This bail Petition filed by the Counsel for the Petitioner/Accused dated 22/10/2020
praying to grant bail to the Petitioners/Accused U/s 439 Cr.P.C.
This Bail petition is coming on this day for hearing before me in the presence of
Thiru.G.Arputhavanan, learned Counsel appeared on behalf of Petitioner/accused and
Tmt.R.Kopperundevi, learned Special Public Prosecutor, Dindigul appeared on behalf of
State, after hearing the arguments of both sides, upon perual of relevant records, this Court
passed the following:
ORDER
Petition for bail. The Petitioner/accused is charged for the offence U/s 363 I.P.C. Sec.5(l)
r/w 6 of of Protection of Children from Sexual Offences Act,2012, Sec.9 of Child Marriage
Restraint Act and Sec.3(2)(v) of SC/ST (POA) Amendment Act,2015 in Cr.No.993/20 of Sanarpartti
P.S. Accused is in duress from 18/09/2020.
The learned Counsel for the Petitioner/Accused contended that the Petitioner/ Accused is
innocent, that the Petitioner/ Accused has not committed any offence as alleged in the complaint,
that Petitioner/ Accused is in no way connected with the alleged occurrence, that false case has been
foisted against the Petitioners/Accused, that the Petitioner/ Accused is arrested and remanded to
Judicial custody on 18/09/2020, and is in Judicial custody for the past 41 days, that if the
Petitioners/Accused will be released on bail, she will neither abscond, nor tamper the Prosecution
witnesses, that the Petitioner/Accused is ready to produce sufficient sureties to the satisfaction of
this Court, that the Petitioner/Accused should obey the conditions imposed against her and prays to
release the Petitioner/ Accused on bail with condition.
The respondent police filed objection through the learned Special Public Prosecutor,
Dindigul stating that the invesigation is still pending, that if the Petitioner/ accused will be released
on bail bail by this court, she will abscond and also tamper the Prosecution witnesses, and hence
strongly objected to release the Petitioner/ accused on bail. The learned Special Public Prosecutor,
Dindigul appearing on behalf of respondent police vehemently opposed to grant bail to the
Petitioners/accused on bail stating that the invesigation is still pending.
Heard both sides arguments. Records perused. While so, on perusal of the back
records, it is found that the A.1 involved in this case namely one Periyanna Velar @
Periyasamy Kumar (24/2020) S/o Rasu Velar not sent to Medical examination before the
Medical Officer, Government Headquarters Hospital, Dindigul on 06/10/2020 on the basis
of the Requisition submitted by the Investigation Officer. Further, invesigation of this case
should have been completed by this time. On considering the facts and circumstances of
this case, gravity of the offence, period of detention already undergone by the
Petitioner/Accused-A.2 in this case, this Court this Court is not inclined to grant bail to the
Petitioner/accused with the following stringent conditions.
In the result, the Petitioner/ Accused-A.2 is directed to deposit Cash Surety amount
of Rs.20,000/- before this Court instead of giving two physical sureties to her, and the same
has to be credited into the Cr.C.D. Account of this Court in favour of Cr.No.993/2020 of
Sanarpatti P.S. After deposit of said Cash Surety amount before this Court by the learned
Counsel for the Petitioner/ Accused-A.2, the Petitioner/ Accused-A.2 will be released on
bail on her executing a own bond for a sum of Rs.10,000/- in the presence of the concerned
Prison Superintendent in which the Petitioner/accused-A.2 is in Judicial custody as on date
with a condition that the Petitioner/Accused should appear and sign before the respondent
police station daily at 10-00 A.M.without fail until further orders. It is further ordered that
the Petitioner/ Accused should not tamper the Prosecution witnesses and should not
abscond.
