would be issued by CPRI free of hire charges. The contractor has to return the tools issued in
good condition. Any loss or damage to tools issue shall be suitably recovered from the
contractor. The decision of the Joint Director on the issue of recovery and quantum of
recovery shall be final and binding.

Clause 19: In partial modification of clause 19, the following additional stipulations are
made:

(a)The contractor is also required to pay minimum Ex-gratia/Bonus @ 8.33% on current


upper limit of wages per month of Rs. 7000 /- mansem to the laborers engaged for this work
as per rules

(b) The contractor is also required to make monthly payment to the laborers engaged by him
on his own, without linking the receipt of payment from CPRI before 5th of every month.

(c)The contractor shall pay to Labour employed by him directly the wages not less than
minimum wages as defined in the contractors Labour regulations in the presence of Accounts
Officer of CPRI or his authorized representatives. The wages shall be disbursed on or before
5th of every month. The contractor shall submit attested Photostat copies of receipts towards
remittance of ESI, PF etc., upon which the same will be reimbursed to the contractor. The
contractor shall not link the payment of wages, EPF, ESI contributions etc., with the receipt
of bills from CPRI. The contractor shall submit the monthly bills along with extract of
Attendance Register, pay-slips and proof of payment made towards ESI / EPF contribution
along with detailed list of remittances containing manpower engaged at CPRI on or before
10th of every month. The contractor shall furnish Annual returns issued by EPF office in
respect of workers engaged by him in CPRI works

(d )Procedure for submission of bills :


The contractor shall submit the bills in prescribed formats for the job works carried out by
then as per as per the nomenclature given in the schedule ‘A’, on monthly basis. The
following required details / information are required to be followed by the contractor and
submitted along with each of the bill as supporting documents, for scrutiny and payment.

(g)The Joint Director shall on a report having been made by an Inspecting Officer defined in
the Contractor's Labour Regulations have the power to deduct from the money due to the
Contractor any sum required or estimated to be required for making good the loss suffered by
a worker or workers by reason of non-fulfillment of the conditions of the contract for the
benefit of workers, non-payment of wages or of deductions made from him or their wages
which are not justified by the terms of the Contract of non-observance of the said Contractor's
labour Regulations.

(h)The Contractor shall indemnify the CPRI against any payment to be made under and for
observance of the. Regulation aforesaid without prejudice to his right to claim indemnity
from his sub-contractors.

(i)In the event of the Contractor committing a default or breach of any of the provisions of
the aforesaid contractor's Labour Regulations, as amended from time to time or furnishing
any information or submitting or filling any form / Register / Slip under the provisions of
these Regulations which is materially incorrect then on the report of the Inspecting Officers
as defined in the Contractors Labour Regulations, the Contractor shall without prejudice to
any other liability pay to the CPRI a sum not exceeding Rs.50/- as liquidated damages for
every default breach or furnishing, making, submitting, filling materially incorrect statement
as may be fixed by the Joint Director of Civil Engineering Division and in the event of the
Contractor's default continuing in this respect, the liquidated damages may be enhanced to
Rs.50/- per day for each day of default subject to a maximum 5% percent of the estimated
cost of works put to tender. The Contractor shall defend the case by himself any action
brought in by such Government Agencies for non-compliance of any Labour Regulations and
/ or reimburse the expenses incurred by CPRI in this regard.

(j)The Joint Director CPRI, Bangalore may require the contractor to dismiss or remove from
the site of the work any persons in the contractors’ employment upon the work who may be
incompetent or misconduct himself and the contractor shall forthwith comply with such
requirements.

(k) The contractor should take independent code numbers under EPF Act 1952 and ESI Act
1948 and shall cover his workmen under the employees provident fund schemes and
Employees State Insurance Act 1948 and shown proof of payment of subscriptions /
contributions to the concerned authorities. Both in respect of ESI / EPF the contractor shall
obtain necessary declaration forms from his employees and obtain individual insurance and
PF numbers and shall furnish to the CPRI necessary proofs for having made remittances of
ESI & PF contributions in respect of all contract laborers engaged by him for CPRI works

(l) As regards employees State Insurance Act the contractor shall submit to CPRI attested
Photostat copies of the Challan of remittance of the contributions (both the employees
contributions and his own contribution thereon) to the ESI corporation in respect of the
employees engaged in CPRI by him for this work for the relevant period before any payment
is released by CPRI

(m)As regards the Employees Provident fund and miscellaneous provisions Act 1952 and
rules and regulations and schemes framed there under he shall be liable to pay employees
compensation under the Act in respect of all labour employed by him for the execution of the
contract for this purpose he shall indicate the code number obtained by him from the
Regional Provident Fund commissioner through authorized officer of CPRI and produce
original and a copy of the Challan receipt of monthly remittance of the contributions made
by him along with every bill. The original on verification will be returned to the contractor.

