereignty and Territorial Xntegrity — The. sovereignty and territoriai integrity
of the State shall be respected at ail times. In this context, the Philippines shall have the
primary responsibility to r espond to d isasters, occurring within its t e rritory and external
assistanceand offers of assistance shallonly be provided upon itsrequest or consent.

RULE 12 - QECLARATXQN OF STATE QF CALAN XTY

Section i. Declaration and Lifting of State of Calamity by the President - The National
Council shall recommend to the President of the Philippines the declaration of a cluster of
barangays, municipalities, cities, provinces, and regions under a state of calarnlty, and the
lifting thereof, based on the criteria set by the National Council. The President's declaration
may warrant international humanitarian assistance as deemed necessary.

Section 2. Declaration and lifting of State of Calamity by the Local Sanggunlan —The
declaration and lifting of the state of calamity may also be issued by the local sanggunian,
upon the recommendation of the LDRRMC, based on the results of the damage assessment
and needs analysis.

S ection 3. C r iteria i n R e commending the D e claration and L ifting of a S t at e o f


Calamity - The National Council shall determine the criteria for the declaration and lifting of a
state of calamity, including epidemics,

RULE 13 - REMEM A L M EASURES

Section X. Ivlandatory remedial measures - The derlaration of a state of calamity shall


make mandatory the immediate undertaking of the f ollowing remedial measures by the
rnernber-agencies concerned as defined in the Act:

(a) Imposition of price ceiling on basic necessities and prime commodities by the President
uponthe recommendation ofthe implementing agency as provided forunderRepublic Act
No. 7581, otherwise knovvn as the "Price Act"', or the National Price Coordinating Council;

(b) Monitoring, p r evention a nd control b y t h e L o ca l P r ice C oordination Council of


overpricing/profiteering and hoarding of prime commodities, medicinesand petroleum
products;

(c) Programming/reprogramming of f'unds for the repair and safety upgrading of public
infrastructures and facilities; and
(d) Granting of no-interest loans by government financing or lending institutions to the most
affected section of the popu'lation through their cooperatives or people's organizations.

Section i. Request for International Assistance —A call for international assistance may
be issued by the President of the Philippines upon the recommendation of the Chairman,
NDRRMC, depending on thesrope, magnitude of damage or implications of the adverse
effects of the disaster. As Party to th e ASEAN Agreement on Disaster Management and
Emergency Response (AADMER), the request for assistance may be sent directl'y to other
ASEAN Member States or t h rough the ASEAN Humanitarian Assistance (AHA) Centre In
3akarta, Indonesia. It may also request assistance from other entities where appropriate.

For purposes of ensuring a concerted effort abroad, the Department of Foreign Affairs,
through the embassies or consulates of the P'hlilppines, may facilitate the call for international
assistance and closely coordinate with t' he NDRRMC for this purpose

Section 2. Request forassistance by the L@RRMC — The LDRRMCs may direct'l

request for assistance abroad in accordance with the Section 23 of the Local Government
Code of 1991.

Section 3. A u thorized importation end donation - The Importation and donation of food,
clothing, mediciine andi equipment for relief and recovery encl other disaster management and
recovery-related supplies is hereby authorized in accordance with Section 105 of the Tarifl'
and Customs Code of'the Phiilippines, as emended, and the prevailing provisions of the
General Appropriations Act covering national internal revenue taxes and import duties of
national end local government agencies; and

Any importation and donation intended for the operation of the NDRRMC and its member
agencies shall be treated es im~ at i o ns by and/or donations to the NDRRMC, subject to the
rules and regulations of the Tariff and Customs Code or special facilities created by the Office
of the President for t h e p u rpose. Payment of d u ties and t axes by c oncerned member
agencies,Ifany, shallbe subject to deferred payment scheme.

Section 1. Xnventory end Monitoring of All Relief Goods - The National Council shall
. provide for the guidelines on the inventory and disposition end utilization and monitoring of ali
relief goods, including donations, within a reasonable period, in order to ensure the proper
disposition and use thereof.

RULE i6 - PROHXSXTKD ACTS


Section 1. Prohibited acts —Any person, group or corporation who commits any of the
following prohibited acts shall be held liable and be subjected to the penalties as prescribed in
Section 20 of the Act and Rule 17 hereunder:

(B) Dereliction of duties which leads to destruction, loss of lives, critical damage of faci'lities
and misuse offunds;

(b) Preventing the entry and distribution of relief goods in disaster-stricken areas, including
appropriate t echnology s uch a s Gke ographic I n formation System, I n f ormation and
Communication Technology Database/System Management for Relief Inventory; System
for Management or the Dead/Casualt~ and the like, tools, ertutnment, accessories,
disaster teams/experts„.

