DECLARATION OF HEIRSHIP AND SALE

KNOW ALL MEN BY THESE PRESENTS:

This Deed is made and executed by:

ANTONIETA MONTEBON GREFALDIA, of legal age, Filipino, single, with


residence and postal address at Looc, Sibulan, Negros Oriental, hereinafter referred to as the
HEIR-VENDOR,
-in favor of-

EMMANUEL BRIGOLE COMPUESTO, of legal age, Filipino, married, with


residence and postal address at Camanjac, Dumaguete City, Philippines, hereinafter referred to
as the VENDEE.

WITNESSETH:

WHEREAS, GRENGIA GRAVADOR, married to Pedro Grefaldia, is one of the


registered owner and is entitled to ¼ share of Lot No. 3425, situated in the Barrio of Looc,
Municipality of Sibulan, Province of Negros Oriental, under Original Certificate of Title (OCT)
No. O-V 1204, containing a total area of SIX THOUSAND FIX HUNDRED AND TWETY
FOUR (6, 524) SQUARE METERS, more or less, which is more particularly described as
follows, to wit:

Lot No. 3425

“ A parcel of land ( Lot No. 3425 of the Cadastral Survey of Sibulan,


Cadastral Case No. 15, L.R.C. Cadastral Record No. 358), with the improvements
thereon, situated in the Barrio of Looc, Municipality of Sibulan, Province of
Negros Oriental. Bounded on the Ne. by Lots 3548, 3549 and 3424; on the SE. by
Lot No. 3424 and Sapang Cansaguing; on the SW. by Lot No. 3436; on the W. by
Lot No. 3429; and on the NW. by Lots Nos. 3429 and 3547. Beginning at a point
marked “1” on plan, being S. 24 deg. 34’E., 565.18 m. from B.B.M. No. 17;
thence S. 7 deg. 40’E., 25.12_ m. to point 2; S. 85 deg.32’W., 39.26 m. to point 3;
S. 25 deg. 06., 11.69 m. to point 4; S.64 deg. 30’E. 32’W., 39.26 m. to point 3; S.
25 deg. 06’W., 11.69 m. to point 4; S. 64 deg.30’E. 32.07 m. to point 5; S. 43 deg.
43’W., 82.86 m. to point 6; N. 47 deg. 55’W., 39.14 m. to point 7; N39 deg. 47’.,
36.7 m. to point 8; N.0 deg. 08’W., 65.07 m. to point 9; N.72 deg. 50’E., 34.72
m.to point 10; S.67 deg. 09’ E., 45.19 m. to the point of beginning; containing an
area of SIX THOUSAND FIVE HUNDRED AND TWENTY FOUR (6, 524)
SQUARE METERS, MORE OR LESS.”

WHEREAS, GRENGIA GRAVADOR and Pedro Grefaldia died intestate and left no
debts or obligations due against their estate and was survived by their four (4) children, namely,
OLIVA GRAVADOR CANCIO, ANTONIO GRAVADOR GREFALDIA, DEMETRIA
GRAVADOR GREFALDIA, ANISITO GRAVADOR GRAFALDIA;

That ANTONIO GRAVADOR GREFALDIA, is the owner by verbal agreement between


the other co-owners of a portion of Lot 3425, which portion is particularly known as Lot No.
3425-A-1 with an area of THREE HUNDRED SIXTY NINE (369) SQUARE METERS;

WHEREAS, ANTONIO GRAVADOR GREFALDIA also died intestate and left no


debts or obligations due against his estate and was survived by his six (6) children, namely,
CATALINA KINKITO, ROLANDO GREFALDIA, DEOGENES GREFALDIA, ANONIETA

MONTEBON GREFALDIA, GENARA SERNICULA, and ANGELITA ÑEGO, the seller-heir
being one of them;

WHEREAS, pursuant to Section 1 Rule 74 of the Revised Rules of Court, subject to


limitations imposed under Section 1 of the same Rule 74, the above-named heir-vendor
ANTONIETA MONTEBON GREFALDIA, being of legal age, with full civil capacity to
contract, do hereby by these presents, SETTLE and ADJUDICATE unto herself her share over
the above-described parcel of land extrajudicially.

WITNESSETH FURTHER:

That for and in consideration of the sum of FORTY THOUSAND PESOS (P40,000.00)
Philippine Currency, receipt whereof is hereby acknowledged in full by the HEIR-VENDOR
from the VENDEE, the herein HEIR-VENDOR, do hereby by these presents, SELL, CEDE,
CONVEY and TRANSFER, in a manner absolute and irrevocable, a portion from the above
mentioned parcel of land which is also a portion of a sublot known respectively as sublot of Lot
No. 3425-A-1, which portion containing an area of SIXTY TWO (62) SQUARE METERS unto
the VENDEE, his heirs, and assigns, free from all liens and encumbrances.

That the above-described parcel of land is not tenanted and no provisions of R.A. 6657
has been violated and that notice of preemption and/or redemption has been given but no such
pre-emptioner and/or redemptioner chose to exercise said rights with regards to this sale.

IN WITNESS WHEREOF, we have hereunto affixed our signatures this 29 th day of


August, 2019 at Sibulan, Negros Oriental, Philippines.

Oriental, Philippines, personally appeared, ANTONIETA MONTEBON GREFALDIA, with
her Philhealth ID with No. 12-025085198-2 and EMMANUEL BRIGOLE COMPUESTO,
with his Professional Driver’s License with No. G08-11-003121 valid until 6/27/2022, known to
me to be the same persons who executed the foregoing instrument, and they acknowledged to me
that the same is their free act and voluntary deed. This instrument relates to a DECLARATION
OF HEIRSHIP AND SALE, consisting of two (2) pages in which this acknowledgment is
written and has been signed by the parties and their instrumental witnesses on each and every
page hereof.