(n)The working hours shall be 08.30 AM to 05.30 PM with ½ Hour lunch break and two
breaks of 15 Minutes each .On the issue of whether performance of any contract worker or
worker is/ are satisfactory or not , the decision of the Joint Director shall be final and binding
.

(o) Procedure to be followed:


(i)The contractor shall make payment of wages, wages of paid holidays and bonus to the
contract workers after making statutory deductions of Employees contribution towards EPF
and ESI on or before 5th of every month in the presence of Accounts Officer or his
authorized representative from CPRI

(ii)He must remit his contribution of EPF and ESI together with the employees contributions
to the EPF and ESI organizations respectively.

(iii)He must then raise his running account / final bill containing the following items :

(iv) Running Account bill for the particular month indicating the various completed job
works as indicated in the schedules and specifications, along with,

(v) Remittances made to EPF and ESI organizations consisting of his stipulated contributions
as well as employee’s contributions

(vi) Among other deductions, Income tax at the rates as applicable on the gross amount of the
bill shall be recovered from bills payable to the contractor, at source.
(vii)The books of accounts regarding attendance, acquaintance, wage paid, PF account etc.,
shall be maintained by the agency and shall be produced for inspection to the Institute
whenever asked for. The CPRI is at liberty to take suitable action against the agency if above
condition is not complied with.

(viii)The workers employed by the contractor under this job contract shall not become
members of any trade union.

(ix)The contractor shall employ able-bodied person with sound health only.

(x)The agency and their workmen shall scrupulously follow all the security rules and
regulation prevailing in the Institute. They shall also follow the rules as amended from time
to time. Further, the agency shall submit details of personnel deployed by him, under the said
job contract, in CPRI like Name of the person, Date of Birth, Proof of residential addresses,
two sets of passport size photographs, educational qualification etc., to the security in-charge
on the award of work, and also at the change of persons within 10 days. The contractor shall
submit “verification certificate” issued by the police authorities in respect of every personnel
deployed in CPRI. The certificate shall be submitted within seven days of deployment.
Failing which Joint Director will be at liberty to remove such persons.

(xi) The contractor shall arrange medical facilities for his labour through ESI scheme within
10 days from the date of appointment. The contractor shall arrange for carrying out medical
checkup of each contract labour once in a year in the approved laboratories. The cost
towards such medical tests shall be reimbursed by CPRI at CGHS rates as applicable. In case
of Safai Karmcharis, the tests shall be conducted once in 6 months.

(xii) On three National Holidays, viz., Republic Day, Independence Day and Gandhi
Jayanthi, the contractor shall allow all workmen paid- holiday and pay their normal rate of
wages. No extra payment shall be made towards this.

(xiii) Providing shoes and uniforms to the contract labours:


The required sets of uniforms, shoes and socks shall be provided by CPRI free of cost to the
manpower proposed to be employed under contract.

Clause 19H: In partial modification of clause 19H, no site or plot of CPRI shall be made
available to the contractor for erection of huts for contact labour. No contract labour shall be
allowed to stay in CPRI office campus. The contractor shall make his own arrangements for
stay of contract labour outside the CPRI campuses at his own cost.

Clause 21: ‘Individuals holding power of attorney shall not be allowed to operate a contract
awarded to a contractor.’

Clause 25: No dispute redressal committee shall be constituted. All other provisions of the
clause are applicable.

Clause 31A: Water required for execution of works assigned to contract workers shall be
supplied by CPRI free of charges.

Clause 15 of General rules and Directions:


The rates quoted by the contractor shall be exclusive of Service tax. The contractor shall pay
service tax, payable by him against the work to the service tax department/ excise department
and the same shall be reimbursed to him on production of necessary documentary proof to the
effect that it has been genuinely and properly paid .

The contractor or his authorized agent approved by CPRI shall be in attendance in CPRI
premises during all working hours for supervising the work. For any negligence of the
service employed by the contractor or for any loss or damage caused or occasioned by
himself, his agents or workmen in respect of the property of CPRI the contractor shall be
personally responsible and shall make good the loss forthwith

Clause 45: Release of Security Deposit after Labour Clearance: In partial modifications of
clause 45, the following additional provisions are stimulated.