(c) Buying, for consumption or resale, from disaster relief agencies such as the DSWD, NFA,
PRC, International Committee of the Red Cross (ICRC), World Food Program (WFP) arid
other such private organizations, any relief goods, equipment or other aid commodities
which are fntended for distribution to disaster affected communities;

{d) Buying, for consumption or resale, from the recipient disaster affected persons any relief
goods,equipment or other aid commodities received by them;

(e) Selling of r e lief goods, equipment or o t her aid c ommodities which are intended for
distribution to disaster victims;

(f) Forcibly seizing relief goods, equipment or other Bid commodities intended for or
consigned to a specific group of victims or relief agency;

(g) Diverting or misdelivery of relief goods, equipment or other aid commodities to persons
other than the rightful recipient or consignee;

(h) Accepting, possessing, using or disposing relief goods„equipment or other aid


commodities not intended for nor consigned to him/her;

(l) Misrepresenting the source of relief goods, equipment or other aid commodities by:

(1) Either covering, replacing or defacing the labels of the containers to make it appear
that the goods, equIpment ol othel aid commodities calTle from another agency oI
persons j

(2) Repacking the goods, equipment or other aid commodities into containers with
different markingsto make it appear that the goods came from another agency or
persons or was released upon the instance of a particular agency or persons;

(3) Making f'alse verbal claim that the goods, equipment or other aid cornrnodity in its
untampered original containers actually came from another agency ol' pel sons Ql' was
released upon the Instance of a particular agency or persons;

(4) Substituting or replacing relief goo6s, equipment or other Bid commodities with the
same items or inferior/cheaper quality.

O) Illegal soiicitations by persons or organizations representing others as defined in the


standards and guidelines set by the NDRRMC;

(k) Deliberate use of false or inflated data in support of the request for funding, relief goods,
equipment or other aid commodities for emergency assistance or livelihood projects; and

(I) Tampering with or stealing hazard monitoring and disaster preparedness equipment and
paraphernalia.

RULE 17 - PENAL CLAUSE


Section X. Penalty, Fines - Any individua~l, corporation, partnership, association, or other
juridical entity that commits any of the prohibited acts provided for in Section 19 of the Act
shal'I be prosecuted and upon conviction shall suffer a fine of not less than Fifty thousand
pesos (Php50,QQQ.QQ) or any amount not to exceed Five hundred thousand pesos
(Php50O,OOO.OO) OI lrnpl'Isonrnent of not less 'than six (6) years ancl one (1) day or not
more than twelve (12) years, or both, at the discretion of the court, including perpetual
dlsqualifiication from public office if t' he offender is a public officer, and confiscation or
forfeiture in f'avor of t h e g overnment of t h e o bjects and th e i nstrumentalities used in
committing any of herein prohibited acts.
Section 2. Who are liable - If the offender is a corporation, partnership or association, or
other juridical entity, the penalty shell be imposed upon the officer or officers of the
corporation, partnership, association or entity responsible for the violation without prejudice
to the cancellation or revocation of these entities' license or accreditation issued to them by
any licensing or accredited body of the government. If such offender is an alien, he or she
shall, in addition t o t h e p e nalties prescribed in t h e A ct , b e d e ported without further
proceedings after service of the sentence.

Section 3. Other liabilities - The prosecution for offenses set f'orth in Section 19 of the Act
shall be without prejudice to any liability for violation of Republic Act No. 3I.85, as amended,
otherwise known as the Revised Penal Code, as well as any other special penal law enacted
by Congress, 8. shall be without prejudice to other civil liabilities.

R ULE i8 - LOCAL DXSASTER RXSK REDUCT XON AN D M A N A G E M E N T FUN D

Section i. Utilization of the LBRRNF - The present Local Calamity Fund shall henceforth
be known as the Local Disaster Risk Reduction and Management Fund (LDRRMF). Not less
than five percent (5ok) of the estimated revenue from regular sources shall be set aside as
the LDRRMF to support disaster risk management activities such as, but not limited to, pre-
disaster preparedness programs including training, purchasing life-saving rescueequipmen t,
supplies and medicines, for post-disaster activities, for the payment of premiums on calamity
insurance and construction of evacuation centers. The LDRRMC shall monitor and evaluate
the useand disbursement of the LDRRMF based on the, LDRRMP as incorporated in the local
development plans and annual work and financial plan. Upon the recommendation of the
LDRRMQ and approvalof the sanggunlan concerned, the LDRRMC may transfer the said fund
to support disaster, risk reduction work of other LDRRMCs which are declared under state of
calamity.

