JUDICIAL AFFIDAVIT

[Affiant BEBITA RIVERA BALDO was advised to answer

the questions asked of her, fully aware that she does so
under oath, and informed that she may face criminal liability
for false testimony or perjury and understood thereof.]

I. WITNESS

This is the Judicial Affidavit of BEBITA RIVERA BALDO,

of 69 years old age, single, Filipino and with Purok 3, Mabini,
Cabadbaran City, Agusan del Norte.

II. LAWYER/PLACE OF EXAMINATION

This Judicial Affidavit is taken before ATTY. DAN

PATRICK S. GARCIA at 2/F, Consortium Bldg., Corrales
Extension, Cagayan de Oro City.

III. STATEMENT

The witness is answering the questions asked of her,

fully conscious that she does so under oath and that she
may face criminal liability for false testimony or perjury. The
witness testifies in English language.
 IV. PURPOSE OF TESTIMONY

The purposes of the testimony of affiant are as follows:

1. To prove that she is the daughter of Epifania Rivera

2. To prove that the Plaintiffs bought the subject lot from
her mother Epifania Rivera
3. To prove all other related matters.

: ug walay lain kun dili ang kamtuoran lamang?
[Do you swear to tell the truth and nothing but
the truth?]
A: Oo.
[Yes.]

2. Q Nganong naa man ka dini sa among opisina?

: [Why are you here in our office?]
A: Naa ko dini aron mag-sulti sa akong salaysay
mahitungod sa kaso nga gipasaka nila Annie
(Anecita R. Nalzaro) ug Jay (Josefina N. Mila)
batok kang Lita (Julieta N. Achas) mahitungod sa
yuta nga gi-panagiyahan sa akong inahan sauna
didto sa Gitagum, Misamis Oriental.
[I am here to give my testimony relating to the
case filed by Anecita R. Nalzaro and Josefina Mila
against Julieta N. Achas regarding the parcel of
land located at Gitagum, Misamis Oriental that my
mother previously owned.]

3. Q Pwede ba nimo isulti kung unsay storya aning

: yutaa?
[Could you please testify the story about this
parcel of land?]
A: Kining yuta-a gipinagiyahan ni sa akong mama
nga si Epifania Rivera.
[This land was previously owned by my mother
Epifania Rivera.]

4. Q Unsa nga yuta imong buot pasabot?

: [What lot are you referring?]
A: Katong yuta nga nhimutang sa Poblacion,
Gitagum, Misamis Oriental.
 [That land located at Poblacion, Gitagum, Misamis
Orienal]

5. Q Giunsa man nimo pagkahibalo nga yuta kini sa

: imong inahan?
[How would you know that the said lot was owned
by your mother?]
A: Kay sugod sa bata pa mi iya na kaming pirmi
ubanon didto sa Gitagum kay mangdugnas ug
lubi.
[Because, since our childhood we were brought by
our mother at Gitagum, Misamis Oriental to
harvest coconut fruit]

6. Q Karon, gadugnas pa ba mo sa maong yuta-a?

: [Now, do you still gather the coconut fruit on the
said lot?]
A: Dili na kay gibaligya naman ni sa among mama
ngadto kang Annie ug Jay.
[Not anymore because the said lot has already
been sold by my mother to Anecita Nalzaro and
Josefina Mila]

7. Q Kanus-a man gibaligya sa imong mama ang

: maong yuta-a?
[When did your mother sell the said the lot?]
A: Mga late 80’s gihinay hinayan na nila Jay ug Annie
ug bayad ang maong yuta-a?
[Late 80’s Jay and Annie have been paying in
installments for the said lot.

8. Q Giunsa man nimo pagkahibalo ana nga butang?

: [How would you know such fact?]
A: Kay sauna makadumdom ko nga gi-uban ko sa
akong mama dadto sa Gitagum Misamis Oriental
gikan sa Cabadbaran
[Because long time ago, my mother brought me
with her to Gitagum, Misamis Oriental from
Cabadbaran City.]

9. Q Unsa may nahitabo didto nga makaingon man ka

: nga gibaligya na sa imong mama ang yuta?
[What happened there that made you say that
your mother has sold the said lot?]
A: Makadumdom ko nga adtong panahon nga naay
 gi-tunol si yaya Mirang (Casimera Nalzaro) nga
kwarta kang Mama.
[I can remember that time that Yaya Mirang
(Casemera Nalzaro) handed money to my
mother.]

10 Q Kinsa man ni si Yaya Mirang (Casemera Nalzaro)?

. : [Who is this Casemera Nalzaro?]
A: Mama nila Jay ug Annie

11 Q Nasayran ba nimo kung para asa tong kwartaha?

. : [Did you know what was the money for?]
A: Oo. Ingon akong mama bayad daw kato sa yuta
nga gipalit nila Jay ug Annie.
[Yes, my mother told me that it was the payment
for the lot that Jay and Annie bought from her.]

12 Q Nasayod ka ba kung pilay area sa gipalit nila Jay

. : ug Anie?
[Did you know the exact area of the land that
Josefina Mila and Anecita Nalzaro]
A: Dili ko kabalo sa insakto na area pero gi-ignan ko
ni mama nga katong among gadugnasan.
[I do not know the exact area but my mother
have told me that what she has sold is the one
that we had been harvesting coconut fruits.]

13 Q Madumdoman pa ba nimo kung asa na dapita

. : nahimutang ang maong yuta-a?
[Can you still remember the location of the said
lot]
A: Oo dili ko malimot kay gabisita man gihapon ako
sa akong mga kaubanan sa Gitagum, pero dili lang
pirmi.
[Yes I cannot forget the location since sometimes
I visit my relatives in Gitagum, Misamis Oriental.]

14 Q Asa man lugar ang maong yuta-a?

. : [Where is the subject lot located?]
A: Kanang gi-puyan nilang Lita.
[That portion where Lita (Juliera N. Achas) is
living.]

15 Q Wala na koy pangutana, aduna ka pa bay gusto i-

. : dugang or bawion sa imong gipang-storya?
 [I have no more questions to ask, is there
anything else you want to add or retract from
your statements?]
A: Wala na sa pagka-karon.
[Nothing more as of this moment.]

16 Q Boluntaryo ba nimo nga gi-tubag ang mga

. : pangutana sa imo aning imong affidavit?
[Did you voluntarily answer the question asked of
you in this affidavit?]
A: Oo.
[Yes.]

17 Q Pamatud-an ba nimo ang kamatuoran sa imong

. : gipang-storya?
[Do you affirm and confirm the veracity of the
foregoing statements?]
A: Oo.
[Yes.]

I HEREBY CERTIFY to the truthfulness of the above-

testimony based on my own personal knowledge and that I
am fully conscious and aware that I am executing the same
under oath and will face criminal liability for false testimony.
[Ako naga-pamatood nga akong mga gipang-storya sa
taas base sa akong personal nga kahibalo og nasayod ko
nga kini nga testimonya gipanumpaan ug pwedi ko mapriso
