JUDICIAL AFFIDAVIT OF
CHITO S. CHISMOSO

This Judicial Affidavit of PEDRO P. PENDUKO is executed to


serve as her direct testimony in the instant case. This Judicial
Affidavit is offered to prove:

(1) all the allegations in the robbery case; including all the
ANNEXES appended thereto, which she respectfully requests to
be correspondingly marked as EXHIBITS in this case;
and
(2) all matters related thereto, with reservation to present
additional exhibits in the course of the proceeding of the instant
case.

QUESTIONS were propounded by the plaintiff’s counsel, Atty.


Lawrence Greghill R. Bravo, in English, which the affiant fully
understands, while ANSWERS were given by witness PEDRO P.
PENDUKO

I, PEDRO P. PENDUKO, 30 years old, Filipino, residing 42 Emerald


Street Kumintang Ibaba, Batangas City, after being sworn to in
accordance with the law, do hereby depose and state that:

1. Q: Please state your name, age, and residence address.

A: I am PEDRO P. PENDUKO, 30 years old, single, and I


currently reside in 42 Emerald Street Kumintang Ibaba,
Batangas City.

2. Q: Mr. witness, how do you know the accused in this case?

A: I do not personally know them sir.


3. Q: You executed a Sinumpaang Salaysay dated September 6,
2020 at Batangas City. If I am going to show it to you, will you
able to identify the same?

A: Yes sir.

4. Q: I am showing to you a Sinumpaang Salaysay (already


marked as Exhibit “A”), is this the Sinumpaang Salaysay that you are
referring to?

A: Yes sir.

(MANIFESTATION: Your Honor, witness identified a copy


of her Sinumpaang Salaysay dated September 6, 2020, which
was previously marked as Exhibit “A”)

5. Q: At the last page, bottom portion of the Sinumpaang


Salaysay, there is a signature (Submarked and bracketed as Exhibit
A-1, above the name of Chito S. Chismoso), can you please tell us
whose signature it is?
A: Mine.

(MANIFESTATION: Your Honor, witness identified her


signature in a copy of her Sinumpaang Salaysay dated
January 21, 2020, which was previously submarked and
bracketed as Exhibit “A-1”)

6. Q: Mr. Witness, where were you on September 6, 2020?

A: I was in my business place sir.

9. Q: Where is that business place?

A: Same address as my house sir.

10. Q: Have you noticed anything unusual?

A: No sir, just the regular course of business sir.

11. Q: But these accused were your customer that day?

A: Yes sir.

13. Q: Then what happened next?

A: They sold me some goods sir.

14. Q: What were the goods sold to you?

A: Some kitchen utensils and rice cookers sir.

15. Q: How much did you pay them?

A: A little bit over 10,000 pesos sir.

16. Q: Did you know where those articles came from?


A: No sir.

17. Q: Have they told you anything where they got it?

A: No sir.

18. Q: What happened next after you paid them?

A: They hastily left sir.

19. Q: Then?

A: I resumed my business with other customers sir.

20. Q: When did you know that the items you bought were the
same items that was reported as stolen?

A: I’ve seen it in an ad in a facebook group sir.

21. Q: What did you do after?

A: I immediately contacted the police sir.

22. Q: What have you told the police?

A: I told them someone sold me the goods same as the


one posted in the ads sir.

23. Q: What happened next?

A: The police went to my shop to check the goods.

24. Q: Do you have anything else to say?

A: I have nothing else

25. Q: Do you confirm that you have answered all the questions
asked of you, fully aware that you did so under oath?

A: Yes sir.

26. Q: Do you also confirm that if you have not answered all the
above questions truthfully, you may face criminal liability for
false testimony or perjury.

A: Yes sir.

Prosecutor in Batangas City, after having been sworn to in
accordance with the law do hereby depose and say:

1. That I have faithfully recorded or caused to be recorded the


questions I asked and the corresponding answers that witness, Maria
M. Tindera , gave;

2. That I have not, nor any other person present or assisting


coached the witness regarding the witness’ answers; and

3. That I fully understand that any false attestation shall
