This document is an agreement between the student named below and the Mass Communication
Department and constitutes the only terms under which any production facility of the department.

Borrower Date

1. Borrower agrees usage of equipment is for class projects or university approved


activities. No equipment is to be used for personal activities.
2. Borrower accepts full financial responsibility for loss (including theft) or damage of equipment
or facilities used under terms of agreement, and hereby agrees to pay full market replacement
costs (or costs or repairs, at the option of the Chair of Mass Communications) of all equipment
and facilities damaged or loss due to negligence, misuse, or carelessness. Borrower will not be
allowed to check out any additional equipment until all claims are settled. Normal wear and
tear is expected by Mass Communication.
3. Borrower accepts responsibility for becoming thoroughly familiar with the proper use and
operation of equipment, prior to its use, under terms of this agreement, and agrees to request
instructions on proper use of such equipment.
4. Borrower agrees to inspect all equipment being borrowed/used before the period of use begins,
and agrees to make written notice to checkout person of any equipment problem before use
begins.
5. Borrower accepts full responsibility for maintaining adequate protection of equipment againsttheft
during periods of use under terms of this agreement.
6. Borrower agrees to report in writing a complete description of any damage or operating problems
during periods of equipment use under terms of this agreement.
7. In the case of shared-credit or corporative production use of equipment or facilities, liability willbe
accepted by the individual nominally in charge (customarily the director) and secondarily by the
individual directly responsible for loss or damage of equipment or facilities. The two may work out
an equitable division of the full financial liability amount, and in the event of a dispute over the
division of liability, borrower agrees to arbitration by the chair of masscommunication.
8. During any period of time in which a liability claim for damage or loss of Mass Communication
equipment or facilities remains unsettled under terms of this agreement, liable individuals will not
receive credit for current production courses, and will not be allowed to enroll in any higher level
production course until said claim is settled.
Penalties and Offenses

Strikes are assigned for the failure to follow the equipment checkout procedures. Listed below is an
overview of the offenses & strikes. The Mass Communication Department has the right to add additional
strike violations as it deems necessary.

1 strike:
Turning in equipment late (2 hours maximum)
Leaving battery on camera
Not coiling cables back neatly
Leaving the camera turned on in the case

2 strikes:
Leaving some or all equipment behind
Bringing equipment back 1 day late
Returning or checking out equipment for someone else

3 strikes:
Breaking any equipment
Flagrant misuse of equipment
Use of equipment for personal projects not approved by Broadcast Operations
Having equipment checked out without approval
Leaving equipment unattended
Bringing Equipment back more than 1 day late

If a student receives strikes they will remain on the student’s record for the rest of the semester. A total of
three strikes will result in the forfeiture of equipment check out privileges for the remainder of that
semester. Any student who receives three strikes, more than once will forfeit privileges for one academic
year. If a violation occurs past the halfway point of an academic semester, based on severity of the
violation, strikes can carry over to the next full semester.

Be careful not to over tighten tripod adjustments. Anything that can be tightened, need only be “snug”.

You must supply your own class 10 or above flash cards (SDHC) for all cameras. NO MINI SD CARDS!

IF ANY PART IS MISSING OR BROKEN ON A CAMERA, ACCESSORY, OR ANY ITEM CHECKED


OUT BY ME, I WILL BE HELD FINANCIALLY RESPONSIBLE.

At the end of each semester, all equipment must be turned into the checkout room by noon on the last
official class day. If it is not returned on time, the university police department will be called and charges
will be filed. Furthermore, the cost of equipment will be placed on your Sam Houston State student
account.

I have read this agreement, fully understand its contents, accept financial liability for equipment and
facilities to be used, and intending to be legally bound by this agreement, hereunto set my signature.