(a). Security Deposit of the work shall not be refunded till the contractor produces clearance
certificate from the labour officer and release / transfer of EPF of all workers. As soon as the
work is virtually complete the contractor shall apply for the clearance certificate to the
Labour Officer under intimation to the Joint Director. The Joint Director, on receipt of the
said communication, shall write to the Labour Officer to intimate if any complaint is pending
against the contractor in respect of the work. If no complaint is pending on record till after 3
months after completion of work and / or no communication is received from the Labour
Officer to this effect till six months after the date of completion, it will be deemed to have
received the clearance certificate and the Security Deposit will be released if otherwise due.
(b). The contractor shall provide every workman / workwoman deployed by him in CPRI
works with an accidental group insurance cover of minimum Rs. 50,000/- which shall be in
force until the completion of the contract and the contractor shall furnish proof of having
covered the workmen with such accidental group insurance before engaging them in CPRI
works. The premium paid against the group insurance for the workman shall be reimbursed
to the contractor on production of proper documentary evidence.
Additional terms, conditions and specifications:

1. Name of Work: Deployment of contract labour of different categories, in required strength


for carrying out various skilled, semi-skilled and unskilled works, relating to horticulture
operations, maintenance of gardens, upkeep of office buildings, laboratories etc., at office
campus and staff colony, at CPRI, Sadashivanagar, Bangalore during the period 2016-17

2. Scope of Work: The contract labour or workers shall be deployed for execution of variety
of manual works relating to horticulture operation, maintenance of greenery and gardens both
in the CPRI office campus and staff colony at Bangalore. They would also be engaged for
carrying out manual works in support of technicians and others for upkeep of CPRI labs. The
contract labour shall be engaged for carrying out works as assigned by Joint Director from
time to time at his sole discretion mainly as follows:

(i) Clean rooms, hallways, lobbies, lounges, restrooms, corridors, elevators, stairways, locker
rooms and other work areas so that health standards are met.
(ii) Clean rugs, carpets, upholstered furniture, and/or draperies, using vacuum cleaners as
directed
(iii) Empty wastebaskets, empty and clean ashtrays, and transport other trash and waste to
disposal areas.
(iv) Sweep, scrub, wax, and/or polish floors, using brooms, mops, and/or powered scrubbing
machines.
(v) Dust and polish furniture and equipment.
(vi) Polish silver accessories and metalwork such as fixtures and fittings if required
(vii) Remove debris from driveways, garages, and swimming pool areas.
(viii) Replenish supplies such as drinking glasses, linens, writing supplies, and bathroom
items, which are available in the stock of CPRI.
(ix) Wash windows, walls, ceilings, and woodwork, waxing and polishing as necessary.
(x) Request repair services and wait for repair workers to arrive.
(xi) Dust window blinds.
(xii) Move and arrange furniture, and turn mattresses.
(xiii) Observe precautions required to protect CPRI property, and report damage, theft, and
found articles to supervisors.
(xiv) Prepare rooms for meetings, and arrange decorations, media equipment, and furniture
for business functions.
(xv) Render all required assistance in segregation of waste at source like wet waste, dry
waste, bio-medical waste etc., and also their collection, transportation and disposal as
directed by Joint Director.
(xvi) All other relevant activities assigned by the Joint Director from time to time.

Note : The frequencies mentioned above are only indicative. The Joint Director has got

The scope of work for horticultural services is:

The total area, for which the maintenance and upkeep is to be carried is as follows.
(a) Lawn, Garden, and Nursery, including edging, shrubs, ground covers, hedges, etc.
= 25,600.00 sqm
(b) Green area with Tree Plantation: = 7,456.00 sqm
(c) Natural Green Area, with natural trees, but undeveloped = 62,256.00 sqm

The nature of work for horticultural work is:

a. Maintenance and up keep of lawns, flower beds, hedges, shrubs, teak & other
plantation and open areas including periodical cutting of grass by lawn mover / grass
chopper, daily removal of dry leaves on lawns, daily watering lawns, flower beds,
manuring, etc., including pick up and removal of all types of scrap materials such as
paper scrap, empty containers, etc., scattered / dumped on the lawns. These scrap
materials are to be collected and dumped in the respective bins regularly so that the
premises is kept tidy.

b. Removal of cut grass, uprooted wild growths, thorny bushes, dried leaves, silt,
mud, grit, rubbish from the lawns and dump them in the designated place for which
adequate labourers are to be employed.

