Tutorial Problem 2 (Week 2)

Question

Anna is a first-year law student at ANU. She went out to a local club in Canberra one Thursday
night. There she met Jedd, also a first-year law student. Jedd was quite drunk. He put his arm
around Anna. She was uncomfortable and immediately moved away from Jedd.

Half an hour later, Anna overheard Jedd making unkind comments about her to a group of his
friends. She was outraged and decided to get back at Jedd.

Anna had some laxatives in her bag. She puts several of these laxatives into Jedd’s drink,
which is sitting on the bar. About 10 minutes later Jedd finished the drink, and within an hour
was unable to get off the toilet. He does not suffer any long-term physical effects from
ingesting the laxatives.

Anna later confessed to Jedd what she did. He was furious and said to Anna in what she
describes as a menacing tone, ‘I’ll get you next time.’

Discuss any possible actions in trespass to the person arising from this scenario.
