Healthcare Legislation in the United States

1. Describe the role of risk management in health care operations.

Healthcare risks are prevalent for patients, employees, and organizations. Therefore, a

health risk management framework must be developed for an entity to analyze, develop,

execute, and track risk management plans with the intention of reducing exposure. A health

system has many priorities, including financing, protection, and above all, patient care.

Health legislation in the united state has been made known to the health care setting more

efficient and more inclusive over the last 5 years. There had been a time when the Academic

Health Centers (AHCs) were challenged by the decrease in the accepted quality of customer

care that was rendered by health care practitioners including physicians. Legislations ensured

that there is a significant drop in direct payments being done to doctors in Academic Health

Centers. This has resulted in Academic Health Centers becoming more effective. Thus, the

standard of clinical practice has been enhanced. Lastly, the trend shows that the research

funding of the National Institute of Health has gradually increased[ CITATION Scr \l 1033 ].

2. Describe general trends in health care legislation over the past 5 years.

Until the late 17th century, the federal government was not directly involved in healthcare

registration. Nonetheless, president John Adams passed into law the Act for the relief of the

sick and disabled people marked the start of federal government involvement in healthcare

legislation. As of today, legislative and regulatory bodies at federal, state, and local

governments have made a tremendous milestone in the promotion of public health through

legislations. In the past five years, healthcare legislation has been shown by the passing of

major laws that will continuously influence the standards, affordability, and accessibility to

healthcare for the majority of Americans.

3. Describe a specific piece of the legislation occurring within this time frame across

the United States. Discuss how it governs a long trending health

care concern. What have been the motivating factors that have influenced this

particular legislation?

In the last 5 years, the laws have strengthened collaboration between health systems and

health plans. This observation can be expressed by the sanction of the 21st century Act 2016

that intended to modernize and personalize healthcare while rationalization the system to

make it more efficient. The 2015 Medicare Access and CHIP Reauthorization Act (MACRA)

is a piece of law that takes place during this period. In this piece of law, a new way of paying

physicians who offer medical services to patients with Medicare was adopted. In order to

enact this law, the driving factors are the need to address the process by which the doctors

listed above are reimbursed. The funding gap had also to be filled. In terms of the effect of

pattern legislation on overall health care in the United States, healthcare in the United States

has seen a reduction to some degree in health inequalities. The positive effects include an

improvement in the performance of key health care innovations, preventive care for the

optimization of health care, misuse, and excessive use of highly costly healthcare facilities.

4. Discuss the effects of the trending legislation on health care overall in the United

States.

The MACRA will have a positive impact on primary care. The enactment of merit-based

incentives will push the creation of a system that will be better and smart. Primary care will

improve due to the focus on the value and quality of healthcare services. The introduction of

the policy to fix these health care systems would have a negative financial impact on

institutions that mishandle patient care. Healthcare professionals have the ability to expand

their positions on health care teams and, possibly, their area of practice through these various
ACA-mandated programs. Adjustments in Medicare payment are important aspects of both

the ACA and other federal deficit-reduction proposals. Many of these proposals reward

efficiency and value over the number of services rendered[ CITATION Lar12 \l 1033 ].

5. Discuss how stakeholders (patients, underserved populations, health care

providers, staff, etc.) have been affected by the trending legislation.

The law was launched in 2015, and no recent changes have been made. The MACRA has

benefited all stakeholders. Patients are improving health care, there is an increased emphasis

on satisfying the health needs of under-serviced individuals, and the merit-based

compensation program benefits health workers. For all stakeholders to be mindful of, and

plan for the effect of, their personal or business implications as per these trends. Individual

stakeholders need to innovate, adapt, and recognize its effect on decision-making on clinical

care[ CITATION San15 \l 1033 ].