c. Periodical cutting of grass means minimum one cutting in a month to see that the
wild growth of grass is completely removed in particular area. The Contractor shall
arrange for further cutting of wild growth, within a month, if required, as directed by
the Joint Director for this purpose.

d. Development of Landscape, Flower beds and nursery at the specified places as per
the direction of the Joint Director.

e. Periodical trimming and pruning of trees, as and when required and as directed by
the Joint Director for this purpose.

f. Removal of wild growths in plantation area and de-weeding in the undeveloped


natural green area within the campus.

g. Removal of bee-hive from located in various places like buildings / trees and
overhead tanks and at other such locations as directed by Joint Director, at all heights.
The work shall be carried out by the authorized personnel from the pest control
agency.

3. These Additional Terms, Conditions and specifications shall be read in conjunction with
Standard CPWD contract Form GCC 2014, CPWD Form 7/ 8.

4. Contractors are advised to inspect and examine the site and its surroundings and satisfy
themselves before submitting their tenders as to the condition of the and nature of the site, the
means of access to the site, and in general shall themselves obtain all necessary information
as to the risks, contingencies and other circumstances which may influence or affect their
tender. A shall be deemed to have full knowledge of the site, whether he inspects it or not and
no extra charges consequent on any misunderstanding or otherwise shall be allowed. The
tenderer shall be responsible for arranging and maintaining at his own cost, water, facilities
for workers and all other services required for executing the work, unless otherwise
specifically provided for in the quotation document. Submission of a tender by a tenderer
implies that he has read this notice and all other quotation document and has made himself
aware of the scope and specifications of the work to be done and of the conditions and the
preparatory work to be done on the surfaces to be painted to receive paint described in the
items of work.

5. The contractor shall follow CPRI security regulations that are in force from time to time.

6. Maximum allowable extension with late fee @ 0.1% per day of Performance Guarantee
amount beyond the period provided or stipulated.

7. No site or plot in the CPRI campuses shall be made available to the contract for erection
huts for contract labour. The contractor has to make his own arrangements of his own at his
own cost for the stay of contract labour outside CPRI campuses.

8. The job description for the supervisors shall be as follows:


(i) Create a schedule of housekeeping staff
(ii) Make sure that appearance of office is clean and tidy
(iii) Maintain constant awareness of cleanliness
(iv) Hand out housekeeping duties on daily basis
(v) Ensure that safety precautions are being taken in the account while mixing chemicals
(vi) Make sure that all cleaning supplies are appropriately labeled
(vii) Oversee housekeeping staff to ensure that they are properly and safely attired

9. CPRI is implementing Environmental and Occupational Health and Safety Management


Systems (EMS and OH&S MS) 18001:2007 for environment, health and safety. The cleaning
and horticultural works to be carried out as per International norms/standards and in such a
manner that policy laid by CPRI in this regard shall be complied with.

10. The contractor shall ensure that none of the labour shall be less than 18 years of age.

11. The contractor shall strictly comply with the provisions of “THE PROHIBITION OF
EMPLOYMENT AS MANUAL SCAVENGERS AND THEIR REHABILITATION ACT,
2013”. In regard of which, the agency shall not be allowed to engage/employ any person for
hazardous cleaning of sewers or septic tanks. Such works shall strictly be carried out using
mechanized equipment only. The charges towards mechanized cleaning shall be reimbursed
at actuals.

12. Compliance with the scheme of Government of India for providing Pre-Matric
Scholarship to children of those engaged in unclean occupations viz., (i) scavengers & (ii)
Sweepers, shall be complied by the agency by helping such persons to obtain such
scholarships from the State Government. Proof of such scholarships, along with a statement
of persons engaged in the contract, who benefitted from such scholarships, shall be submitted
to the Joint Director at the end of each financial year

13. The agency shall comply with the rules and regulations under relevant acts for
appointment on compassionate grounds, in case of death of any worker employed under the
contract, and shall submit a statement of compliance annually to the Joint Director.
14. A lumpsum incentive of Rs. 25.00 per day shall be paid to those engaged in unclean
occupations viz., (i) scavengers & (ii) Sweepers, under the said contract. The daily log sheet
of person engaged in such activity, authenticated by Joint Director or any official authorized
by him shall be submitted monthly, for reimbursement by CPRI. The said incentive of Rs.
25.00 per day is exclusive of agency service charges and service tax component, but inclusive
of ESI component.

15. The Joint Director, CPRI, Bangalore shall be the Principal employer
