BILL NR 1: PRELIMINARIES

Conditions of Contract and Preliminaries

The Conditions of Contract are the JBCC Principal Building Agreement inclusive of the
Contract Data (Edition 6.1 March 2014) prepared by the Joint Building Contracts Committee
Inc amended as hereinafter described with ammended clause 25.7

The ASAQS Preliminaries (August 2010 edition) published by the Association of South
African Quantity Surveyors for use with the said JBCC Principal Building Agreement inclusive
of the Contract Data shall be deemed to be incorporated hereinafter

Contractors are referred to the abovementioned documents for the full intent and meaning
of each clause thereof

These clauses are hereinafter referred to by clause number and heading only. Where
standard clauses or alternatives are not entirely applicable to this agreement such
modifications, corrections or supplements as will apply are given under each relevant clause
heading and such modifications, corrections or supplements shall take precedence
notwithstanding anything contrary contained in the abovementioned documents

Where any item is not relevant to this specific agreement such item is marked not
applicable

Pricing of Preliminaries

Should the contractor select Option A in terms of clause 26.0 in the Contract Data for the
purpose of adjustment of these preliminaries, the amount entered into the amount column
in these preliminaries is to be divided into one or more of the three categories provided
namely Fixed (F), Value Related (V) and Time Related (T)

Section A - Principal Building Agreement

Definitions (A1)

Clause 1.0 - Definitions and interpretation

Replace the definitions with the following wording:

AGREEMENT: The agreement arising from the signing of the Form of Offer and Acceptance
by the parties

BILLS OF QUANTITIES: The document drawn up in accordance with the measuring system as
stated in the Pricing Data. The contractor shall have priced the document to reflect the
contract sum

CONTRACT DOCUMENTS: The document, the contract drawings, the priced document and
such other documents as are identified in the contract data

CONTRACT DRAWINGS: The drawings stated in Addendum A upon which the accepted
tender or negotiated amount was based

CONTRACT SUM: The total of prices inclusive of VAT as stated in the Form of Offer and
Acceptance

Where prices are submitted by the contractor or n/s subcontractor during the progress of
the works in respect of contract instructions or in regard to a claim under the terms of the
agreement and notwithstanding the fact that such prices may be used in an interim
payment certificate, there is to be no presumption of acceptance. Should the principal
agent wish to accept any such prices prior to the issue of the certificate of final completion,
it shall be in writing

The contractor shall not receive any mark-up for overheads and profit on any omission of
tenant installation work or tenant installation work by others. Claims for loss of profit shall
not be entertained

Various existing services including but not limited to storm water, sewer, water, telephone,
electrical, gas, cross the site. The contractor shall make all necessary allowances for all
deviations and protection of services in the programme.

Should any interruption to water, electricity, sewer, or drainage services to the terminal
buildings be required, the contractor shall give at least 7 working days notice to the
principal agent and provide a method statement outlining the extent of the work and satisfy
all the requirements

The contractor shall be solely responsible for ensuring that every necessary precaution is
taken to protect all existing services from any damage. The contractor shall furthermore
ensure that no services are cut off to any of the existing operational areas during deviations
and the like. Should this, however, not be possible then the contractor shall timeously notify
the principal agent of this so that arrangements may be made with the employer for
identification as to when such work may be executed.

Should the contractor encounter unknown services such as underground cables, pipes or
sewers during the execution of the works, he shall adequately support in position and
protect from damage any services exposed by his operations of rendered liable to damage
by reason of the work in hand.

Where the contractor anticipates or find that it will be impossible for him to carry out the
works without causing the damage to the existing services or works, the contractor shall
make such arrangements as the principal agent may approve to remove, deviate, protect or
suspend the work or services concerned.

The contractor shall ensure that he/she has suitable staff to programme the works using
suitable and recognised programming software and the programme for the works is to be
developed in sufficient detail indicating an activity network with early and late start dates,
early and late finish dates and duration for each activity, further each activity is to be linked
and the critical path indicated. Furthermore, the programming of the works shall include
detailed documentation and information required schedule which indicates latest dates by
which information is required in order to achieve programme dates.

This programme shall be drawn up in accordance with the dates given herein, sectional
completion and practical completion and shall be in sufficient and approved detail to ensure
control over the work.

The contractor shall be responsible at all times for maintaining the accuracy, validity and
reasonableness of the programme, and the implementation thereof.

