INSIGHT PAPER on “HOW TO INTERVIEW A CLIENT”

Clients from all walks of life open up to lawyers for issues that aggrieved them or
for the rights that were deprived of them by the opposing parties. And when a lawyer
interviews a client who is physically relaxed, comfortable and feels safe enough to
uncover the emotions that underlie their behaviour concerning the facts and
circumstances of the case, they are inevitably more likely to participate openly and
honestly, in line with the participatory approach to interviewing.

Interviewing with clients is all about asking the relevant questions to gather
necessary information concerning the complaint. There are can be loads of ways when
interviewing a client. But if a lawyer wants extremely deep insight into their clients,
engaging in meaningful small talks to put them at ease in situations that may be rather
uncomfortable would be helpful. This technique allows a lawyer to build trust with their
clients and get deeper and more relevant insights that can be utilized to identify the
victims, culprit, witnesses, when and how the incident happened, shreds of evidence,
remedies, and probable penalties once judgment will be reached by the tribunal.

Working efficiently and effectively with clients, an attorney must be equipped not
only with knowledge of the law and its application, but he must as well possess a
proficient understanding of how people think, make conclusions and good people skills.
Law schools may likewise consider incorporating lessons related to human behaviour
and the importance of psychological insights to attorneys. While good lawyers ultimately
pick up this information through experience, there is no reason to leave young lawyers
at bay. Hence, constant training and guidance to new lawyers would be crucial to help
them in understanding their roles not only as legal advisors but also as counsellors.
