Question : please explain the hierarchy of laws and regulations based on the law
Answer : Regarding to the regulation concerning of Hierarchy of law in Indonesia, I found 2 law
which directed connect with explanation the Hierarcy of law, namely :
1. Act number 12/2011
2. Act number 15/2019
For the hierarchy, It’s explained to the article 7 of act number 12/2011, namely:
1. The 1945 Constitution of the Republic of Indonesia
2. The Decision of the People's Consultative Assembly
3. Acts /PERPU
4. Government Regulations
5. Presidential Regulation
6. Provincial Regulations
7. District / City Regional Regulations
*Power of those law depend on the its hierarchy (from the top to bottom).
Another regulation that are recognize as legal and binding regulation as stated in article 8 act
number 12/2011 namely :
1. People's Consultative Assembly
2. House of Representatives
3. Regional Representative Council
4. Supreme Court
5. Constitutional Court
6. Audit Board of the Republic of Indonesia
7. Judicial Commission
8. Indonesia Bank
9. Minister
10. Agencies, institutions, or commissions at the same level as established by law (“UU”) or
the government at the behest of the law
11. Provincial and regency / city Regional People's Representative Council
12. Governor, regent / mayor, village head or the like.
For definition of each law in that hierarchys, it’s clear on the article 1 act number 12/2011 junto
act number 15/ 2019
1. Acts are Legislative Regulations established by the House of Representatives with the
joint approval of the President.
2. PERPU is Legislations that are stipulated by the President in matters of emergency that
are sent.
3. Government Regulations are statutory regulations stipulated by the President to carry out
laws properly.
4. Presidential Regulation is the Legislation which is stipulated by the President to carry out
the higher order of Legislation or in exercising governmental power.
5. Provincial Regulations are Legislative Regulations established by the Provincial Regional
People's Representative Council with the joint approval of the Governor.
6. Regency / City Regional Regulations are Legislative Regulations established by the
Regency / City Regional People's Representative Council with the joint approval of the
Regent / Mayor.
