Writing Legalese

On the evening of November 30, 1970, Rita, a minor, alone in the rented room in
a house at Aliw Beach, Zamboanga City, where she was living with her mother, who
was then away for the night complaint for rape by Hector Galos, a boarder in the same
house. Although he admitted the sexual intercourse, Hector Galos would insist that Rita
freely agreed to it, she being his sweet heart. He would argue his continued presence in
the room until the dawn of the next day and the absence of any outcry on the part of
Rita. This was corroborated by another boarder and the owner of the house. The lower
court believed the girl’s version and sentenced him to reclusion perpetua. The record
shows that Galos offered convincing proof of his claim. Thus, a need to reverse.

Record shows that Galos did not use force or deceit to gain entrance into the
rented room where the incident took place. What is more, it happened twice and there
could have been a third time if only the chair on which it was attempted did not give way
due to the combined weight of the parties. This certainly was not indicative of rape.
Hence, acquittal is to be the proper verdict.

WHEREFORE, the decision of the lower court is set aside and the accused is
acquitted of rape.
