This tender is subjected to any further requirements as required by relevant statutory


authorities as a result of energy assessment including not limited to BASIX. Any additional
requirements will be responsibility of client. Please note structural and window changes
may be required.

This tender is subjected to developer, Council and state authority condition of approval.

Flood Note: This sales estimate is subjected to land not bring affected by flooding. Any

Statutory Fees: All fee & levies to Council and relevant authorities (if required) are to be at

Council Damage Bond: No allowance has been made for any Council Damage Bonds that

Extra Requirements to Satisfy Council:
Should any of the following item be required to satisfy council, they are to be charged to the
client as an extra:
a)       Work as executed drawings in order to receive Occupation Certificate

Saline Soil Upgrade:
Due to saline affected soil, provide the following

Marine Conditions:

No Allowance Acoustics:
xvii No allowance has been made for any acoustic reports/noise attention provisions. Note Only
Requirements will be subject to Council approval. Any additional costs will be charged to
the Client.
Shading to west facade Windows:
xviii To comply with council requirements, Any West Facing Windows must have a full window By owner
shading device to be provided by the client after handover and before Occupational
Certificate will be released.
Work Permit:
xix No Allowance has been made to obtain work permits required from the council. If required By owner
additional cost will be borne by the owner.
Mines Subsidence Note:
xx The subject lot requires mines subsidence board approval, should conditions of this Note Only
approval require design alteration to the submitted dwelling, additional cost incurred will be
charged to the client.
SYDNEY WATER ASSET: Building Over Sewer (BOS) or/ Building Adjacent to Sewer
(BAS)
This tender is subjected to the requirements of Sydney Water when building adjacent to a
sewer line. If your house is position near a sewer line, Sydney Water may require a peg out
report to determine the depth and location in relation to the dwelling. Should peg-out report
be required, any additional items needed to satisfy Sydney water requirements will be at the
expense of the owner.
Note: At this stage, because we do not have the details of the sewer position & depth, no
allowance has been made to satisfy building over the server (BOS) or Building Adjacent to
Sewer (BAS) requirements.
Note: Until the sewer peg-out, Piering and slab design have been undertaken by a suitably
qualified engineer, the exact cost for the work to be undertaken (if required) cannot be
ascertained.
xxi Note Only
Note: MarkQ standard depth of concrete Piering includes the depths of up to 1500 mm per
pier. Should additional Piering or slab strengthening is required to satisfy BAS/BOS
requirements, these will be charged as an additional expense of the owner.
Arranging a sewer peg-out:
To avoid delays in the building process, MarkQ recommend ordering the sewer peg out and
engineering details as soon as plans have been finalised. This will require a pre-payment of
$950. Furthermore, if land does not have fences or boundary survey pegs in place, we
would also require a further prepayment of $650 for surveyor boundary pegs. Once an
engineer design has been prepared we can then provide accurate scope of cost that may
be required to satisfy Sydney Water Compliance.
Provide provisional allowance for building adjacent to sewer (BAS). Pricing to be confirmed
upon receipt of final working plans & engineers details. Should any additional cost will be
charged to the client.
This tender is priced on the assumption that the sewer junction is available for connection
to the new dwelling and that the connection point is within the property boundary and that

no additional Sydney water requirements will relate to the connection. If such is not the
case, any additional costs will be charged to the client.

31. CONDITIONS & NOTES
MarkQ hereby notifies where a building covenant applies to the land the Owner/s intends to
build on, it is the responsibility of the Owner/s to provide the working drawings and any
• other relevant information of the home to the Land Developer to satisfy Covenant
requirements. Any additional costs incurred as a result of Covenant requirements, will be
borne by the Owner/s
This tender is subject to the Building Contract to be entered which will be in Edition 4 Plain
• English Form of Contract and the terms of this tender will be governed by the terms of the
Building Contract.
This Tender is subject to changes in State Legislation and will fall under the new
• Environmental Planning and Assessment Act 1977, which will require a Development
Application and Construction Certificate. Any additional costs will accrue to the Client.

Due to Workplace Health and Safety and public liability restrictions no works are to be
• carried out by the client or the client's sub-contractor during the period of construction.
Should the client (or his contractor) carry out any such unauthorised works, damage or
delays, the builder may charge the client as is appropriate to recover any associated costs.
MarkQ will take no responsibility for any verbal discussions or instructions. All changes and
• special inclusions must be documented in writing.
• The tender price is GST inclusive.
