ORDER:-

Whereas Sri B. Eswara Rao, Assistant Director, District Survey and Land records,
Kakinada, East Godavari was trapped by the Anti-Corruption Bureau officials on
09.05.2005, while accepting bribe of Rs.4000/- from the complainant for doing an
official favour, i.e., to provide rough village maps. In the reference 1st read above,
the Director General, Anti-Corruption Bureau, has furnished final report and
recommended to prosecute the Accused Officer in a court of law. In the reference 2nd
read above, sanction was accorded to prosecute Sri B. Eswara Rao, Assistant Director,
District Survey and Land Records, Kakinada, East Godavari in a court of law.

2. And whereas, in the reference 3rd read above, the Director General, Anti
Corruption Bureau has informed that the Special Judge for SPE & ACB Cases,
Rajamahendravaram delivered the Judgment on 10.06.2019 in CC No.29/2018
convicting Accused Officer Sri B. Eswara Rao, Assistant Director, District Survey and
Land records, Kakinada, East Godavari. The Director General, Anti-Corruption Bureau
has therefore requested to impose punishment against Accused Officer equivalent to
dismissal from service as he retired from service.
3. And whereas, on consideration of facts and circumstances of the case with
reference to the instructions issued in G.O Ms.No.2, G.A(Ser-C) Dept., dt:04-01-1999
read with instructions issued in Memo.No.178/Spl.C/2003-1, General Administration
(Special.C) Department, Dated 07.05.2003, Government have decided to impose the
penalty of withholding of 100 % pension and gratuity in full permanently against Sri B.
Eswara Rao, Assistant Director(Retired), District Survey and Land records, Kakinada,
East Godavari District, with immediate effect for his conviction in the criminal case.
4. Now, therefore, in exercise of the powers conferred under Sub-rule (2) of Rule
8 and Sub-rule (1) of Rule 9 of Andhra Pradesh Revised Pension Rules, 1980 read with
instructions issued in G.O.Ms.No.2, G.A(Ser-C) Dept., dt:04-01-1999 and
Memo.No.178/Spl.C/2003-1, G.A.(Special.C) Department, Dated:07.05.2003,
Government hereby impose the penalty of withholding of 100 % pension and gratuity
in full permanently against Sri B. Eswara Rao, Assistant Director (Retired), District
Survey and Land records, Kakinada, East Godavari District, with immediate effect.
5. The Chief Commissioner of Land Administration, & Special Chief Secretary,
Andhra Pradesh, Vijayawada / Director, Survey Settlement and Land Records and the
Collector & District Magistrate, East Godavari shall take necessary further action
accordingly and furnish the compliance report, to the Government, immediately.
6. The following Notification shall be published in the extraordinary issue of the
Andhra Pradesh Gazette.

In exercise of the powers conferred under Sub-rule (2) of Rule 8 and Sub rule
(1) of Rule 9 of Andhra Pradesh Revised Pension Rules, 1980 read with instructions
issued in G.O.Ms.No.2, G.A(Ser-C) Dept., dt:04-01-1999 and
Memo.No.178/Spl.C/2003-1, G.A.(Special.C) Department, Dated: 07.05.2003, the
Government of Andhra Pradesh hereby impose the penalty of withholding of 100 %
pension and gratuity in full permanently against Sri B. Eswara Rao, Assistant Director
(Retired), District Survey and Land records, Kakinada, East Godavari District, with
immediate effect.
