3. Products and technology obtained will NOT be used, directly or indirectly, in the (1) design, development, fabrication, handling,
operation, maintenance, storage, detection, identification, dissemination or testing of nuclear weapons or explosive devices; or
(2) design, construction, fabrication, or operation of facilities or components of facilities for chemical processing of irradiated
special nuclear or source material, heavy water production, separation of isotopes of source and special nuclear material, or
fabrication of nuclear reactor fuel containing plutonium.
4. Products and technology obtained will NOT be used directly or indirectly to assist in the design, development, fabrication,
operation, maintenance, or storage of (1) rocket systems (including ballistic missile systems, space launch vehicles, and
sounding rockets); or (2) unmanned air vehicle systems (including cruise missile systems, target drones, remotely piloted
vehicles, and reconnaissance drones).
5. Products and technology obtained will NOT be used in the design, development, production, handling, operation, maintenance,
stockpiling, detection, identification, dissemination or use of chemical or biological weapons.
6. Products and Technology obtained will NOT be diverted to (1) Cuba, Iran, North Korea, Sudan, Syria or other country or party
sanctioned by a United Nations Security Council decision, (2) other US EAR Part 744 End-User and End-Use based restrictions
otherwise not enumerated herein or 3) any country subject to an arms embargo imposed by a decision or common position of
the Council of the European Union or a decision of the Organization for Security and Co-operation in Europe or a binding
decision of the United Nations Security Council, (4) any use or purpose prohibited by any applicable export control restriction or
trade sanction, or (5) to an entity or person on any applicable export control government restricted party “watch” lists..

“military end-use” shall mean: (a) incorporation into items (technology or equipment) designed or modified for military, paramilitary, internal repression, physical enforcement or secret
intelligence purposes, including but not limited to weapons, vehicles, electronic equipment, software, etc. (hereinafter “military items”; (b) use of production, test or analytical equipment
and components therefor, for the development, production or maintenance of military items; (c) use of any unfinished products in a plant for the production of military items.

7. Products and technology obtained will remain at Ultimate Destination and will NOT be resold or transferred without the
appropriate authorization from the applicable Export Control Government(s). If the Ultimate Destination is a customs free zone
or free warehouse, the goods stored in such places are treated as if they were located outside the customs territory of the given
country. Other premises and places in which goods are subject to similar customs rules and treatment to those described above
shall be relevant with regard to statement No. 6 of this End User Statement.
8. As far as technology is concerned, it is treated strictly confidential and not passed on to other companies nor knowledge made
available to third parties. In case of goods produced by the help of transferred technology, these goods will only be delivered to
a third person/company on condition that this third person/company accepts the commitments of the above declaration as
binding for itself and on condition that this third person/company is known to be trustworthy and reliable in the observance of
such commitment.
