JUDICIAL AFFIDAVIT

I, HERNALISA S.J. MACASO, of legal age, married, with postal address at PNP
Crime Laboratory Service 9, Mercedes Road, Camp Colonel Romeo A. Abendan,
Zamboanga City, a forensic chemist in this case, state under oath as follows:

PRELIMINARY STATEMENT
The person examining me is Atty. Ellen S. Enriquez, with office address
at 456, Sarte Building, San Jose Road, Zamboanga City. The examination is
being held at the same address. I am answering her questions fully conscious
that I do so under oath and may face criminal liability for false testimony and
perjury.

Question 1: Please state your name and other personal circumstances for
the record.
Answer 1: I am PCPT Hernalisa S.J. Macaso, of legal age, married, and
a forensic chemist for the PNP Regional Crime Laboratory;

Question 2: Why are you here in my office today?


Answer 2: To give my testimony regarding the case filed by the Republic
of the Philippines for Rape defined under Article 266-A,
Paragraph 1, in relation to Article 266-B, as amended by RA
No. 8353 known as “The Anti-Rape Law of 1997” against the
person of Mr. X pending before the Regional Trial Court,
Branch 17, Zamboanga City;

Question 3: In what capacity are you going to testify?


Answer 3: As a witness Ma’am.

Question 4: So you are a licensed chemist?


Answer 4: Yes Ma’am.

Question 5: With regards to your educational background, what is your


bachelor’s degree and where and when did you graduate?
Answer 5: I graduated from University of Sto. Tomas with the degree of
Bachelor of Science in Chemistry in the year 2005 with latin
honors and passed the Licensure Exam for Chemist on
October 2006.

Question 6: How long have you been practicing your profession?


Answer 6: For almost twelve (12) years already.
Question 7: Where are you presently employed?
Answer 7: At PNP Regional Crime Laboratory, Zamboanga City.

Question 8: What position do you currently hold?


Answer 8: I am the Forensic Chemist in the said office.

Question 9: As a Forensic Chemist, what are your duties and


responsibilities, Ms. Witness?
Answer 9: As a Forensic Chemist, we analyze non-biological trace
evidence found at crime scenes in order to identify unknown
materials and match samples to known substances. We also
analyze drugs/controlled substances taken from scenes and
people in order to identify and sometimes quantify these
materials.

Question 10: Have you undergone trainings and seminars to qualify you
as Forensic Chemist?
Answer 10: Yes, I have attended trainings and seminars in the
Philippines and overseas particularly on Public Safety Traffic
Investigation and Detection, and Public Safety Narcotics
Investigation.

Question 11: In the course of your examination as such, did you happen
to examine a sample of milk last September 23, 2019 @
around 2PM, particularly labelled as WCPD-R-01-2019?
Answer 11: Yes Ma’am.

Question 12: Under what circumstances did you come to examine the
sample of milk?
Answer 12: The request came from PSSg Maria L. Abu, lead investigator
of the rape case of MISS A. The request for examination of
then unknown substance was made on September 23, 2019
around 2PM.

Question 13: After receiving such request, what did you do next, if any?
Answer 13: After I received the request together with the sample of milk
recovered from the crime scene, I immediately conducted the
procedure for substance analysis.

Question 14: What was your finding after conducting a substance analysis
of the sample of milk?
Answer 14: After examining the sample of milk, following substance were
found: water, proteins, lactose and minerals, phospholipids
and traces of KETAMINE.
Question 15: What is this Ketamine?
Answer 15: KETAMINE is used by medical practitioners as an
anaesthetic and sometimes used illegaly by people as a ‘date-
rape drug’. It is also known as club drugs are usually used
at raves, clubs and concerts used by people to overpower
and incapacitate victims to facilitate sexual assault.

Question 16: In what form are these substances available?


Answer 16: It is a clear liquid when used in medicine, a grainy white
crystalline powder when sold on the street.

Question 17: How is it taken?


Answer 17: By injecting it, swallowing or snorting.

Question 18: What are the effects after taking it?


Answer 18: The effects include abrupt loss of consciousness and can
make you feel dream-like and detached.

Question 19: How long is the duration of such effects?


Answer 19: It typically lasts for just about an hour, but they can
continue for as long as a day, depending on the dose and
method of ingestion. Some people just sleep off lower doses
of ketamine, but others may continue experiencing a sense
of derealization the day after taking it, especially at high
doses.

Question 20: Would a ketamine substance mixed in milk produce such


effects?
Answer 20: Yes.

Question 21: Did you prepare a laboratory report showing such findings?
Answer 21: Yes Ma’am.

Question 22: I have here a document from the PNP REGIONAL CRIME
LABORATORY OFFICE dated September 23, 2019, is this
familiar?
Answer 22: Yes Ma’am.

Question 23: At the bottom of this document entitled SUBSTANCE


ANALYSIS REPORT, there appears to be a name, PCpt
Hernalisa S.J. Macaso with a signature over it. Is this your
name and signature?
Answer 23: Yes Ma’am that is my name and signature.
Question 24: For the meantime, I don’t have further questions, do you
have any statements to add or take away from this affidavit?
Answer 24: None Ma’am.

Question 25: Are you willing to sign this affidavit consisting of eleven (11)
pages, to certify that all statements you made are true?
Answer 25: Yes Ma’am.
