DEED OF ASSIGNMENT

KNOW ALL MEN BY THESE PRESENTS:

That I, EFREN Y. PELAEZ, of legal age, Filipino citizen, married to


LOLITA A. PELAEZ, and a resident of No. 20 H. Lozada St., San Juan, Metro-
Manila, Philippines,

WITNESSETH, THAT :

Whereas, I am the Mortgagee of a real property consisting of a parcel of land


with improvements located at No. 20 H. Lozada Street, San Juan, Metro-Manila,
with a total area of Fifty Two Square Meters and Fifty Three Square Decimeters
(52.53), and covered by Transfer Certificate of Title No. 7534-R of the Registry of
Deeds for San Juan, Metro-Manila;

Whereas, said real property was mortgaged in my favor by Eduardo V. Aguilar,


married to Nenita Pascual, and a resident of No. 20 H. Lozada Street, San Juan,
Metro-Manila on January 9, 2004, by virtue of a Real Estate Mortgage duly
acknowledged before Notary Public Atty. Romualdo C. Delos Santos of San Juan,
Metro-Manila, as per Doc. No. 280, Page 57, Book No. 48, Series of 2004 of his
Notarial Register, and duly annotated at the back of the aforesaid Transfer
Certificate of Title No. 7534-R;

Whereas, I have decided and agreed to transfer, cede and assign all my rights
and interests as Mortgagee over said real estate mortgage unto the ROSABELLA
A. KUTCHEK, of legal age, formerly a Filipino citizen, now a U.S. citizen,
married to RAYMOND KUTCHEK, and a resident of No. 8528 West 80th Street,
Justice, Illinois, U.S.A., who has agreed to accept and exercise such rights and
prerogatives as if she were the original Mortgagee in said real estate mortgage
contract;

NOW, THEREFORE, FOR AND IN CONSIDERATION of the foregoing


premises, and of our mutual covenants, I, EFREN Y. PELAEZ, do hereby
transfer, convey and assign, and by these presents, have transferred, conveyed and
assigned, in a manner absolute and irrevocable, all my rights, title, interests and
participation as Mortgagee of the aforementioned real property and under the
above-denominated Real Estate Mortgage deed, unto and in favor of
ROSABELLA A. KUTCHEK, her heirs, successors or assigns, for all intents and
purposes, to have and to hold the same for all intents and purposes, and to exercise
such rights and prerogatives as if she were the original Mortgagee in said real
estate mortgage contract, including all of the rights and interests I have acquired
subsequent to the execution of said real estate mortgage deed, and other rights
appurtenant to the enjoyment of the same;

That I, EFREN Y. PELAEZ, do hereby warrant that my aforesaid rights and
interests as Mortgagee remain intact and enforceable up to this date, and that,
henceforth, the same shall pertain solely and exclusively to said ROSABELLA A.
KUTCHEK.

This  instrument refers to a Deed of Assignment of Rights and Interests as


Mortgagee pertaining to the real estate mortgage contract of the real property
situated in San Juan, Metro-Manila and covered by Transfer Certificate of Title
No. 7534-R, consisting of two (2) pages, duly signed by the parties and their
witnesses on each and every page, and sealed with my notarial seal.