Section R. Quick Response Fund - Of the amount appropriated for LDRRMF, thirty percent
(30'k) shall be allocated as Quick Response Fund (QRF) or stand-by fund for relief and
recovery programs in order that situation and living conditions of people in communities or
areas stricken b y d i sasters, calamities, epidemics, or complex emergencies, may be
normalized as quickly as possible.

Section 3. Special Trust Fund- Unexpended LDRRMF shall accrue to a special trust fund
solely for the purpose of supporting disaster risk reduction and management activities of the
LDRRMCs within the next five (5) years. Any suc'h amount still not f'ully utilized after fi ve (5)
years shall revert ~back to the general fund and made available for other social services to be
identified by the local sanggunian.

place, including websites, if any, of the LGU/LDRRMG. The reports of the LDRRMcs on the

R ULE 3.9 - NATXONAL DXSASTKR RXSK RKQU C T XON AN D M A N A G E M E N T


FUND

S ection i . U t i ilizatlon of the NDRRM Fund — The present Calamity Fund appropriated
under the annual General Appropriations Act shall henceforth be known as the National
Disaster Risk Reduction and Management Fund (NDRRM Fund) and it shall be used for
disaster risk reduction or mitigation, prevention and preparedness activities such as but not
limited to training of personnel, procurement of equipment, and capital, expenditures. It can
also be utilized for relief, recovery, reconstruction and other work or services in connection
with natural or human-induced calamities which may occur during the budget year or those
that occurred in the past two (2) years from the budget year.

Section 2. Amount - The specific amount of the NDRRM Fund and the appropriate recipient
agencies and/or iLGUs shall be d etermined upon approval of the President of the Philippines
in accordance with the favorable recommendation of' the NDRRMC.

Section 3. Quick Response Fund -Gfthe amount appropriated for the NDRRM Fund, thirty
percent (30VO) shall be allocated as Quick Response Fund (QRF) to the agencies identified by
the NDRRMC.

Section 4. Accounting -Alldepartments/agencies and LGUs that are allocated with DRRM
fund shall submit to the NDRRMC their monthly statements on the utilization of DRRM funds
and make an accounting thereof in accordance with existiing accounting and auditing rules.

Section5. Funding for DRRN projects - Alldepartments, bureaus, offices and agencies of
the government are hereby authorized to use a portion of their appropriations to implement
projects designed to address DRRM activities in accordance with the guidelines to be issued
by the NDRRMC in coordination - with the DBM.

Section 1. Budget - As lead agency to carry out the provisions of the Act, the GCD shall be
allocated a budget of Gne Billion Pesos (Php1,000,900,000.00) revolving fund starting from
the effectivity of tuchis Act, which shall be taken from sources to be identified by the 'Nationai
Council. Tihereafter, the fund necessary to carry out the provisions of this law shall be
included in the General Appropriations Act.

RULE 21- ANNUAL REPORT

Section i. Deadline for the annual report - The National Council, through the OCD, shall
submit to the Gffice of the President, the Senate and the House of Representatives, within
the first quarter of the succeeding year, an annual report relating to the progress of the
implementation ofthe NDRRMP,
Section 2 . Inputs of ether agencies to the annual repert — Within the month of
3anuary of the succeeding year and every january thereafLer, ail member agencies shall
submit to th e GCI3, as Secretariat of t h e N DRR,MC, their respective annual reports for
purposes of consolidation and analysis. These annual reports shall, in turn be submitted by
the GCB to the Chairperson, NDRRMC.

RULE 22 - CQNORKSSXONAL OVERSXGHT CONN XTTKE

Section 1. Functions -The Congressional Oversight Committee created and composed

under section 26 of the Act shall monitor and oversee the implementation of the provisi
thereof.

Section 2. Period for Reviews —Within five (5) years after the effectivity of the Act„or as
the need arises, the Congressional Oversight Committee shall conduct a sunset review. For
purposes of' these Rules, the term "sunset review" shall mean a systematic evaluation by the
Congressional Oversight Committee of the accomplishments and impact of the Act, as well as
the performance and organizational structure of its implementing agencies, for purposes of
determining remedial legislation.

Section 1. Existing Practices, auideiines - Pending the development and approval of the
necessary guidelines cited in the Act and these Rules„ i.e., accreditation of volunteers, etc„
within the period specified herein, existing practice and procedures shall be maintained.
