INQUIRY REPORT REGARDING FIGHTING OF SECURITY SUPERVISORS

(Mr. ARSHAD MEHMOOD & MR. MUMTAZ KHAN)

Formulation of Inquiry Committee:

In response to reply against show cause notice (SCN) # SIAL/12/17/HR dated 1 st February 2019 of
Mr. Mumtaz Khan (Security Supervisor) & Mr. Arshad Mehmood (Security Supervisor) The Competent
Authority (CEO) has formulated an Inquiry Committee comprising “Company Secretary” and “Manager
HR”. Inquiry Committee was asked to conduct an inquiry in the subject matter.

Charge on Security Supervisors:

A serious complaint has been received that on 19th January 2019 both Security Supervisors fought with
each other. Security Supervisor (Mr. Mumtaz Khan) hit the Security Supervisor (Mr. Arshad Mehmood)
with a wooden stick and as a result Mr. Arshad Mehmood receive a scare mark on his arm.

Inquiry Proceedings:

SCN (Annex-I & II) was served to both Security Supervisors (Mr. Mumtaz Khan & Mr. Arshad Mehmood)
on 1st February 2019 which was responded on 4 th February 2019. To meet the end of Justice, both were
given opportunity of being heard and, inquiry notices were served to both on 7 th February 2019 (Annex-III
& IV). Both were directed to appear before the Inquiry Committee on 9 th February 2019 at 10:00 am in the
SIAL Conference Room. Due to short leave of one of the inquiry committee member, inquiry proceeding
was adjourned till Monday dated 11 th February 2019. Accordingly both attended (at 2:30 pm) the inquiry
proceedings and their statements were recorded on oath in the following manner - (Annex-V & VI).

WRITTEN STATEMENT ON OATH BY MUMTAZ KHAN (SECURITY SUPERVISOR)

I, Mumtaz Khan son of Kala Khan, working as Security Supervisor (SIAL) do hereby solemnly declare and
affirm on oath that under mentioned written statement is being recorded with free will and without any
pressure.

Q: When you joined SIAL? How many years you served SIAL?

Ans: Almost 02 years

Q: Do you know the policy & procedure for Office Decorum?

Ans: Yes! I know the company policy & procedures very well.

Q: To whom do you report? What is your area of responsibility/deployment? And how much time you spend in your
present deployment/area of responsibility?

Ans: I am reporting to SVO. I am overall Incharge being declared with the permission of Ex-CEO and responsible for
overall area i.e cargo, Apron, SIAL Secretariat etc.

Q: During your fight was there any third person. Did he intervene and tried to resolve the issue?

Ans: Mr. Anar was present at the place. He was in civil uniform because his duty completed at 7:00 am. Mr. Arshad
came on duty at 7:00 am. I think Mr. Anar hit me with a stick because I report to SVO that he always take a sleep
during night duty. May be due this reason, Mr. Anar hit me.

Q: Did you share this issue with your HOD?

Ans: I call to my SVO and inform about the incident. Furthermore, I informed to SVO that I will go to Police Station
for complaint to which SVO advised me not to do this.

Q: In your reply you totally held responsible to Mr. Arshad Mehmood. You imposed irrelevant blame which are out
of context to this incident. Furthermore, you impose unethical blame on Muhammad Anar, Security Supervisor.
What you say about this?

Ans: Sir, Anar (Security Supervisor) hit me with a stick so that’s why I highlighted his unethical activities. Mr. Anar
hit me with a stick and I save myself. Resultantly, stick hit to Mr. Arshad. Furthermore, Mr. Arshad punch my belly
2-3 times. I also went to SIAL Doctor (Dr. Khurram Shahzad) for checkup who advised some medication.

Q: Any other point you want to ask or want to say about this.

Ans: Sir, both Security Supervisors are involved in wrong activities i.e spend night duty while taking sleep, claim
wrong overtime, don’t perform their duty with honesty etc. Both of them must be punished.

I, Arshad Mehmood son of Khuda Baksh, working as Security Supervisor (SIAL) do hereby solemnly
declare and affirm on oath that under mentioned written statement is being recorded with free will and
without any pressure.

Q: When you joined SIAL? How many years you served SIAL?

Ans: Almost 02 years. I retired from Army as SSG from 22 Baloch Regiment.

Q: Do you know the policy & procedure for Office Decorum?

Ans: Yes! I know the policies & procedures as well as Office Decorum. I know how to deal with Seniors & Juniors.

Q: To whom do you report? What is your area of responsibility/deployment? And how much time you spend in your
present deployment/area of responsibility?

Ans: I report to SVO. I am deputed in Cargo since 03 months. Before this I was deployed at Apron. Furthermore,
Mumtaz Khan is declared our Senior by The Management who give instructions regarding duty.

Q: During your fight was there any third person. Did he intervene and tried to resolve the issue?

Ans: Mr. Anar (Security Supervisor) was present at the place. He was shocked by seeing this incident. He didn’t say
anything just watch both of us.

Q: Did you share this issue with your HOD?

Ans:.Yes! I inform to SVO on phone as he was in a marriage function. At that time SVO said that if Mumtaz Khan
apologize on his attitude then will you accept it. I replied that Sir you are our Senior I am agree. But next day SVO
tells me that Mumtaz Khan is not agreed for apology.

