SUBJECT : GUIDELINES ON THE WORKING HOURS AND


AVAILMENT OF COMPENSATORY TIME-OFF IN
LIEU OF OVERTIME SERVICES RENDERED

I. BACKGROUND/RATIONALE

Department Order (DO) No. 2017-0418 was issued on November 17, 2017
granting flexibility to Heads of Agencies to pay overtime services in cash for
Plantilla Personnel subject to certain conditions and limitations.

It was observed, among others, that Job Order (JO) personnel who render
overtime services are not covered in the said Order. Considering the JO services
and contributions in the office operations, it is imperative to issue guidelines to
provide a uniform policy and to ensure a more efficient implementation of the
rendition of overtime services and the availment of compensatory time-off, in lieu
of overtime pay for JO Personnel.

Hf. DETAILS

A. The JO personnel shall perform daily work for eight (8) hours a day from
Monday
to
Friday, following the flexi-gliding schedule as follows:

a. The flexible period within which the JO may report for work is between
7:00 a.m and 9:30 a.m.

b. On Mondays, the flexible period shall only be between 7:00 a.m. and 8:00
a.m. “

B. In the event of work suspension, the working hours and salary of JO


personnel shall be computed as follows:

a. Declaration before the start of government working hours (Whole Day), the
JO personnel are entitled to full day salary.

b. Before the start of government working hours, declaration is 12:00 noon


(half-day), the JO personnel are entitled to full day salary if they have

rendered at least four (4) hours of service. Otherwise they shall be deducted
the amount corresponding to the time he/she istardy. (No flexi time).

c. During government working hours, work suspension other than half day
(e.g. 3:00 pm), the JO shall be deducted the amount corresponding to the
time he/she is tardy.

¢.1 For JO personnelwho incurred tardiness during the declaration of office


suspension, the amount corresponding to the time they are tardy shall be
deducted from their salaries (with application of flexi time).

c.2 For JO personnel who are absent during the declaration of Office
suspension, the amount corresponding to the time they should report for
workshall be deducted from their salaries. On the other hand, JO personnel
who
report for work on time, are entitled to full day salaries.
C. Services rendered beyond the work schedule stipulated in the Contract of
Service (COS) of JO personnel cannot be used to off-set the number hours/minutes
he/sheis tardy.

D. Activities that may authorize the rendition of Overtime services

The activities that may authorize the Job Order to render OT services as
supported by the issuance of the Department Personnel Order, Office Order or
Authorization by the Head of Office, include the following:

1. Implementation of special or priority programs and projects embodied in


Presidential directives with specific dates of completion;

2. Completion of infrastructure and other projects with set deadlines when due to
unforeseen events, the deadline cannot be met without resorting to overtime work;

3. Essential public services during emergency or critical situations that would


require immediate or quick response;

4. Relief operations, rehabilitation including post recovery and rehabilitation,


reconstruction, and other work or services during calamities and disasters;

5. Seasonal work, such as but not limited to, preparation of budgets and annual
reports, in order to meet scheduled deadlines;

6. Preparation of financial and accountability reports required by oversight agencies


like Congress of the Philippines, Office of the President, Commission on Audit,
Department of Budget and Management, and National Economic and Development _

Authority;

7. Services rendered by drivers and other immediate staff of officials when they are
required to keep the same working hours as these officials;
8. Services rendered by the Bids and Awards Committee Secretariat pursuant to
Section 15 of the 2016 Implementing Rules and Regulation of Republic Act 9184;
and

9. Such other activities needed to meet performance targets or deliver services to


the public as may be determined by the Head of Office.

E. Conditions for overtime service

In lieu of overtime pay, the COC corresponding to the number of hours


earned as a result of services rendered beyond regular working hours may be
availed of by the JO for the following instances:

1. Since the Department-Central Office is implementing the Flexi-Time Schedule,


JO who are authorized to render OT Services are required to report for work not
later than 8:00 in the morning during Mondays and 9:30 in the morning during
Tuesdays-Fridays, provided that at least 2 hours of overtime services are rendered,
otherwise OT services will not be counted.

2. OT services of JO in the Bureaus/Services operating on a 24-hour basis should


report for work on the scheduled time, otherwise OT services will not be counted.

3. During Saturdays, Sundays, holidays and non-working days, OT work shall be


limited to a minimum of four (4) hours and a maximum of eight (8) hours, which
shall start at 8:00 am and end at 5:00 pm.

4. The members of the secretariat and facilitators conducting activities (e.g


trainings, orientations, workshops, seminars, provision of technical inputs, etc) who
are required to undertake preparatory works one (1) day before the actual start of
the activity to meet the performance targets or deliver services to the public as may
be determined and approved by the Head of Office are allowed to earn COC.

5. If the scheduled day of the training falls on an unexpected holiday and


suspension, the members of the secretariat, facilitators and resource persons shall
be allowed to earn COC.

F. Not Authorized to Earn COC

1. JOs who are attending activities such as but not limited to trainings, seminars,
orientations, workshops as participants.

2. Travel time of JOs as participants and secretariat during trainings, seminars,


orientations, workshops, etc.

3. Overtime services rendered after the suspension of work.

G. Computation of Overtime Credits (COC)

The COC is expressed in number of hours, computed as follows:


a. For overtime services rendered on weekdays or scheduled work days:

COC = number of hours of overtime services x 1.0


b. For overtime services rendered on weekends, holidays or scheduled days off:

COC = no. of hours of overtime services x 1.5

H. Accrual and Use of COCs

1. Each JO may accrue not more than forty (40) hours of COCs in a month. In no
instance, however, the unexpended balance shall not exceed one hundred twenty
(120) hours.

2. COCs should be used as time-off within the year these are earned until the
immediately succeeding year. Thereafter, any unutilized COCs are deemed
forfeited.

3. The COCs cannot be used to offset undertime/s or tardiness incurred by the


employee during regular working days.

4. The unutilized COCs are deemed forfeited in cases of resignation, termination of


the contract and transfer to other Bureaus, Services and Offices. However, those
who
are appointed in a permanent position within the same office, the COC earned
be availed of.

I. Availing CTO

1. The CTO shall be availed of in blocks of four (4) or eight (8) hours.

2. An employee may use the CTO continuously up to a maximum of five (5)


consecutive days per single availment, or on staggered basis within the year.
However, Saturdays, Sundays and Holidays are not considered as gap for purposes
of availment anew.

3. JO who wish to avail of CTO should inform their supervisor at least 3 days prior
to the intended availment. The said schedule shall be submitted to the respective
Administrative Officer/Designate. CTO filed after incurring absences shall be
disapproved.

4. The said schedule may be recalled by the supervisor in the exigency of the
service and subsequently rescheduled by the supervisor within the year.

Steps Activity
1 The Head of Office issues an Office Order/Department
Personnel Order (DPO) authorizing the rendition of overtime
services indicating the task to to be completed and the
expected time of completion.
2 The JO renders overtime services as stipulated in the Office
Order/DPO
The Administrative Officer/AO designates shall prepare the
summary of overtime services rendered in a month and
computes the equivalent COC, for the purpose of the issuance
of the COC Certificate.
The Head of Office issues Certificate of COCs, specifying the
number of COCs earned in a month
The JO/AO/AO Designates request approval on the schedule
of CTO
The JO avails of the CTO
