THE ACHIEVEMENTS AND CHALLENGES OF THE DIGITALISED CENTURY IN

HUMAN RIGHTS

Summary

In this article the author proposes to present briefly the main achievements and challenges
in the field of human rights by mentioning the impact of digital progress and globalization as a
whole. The aim of the paper is to highlight both the achievements and challenges faced by
citizens in the process of re-healing human rights as a prerogative of the rule of law. The subject
under investigation involves a scientific-philosophical approach through the prism of the generic
content of the work. The author of the article expresses his concern about the lack of digital
literacy of information consumers regarding internet, terms and conditions of security and self-
protection in the online environment. He refers to novelty elements such as online manipulation,
false streets, the approach of privacy as an essential prerequisite in respect of human rights and
human dignity.

We live in a digitized century, where accessibility is at the fingertips. The man, always
thirsty for mystery, thanks to digitization, has experienced the peak of knowledge. No one is
omniscient, there are no people who have answers for everything, but it is technology that has
led people to come out of the panorama of man, to get acquainted with the outside world, and to
find answers to even the bleakest questions. In the absence of information, the human brain
would quietly smother, fall into nothingness, and be subjected to a nostalgic ephemerality.
Intense globalization has left deep traces in the development of intelligent technologies, with the
Internet becoming a source of elevation in the world of knowledge.
Access to information is a form of manifestation of individual rights and freedoms. Every
man, regardless of his social position, beliefs and origins, has the right to information, which has
become an art of common sense, each obtaining the information he wants without restricting
access to information of someone else. This right is closely linked to the nature of advertising.
An eloquent example are court public hearings, with certain exceptions provided by law. At the
same time, all users have the right to join associations, to create social networks or work
platforms, where everyone is entitled to own a virtual space, where he can spend his time
rationally and efficiently. For the younger generation, being an alternative and innovative one,
they need to see the internet as a springboard to the future but also to a good education. [1]
Personal data from the internet world is always subject to electronic processing and
storage. All our communications, visits and data are converted into binary language, and in the
case of disturbances in the online environment they may be lost or get in unsafe hands. To
prevent this, we need to know the terms and conditions of security and self-protection online.
Confidentiality and security must also be kept at work, as they are a primary key and a
confidence in tomorrow, as today's world is obsessed with social media, electronic articles and is
flooded with emails.
A veridical data processing system is the Integrated File Management Programme (IFMP),
an automation tool implemented with the aim of reducing corruption and promoting transparency
in the judicial system. It has the ability to manage data, monitor and manage files electronically.
One of its advantages is the random distribution of cases for resolution. The bottom line is that
the use of official platforms increases user privacy and security as they are upgraded.
It also happens, at the present stage, to face fake news (false news), which is a strategic
mean of manipulating the masses, because it perishes in human minds as a harmful
psychological game. These, by reducing the right to information, have a subjective aspect, are
characterized by spontaneity and focus on social topics, which often belong to certain
personalities, political campaigns and propaganda, less fixed data, representing, for their
promoters, a considerable source of income. It's not difficult to distinguish false news from true
one. True news has accurate data, is formed only by juxtaposition and presents the situation in
arguments and details, and in their account there is no antithesis in thoughts, unlike fake news,
which undermines serious media, misleading the population. A big problem is when the false
information is promoted by official sources such as: websites, platforms, radios or TV stations.
The Audiovisual Code considers that fake news is a total dementia and must be sanctioned. For
this purpose, the information and security service shall also operate. Last but not least, I would
like to remind you that the press has the task of correctly informing matters of public interest,
and "the dissemination of news must be done in accordance with the truth, after they have been
rigorously verified previously, the facts having to be exposed, described and presented with
rigour. Headlines and news announcements shall be the most accurate expression of the content
of the facts and data presented." [2] The legislation in force provides for penalties of around
1500 lei for each false news, a law introduced because 68% of the total information received in
the media is false[3]. Often, periods of crisis, national or international, are adorned by fake news,
an exception does not make the pandemic evolution COVID-19.
In case of participation in certain events or public demonstrations, people may face the
danger of having their pictures, videos placed in the online environment, on certain platforms,
without their consent, which is a serious violation of their personal dignity and life. Personal
data, in the given case, can be sold in the online environment and used for non-licensable
purposes. According to Article 74 of the Civil Code, every person has the right to the image.
Unagreed shooting of a person in a space that belongs to him or her is completely prohibited.
Article 76 of the Civil Code also presupposes the consent of the person photographed for the use
of his image when he has provided the photograph of a person whom he knew was active in the
field of public information. [4]
As long as we don't take a step forward, we'll always find ourselves in the same place. No
one should ever limit himself, looking at life as a spectator, limitation is the raw material of
manipulation. We must have the courage to inform ourselves in order to be enlightened. It would
be good for everyone to work hard on their wisdom, only then the steps under their feet will
never end.