Q: In your reply you totally held responsible to Mr. Mumtaz Khan but didn’t inform about the reason that why Mr.
Mumtaz Khan hit you with a stick. What you say about this?

Ans: He hit me because I sit on his chair. Furthermore, he deployed Mr. Ashraf (SG) as his Assistant who help him
for preparing duty rosters of Guards deputed at Admin Block & Apron.

Q: Any other point you want to ask or want to say about this.

Ans: I requested Management to advise Mr. Mumtaz Khan to avoid criticizing anyone in SIAL. He always criticize
employees and he shouldn’t abuse anyone. According to him everyone is corrupt and unfaithful with Organization.

Statement of Mr. Anar (Security Supervisor)

Mr. Anar was also called and appeared before the inquiry committee on 12/2/2019. He recorded his
statement as under.

“On 19th January 2019 I switched-off my duty at 7:00 am and Mr. Arshad came on duty at 7:00 am. We
both sit in Cargo Office in the meantime Mr. Mumtaz Khan appeared and start shouted on Mr. Arshad with
the plea that why He is sitting on his chair. Mr. Arshad reply that you may sit on another chair. Suddenly
Mr. Mumtaz Khan picked up a stick and start hitting Mr. Arshad but Mr. Arshad didn’t say anything just
ask him that this is not fair. After 3-4 minutes Mr. Mumtaz Khan wear his uniform and left the place for
Main SIAL Gate. On 21 st January 2019, SVO and Mumtaz Khan came in the office of CTM. They called
me to which I briefed about the whole story. I also inform them that Mr. Mumtaz Khan is personalized with
me within 5-6 months just after my joining because he left early but forgot to mark his attendance.
Accordingly he ask me to fill up his overtime form but I refused.

Furthermore, he impose unethical blame regarding Mr. Imran (Loader) which is totally wrong. Mr. Mumtaz
Khan is blaming because he has nothing to say in his defense”.

Statement of Mr. Imran Zia (Traffic Loader P. Code 917)

Mr. Imran Zia (Traffic Loader) was also called and appeared before the inquiry committee on 13/2/2019.
He recorded his statement as under.

“Mr. Mumtaz Khan, Security Supervisor imposed an unethical blame which is totally wrong. He must
provide witness to this blame because I am very mush upset by hearing this. Actually I have done
Dispenser Course and Mr. Mumtaz Khan asked me to arrange tablets for him to enhance his sexual power.
I refused and from that day he is against me. He is also passing unethical remarks and call me with bad
words. Furthermore, he didn’t help me to prepare my Social Security Card because I refused his above
demand. I request the Management to advise Mr. Mumtaz Khan to avoid passing unethical remarks and
stop cribbing every time and amend his behavior”.

Statement of Dr. Khurram Shahzad (Manager Medical Services)

“Dr. Khurram Shahzad (Manager Medical Services) was also called to know about the medication of
Mr. Mumtaz Khan because he claimed that Mr. Arshad punched his belly 3-4 times and as a result he feel
swear pain. Dr. Khurram Shahzad verify his treatment as well as marks of punches on his belly.
Accordingly it is proved that Mr. Arshad also punch him badly”.

Findings of Inquiry Committee

After having recorded the written statement on oath, assessment of available documents and Q/A
sessions with both Security Supervisors, the facts of case are framed as under –

 Both Security Supervisor has completed their almost 02 years of service with SIAL and are very
well aware about the policies & procedures.
 Mr. Mumtaz Khan (Security Supervisor) declared senior (verbal instructions) within Vigilance
Department to lead the department. Accordingly Mr. Arshad (Security Supervisor) & Mr. Anar
(Security Supervisor) admit that Mr. Mumtaz Khan is their senior.
 It is clear that Mr. Mumtaz Khan hit Mr. Arshad with a stick very badly. In this regard he produce
bogus story but has no solid justifications/reasons.
 It is found that in response, Mr. Arshad punched him (Mr. Mumtaz).
 It is found that Mr. Mumtaz Khan has loose temperament and it is also evident during inquiry
process.
 During inquiry it is came to know that local Security Guards being accommodated by setting their
duties in Night Shift so that they may do their home assignments in day time and take rest in Night
Shift.

RECOMMENDATIONS –

Keeping in view the Chapter – V (Efficiency & Discipline Regulations) of SIAL Service Rules, following
recommendations are as under:

 Mr. Mumtaz Khan (Security Supervisor) found guilty of misconduct so as per clause 5.03,
below recommended penalty may be imposed unless the accused has been given an
opportunity of being heard.
 As per clause 5.04 (d) following penalties are being recommended as a whole OR anyone as
under:
o Censure / warning letter
o With-holding, for a specific period, not exceeding Two years, increment or
promotion otherwise than for unfitness for promotion.
 Mr. Mumtaz Khan may be remove from duties as “Team Lead” of Vigilance Department. He
may be treated equally to other two Security Supervisors (He is also in same pay scale) by
taken-off his one star.
 All the Three Security Supervisor should be given independent duty by rotated them in
shifts and every Supervisor will be responsible for his shift.
 As they get personalized with each other since long so SVO should address this issue in the
beginning.
 Duty Roster of Vigilance Department should be balance i.e every Guard should be rotated
in shift and duty timing be changed after every week.
