MTC
a. MTC (Municipal Trial Courts) – can be
found in municipalities.
b. MTCC (Municipal Trial Courts in
Cities) – can be found in Cities.
c. MeTC (Metropolitan Trial Courts) – can
be found in Manila (imperial Manila)
d. MCTC (Municipal Circuit Trial Courts)
– are courts with wheels, the judges go
around certain Municipalities. They will
hold session in a certain municipality on
this day. Although they have buildings
there, the court is not permanent.
So when you read BP 129, bakit iba-iba ang
pangalan, kasi iba-iba din ang kanilang
jurisdiction.
So when you talk about SC, their jurisdiction is
Nationwide, they covers the whole country.
The jurisdiction of:
a. CTA – nationwide (trier of facts)
b. Sandiganbayan – nationwide (trier of
facts)
c. CA – nationwide but there is an element
of territorial jurisdiction. Divided into
NCR (Manila), Visayas (Cebu) and
Mindanao (CDO), jurisdiction therefore
although nationwide, now it depends on
its territorial aspect. All cases in Luzon
including Palawan go to NCR, all cases
in Visayas go to Cebu, and all cases in
Mindanao go to Cagayan de Oro.
d. RTC – regional, if you look we have 13
judicial regions. Do not mix the political
region and the judicial region. Basically
the RTC is by judicial region, the
authority to act depends on the branch.
Jurisdiction of MTC
I. Original Jurisdiction – civil actions and
probate the value of which does not exceed
or less than 300k or 400k in metro manila.
a. Civil Actions – ordinary civil
actions, special civil actions
b. Probate – settlement of the
estate of persons who are dead.
Civil Procedure – based on the lectures of Judge Ronald Tolentino (Dec. 14, 2018)
1. Actions and admiralty, land and
maritime – less than 300k and 400k in
metro manila
c. These are actions in collision of
ships, salvage operations
2. Forcible entry and unlawful detainer –
these are actions involving usually
tenants and lessees. The issue here is
possession not ownership. Notice there
is no amount, so that means all cases
involving forcible entry and unlawful
detainer are under the MTC.
3. Actions involving title to or possession
of real property of less than 20k or 50k
in metro manila.
II. Delegated Jurisdiction
a. Cadastral cases are cases that involve
land or its registration where the value
does not exceed 100k.
III. Special Jurisdiction
a. Habeas corpus cases where there is no
RTC or in the absence of RTC
IV. Cases involving summary procedure:
a. Involves forcible entry and unlawful
detainer
b. And other cases which does not exceed
10k.
c. Recently small claims, ano itong small
claims? But this is a hybrid? These are
cases which do not involve lawyers and
these are sum of money, ano yong sum
of money? Nangungulekta ka ng pera,
sum of money not more than 100k. But
technically its odd because of the 300k
difference, but it does not involve
lawyers, iba yong procedure nila. In
small claims, you go there, you fill up
the form and notice will be sent to the
other person, they will have a
conference before the judge and the
judge will try reconciling them and
settling and submitting for decision and
technically within 24 hours there is a
decision.

Jurisdiction of RTC
I. Original Jurisdiction
Pagdating sa original, sympre tingnan
nating ang amount, so the first is:
a. These are cases incapable of
pecuniary estimation – ano yon?
Hindi alam magkano ang value,
like what? Expropriations,
annulment, support, recission,
annulment of contract. Pag
walang amount kaagad
incapable of pecuniary
estimations, RTC.
b. Title and possession of real
property but more than 300k or
400k in metro manila.
c. Civil actions and probate
wherein the value is more than
300k and 400k in metro manila.
d. Admiralty and maritime value is
more than 300k and 400k in
metro manila.
e. Not within the jurisdiction of
any court. Pag maykaso kayo
and hindi nyo alam ang
jurisdiction you go to RTC. Pag
wala dito – RTC, pag wala sa
CA – RTC, pag wala sa SC –
RTC
f. Marriage and marital relations
g. And all other civil actions
exceeding 300k and 400k in
metro manila, and title and
possession of real property more
than 20k and 50k in metro
manila.
h. Arbitral agreements/awards, you
know what is arbitral awards?
These are the decisions of the
arbiter in arbitration.
i. Just compensation.
Did you observe anything with respect to the
original jurisdiction of the RTC? People, title or
possession of more than 20k or 50k in metro
manila, tell me is there any property less than
20k? No? So what does it tell you? The truth of
the matter is, it is impossible, so most cases fall

within the RTC because the value is outdated.
This is also in cases for civil actions and
probate.
II. Appellate Jurisdiction
a. All appealed cases from the MTC
both criminal and civil.
III. Original concurrent with the SC
a. Cases involving ambassadors, consuls
and other public ministers.
IV. Original concurrent with the SC and CA
a. Certiorari, prohibition, mandamus,
quo warranto and habeas corpus and
injunction within the judicial region.
b. Continuing mandamus in environment
cases.
V. Original concurrent with SC, CA and
Sandiganbayan
a. Writ of amparo
b. Habeas data
VI. Original concurrent with the Insurance
commission.
a. Claims not exceeding 100k
So those are the jurisdiction of RTC, marami
kasi the amounts are outdated.
Now sa CA, madali lang, bakit? Kasi sa CA,
yung original, concurrent practically like this.
Ang original lang nila is actions for annulment
of judgment of the RTC on the grounds wherein
the party was not able to participate in that case
because of extrinsic fraud and lack of
jurisdiction.
