INTRODUCTION

Article 14 in The Constitution Of India 1949.1


Equality before law The State shall not deny to any person equality before the law or the equal
protection of the laws within the territory of India Prohibition of discrimination on grounds of religion,
race, caste, sex or place of birth.

Article 14 consolidate the idea of equality expressed in preamble. Article 14 of the constitution
guarantee the right to equality to every citizen. Its include the general principle of equality before law
and forbid unreasonable discrimination between person.

"Equality is a dynamic concept with many aspects and dimensions and it cannot be ‘cribbed, cabined and
confined’ within the traditional and doctrinaire limits. From the positivistic point of view, equality is
antithetic to arbitrariness. In fact, equality and arbitrariness are sworn enemies… Where an act is arbitrary, it
is implicit that it is unequal both according to political logic and constitutional law and is therefore violative
of Article 14.

OBJECTIVES OF THE STUDY


The researcher intends to find out the following during the course of research:

A. The Objective of this research is to find out the concept Article 14.
B. The aim of the project is to present a detailed study of the “Right to equality ”.

C. The Objective of this research is to study Equality before law.

D. The Objective of this research is to find out “the Equal protection of law.”

HYPOTHESIS
The right to Equality is a fundamental Right which allow certain reasonable discrimination.

RESEARCH METHODOLOGY
The researcher will do doctrinal type of research in which he will go through the primary as well secondary
sources. The researcher through this methodology will be able to get an adjust picture of the problem in
question. The doctrinal method helps in doing a comparative study of the topic. This methodology helps in
going through not only the work of one eminent person but of many other too. This helps in getting the
bird’s eye view of the subject.

SOURCE OF DATA
Primary source include The Constitution of India.

Secondary sources include Books, Articles, Websites etc.

LIMITATION OF THE STUDY:


Since the researcher is a student of law, he has access to a limited area. The researcher having read the

commentary on the government policies could understand the problem clearly, but it would have been
clearer if he would have read commentary of more writers. The researcher has limited time for the project.
The historical need and background are also necessary for having a bird’s eye view of the particular topic
and it gets developed only by effective and extended reading over a long period of time. But the required
materials are not available in our library. The researcher has a restricted access to the reports of the
government commission and government websites where the reasons of their work was not available. But
still researcher with his hard work will manage to take out the best possible work.
SCOPE OF THE STUDY
The project entitled “ARTICLE 14 PROHIBITIONS CLASS LEGISLATION” has been done at Patna as a
completion part of the degree B.B.A.,LL. B. (hons.) during the session 2018-23 program.
