Obligation and Contracts
ART 1156. 
An Obligation is a Juridical necessity to give, to do or not to do. 
Requisites / Elements of an Obligation
1. Active Subject – Known as the creditor or the obligee. The person who is entitled to demand the
fulfilment of an obligation. 
Kilala bilang nagpapautang o ang nagpapaupa. Ang taong may karapatang humiling ng
katuparan ng isang obligasyon.

Halimbawa

Illustrative case:

By virtue of a contract, Coca Cola Company Delivery obliged to ship the goods of SM
Supermarket from Manila to Lucena for 2,500. 

Sa bisa ng isang kontrata, obligado ng Coca Cola Company Delivery na ipadala ang mga
kalakal ng SM Supermarket mula Maynila patungong Lucena sa halagang 2,500.
 
JEAN GAGAN a ONLINE SELLER  owner obliged Mabel to deliver 8 t-shirt of lacos from Brgy.
Sapaan to Brgy Lumutan for 50 pesos.  

2. Passive Subject – Known as the debtor or the obligor. The person who is bound to the
fulfillment of an obligation. 

Kilala bilang may utang o may utang. Ang tao na nakasalalay sa katuparan
ng isang obligasyon.

By virtue of a contract, Jefferson Layug obliged himself to ship the goods of melanie
from caridad to lumutan for 1, 000.

3. Prestation- the promise or the particular contract to be observed in the performance of an
obligation, and may consist of giving, doing or not doing. 
Kahusayan- ang pangako o ang partikular na kontrata na dapat sundin sa pagganap ng isang
obligasyon, at maaaring binubuo ng pagbibigay, paggawa o hindi paggawa.