Where warranties for materials and/or workmanship are called for, the contractor shall
obtain a written warranty, addressed to the employer, from the firm supplying the
materials and/or doing the work and shall deliver same to the principal agent on the final
completion of the contract. The warranty shall state that workmanship, materials and
installation are warranteed for a specified period from the date of final completion and that
any defects that may arise during the specified period shall be made good at the expense of
the firm supplying the materials and/or doing the work, upon written notice to do so. The
warranty will not be enforced if the work is damaged by defects in the construction of the
building in which case the responsibility for replacement shall rest entirely with the
contractor

Notwithstanding anything to the contrary contained herein the Principal Agent at all times
reserves the right to direct the order in which various parts of the contract are executed.
The contractor shall give priority to any individual section or portion of the works that in the
opinion of the Principal Agent requires to be expedited. Should the Contractor or the
Principal Agent be of the opinion that such instruction warrants a revision of the
Programme, then the applicable provisions of the contract shall apply.

Should it appear, in the opinion of the Principal Agent, that work in any area is not being
executed in accordance with the requirements of the programme, the Contractor shall
provide at no extra cost, additional overtime and do everything else required to bring the
work back to Programme to the satisfaction of the Principal Agent.

At the end of each week the contractor shall provide the principal agent with a written
record, in schedule form, reflecting the number and description of tradesmen and labourers

recorded by the contractor on the structural engineer's drawings and are to be submitted

Without limiting the generality of the provisions of clause 2.0, the contractor's attention is Item 1
drawn to the provisions of the Construction Regulations, 2003 issued in terms of the
Occupational Health and Safety Act, 1993. It is specifically stated that the employer shall
prepare a documented health and safety specification for theworks and that the employer
shall ensure that the contractor has made provision for the cost of health and safety
measures during the execution of the works. The contractor shall price opposite this item
for compliance with the act and the regulations and the reasonable provisions of the
aforementioned health and safety specifications

BILL NR 2: DEMOLITIONS OF STORAGE UNITS

MODEL PREAMBLES FOR TRADES

For preambles refer to Model Preambles for trades 2008 edition issued by the Association of South African
Quantity Surveyors for specification of materials and methods to be used.

SUPPLEMENTARY PREAMBLES

The Tenderer is also to refer to drawings number A103 and A104 and take cognisance thereby in pricing.

STORE ROOM (BLOCK A ON PLAN)

A Demolish existing building approximate dimensions 8880 mm long x 3910mm wide x 3200mm high . The 1 Item

demolition works shall include but not limited to taking down the whole substructure including strip foundations

and foundation walls, concrete surface bed, internal and external walls, window and doors, roof covering and

structural roofing timber, plumbing installation works, electrical installation works, joinery fittings, backfilling

excavations in 300mm layers compacted to atleast 95% AASHTO, disposal of surplus excavated material etc.

Materials arising from the demolitions must be carted away to a tip provided by the contractor and the

contractor shall be responsible for paying any tipping fees. The contractor is strictly advised to visit the site to

assess the extent of the scope and any risks associated with this work because claims for extra payment

arising as a result of the contractor's failure to fully understand the scope and its risks will not be accepted.

All the works must be carried out in compliance with Occupation Health and Safety Act, Construction

Regulations and any other laws applicable at the time the works are being executed.

STORE ROOM (BLOCK B ON PLAN)

uPVC pipes and fittings

Soil, waste and vent pipes and fittings shall be solvent weld jointed

Excavations

No claim for rock excavation will be entertained unless the contractor has timeously notified the quantity
surveyor thereof prior to backfilling. (48 hours notice is required prior to backfilling)

Laying, backfilling, bedding, etc of pipes

Pipes shall be laid and bedded and trenches shall be carefullybackfilled in accordance with manufacturers'
instructions. Where no manufacturers' instructions exist pipes shall be laid in accordance with clauses 5.1
and 5.2 of each of the following: SABS 1200 L : Medium pressure pipelines: LD Sewers LE: Stormwater
drainage: Pipe trenches etc shall be backfilled inaccordance with clause 3, 5.5, 5.6, 5.7 and 7 of SABS

A 110mm pvc pipe in trench including excavations, backfilling and disposal 32 m

B 110mm pvc bend 2 Nr

C 8000litres heavy duty plastic septic tank as manufactured by Roto Tanks or any other equal and approved 1 Nr
installed as per manufacturer's specifications including excavations,backfilling in 300mm layers and
compacting to atleast 95% AASHTO and disposal of surplus materialto a tip provided by the contractor
(See product specification attached for for details)

D 1000x1000x1000mm deep brick manhole complete with 100mm thick mass concrete slab, 230mm 2 Nr
brickwall in English Bond, benching, plastering, forming holes and ductile cast iron cover and frame size
420 x 345mm type HYDREX Z300x400C including excavations, backfilling in 300mm layersand compacting
to atleast 95% AASHTO and disposal of surplus material to a tip provided by the contractor all complete
including any associated works

E Extra over excavation in hard rock (Provisional) 1 m3
