(Rev. 1/2010), identify the documents that contractor should submit to the government if the
contractor has involved in direct loss and expenses. (CLO1, C3)

3. By referring to Standard Form of Contract P.W.D. Form 203 (Rev. 1/2010) and Figure 1, explain the
term of Date of Commencement. (CLOI' C3)

Date of CommencemenVDate of Possession is where the contractors have the right to enter the site,
occupy and use the site and carry out the specified u'orks'

Duration of possession is stafts from the date for possession of site to completion date and inclusive
of extended time if the contractor is granted extension of time'

Refer to clause 38.2 employer is obligated to give possession of site to allow contractor to
cany out his work. Usually the date of submission of the construction site is 2 weeks after

the contractor to provide necessary preparations before starting work on site i.e. per ance

bond, insurances

If contractor fails toc mence work within two (2) rveeks after date of site possession,
Government shall gir,e tten Notice of Termination Conffactor lvill be gir.'en under
provision Clause 51.1 (a) (i).

4. By referring to Clause 48: Defects After Completion, Standard Form of Contract P.W.D. Form 203
(Rev. l/2010):
i. Explain the meaning of Defect Liability Period (CLOI, C3)
(2 marks)

Under provision Clause 48 DLP is a period where Contractor shall make good the
defects at his own costs against any defect, imperfection, shrinkage or any other faults
which may appear and which are due to materials or goods or workmanships not in
accordance with this contract.

DLP is stated in the Appendix (if not stated is six (6) months after Date of Practical
Completion). Common practice is 12 - 18 months unless some other period speoifiod in
the Appendix.

ll Determine the action that will be taken by S.O. due to any defects or imperfection occws
during the Defect Liability Period. (CLOI, C3)
(5 marls)

o S.O. shall specifu in Schedule of Defects and deliver to Contractor not less than 14
days after the expiration of DLP. Contractor shall make a good not later than three
(3) months after the receipt of the said Schedule.
o If the Contractor failed to comply with the Clause 48.1 (a) and/or 48.1 (b) S.O. may

departmentally or employ others to make good the defects and deduct ftom:
- Remaining sum to be paid to the Contractor

o When Contractor has made good all defects, S.O. shall issue "Certifrcate of
Completion of Making Good Defects" on the date.

i. The Govemment shall keep indemnified bythe contractor against all penalties and liability of
every kind of breach of any such statutory Requirements. (clol, c3)

SECTION 2 (PLO8, CLO3, A3)

INSTRUCTION:
Answer ALL questions.

QUESTTON I
By referring to Clause 28: Palanent to Contractor and Interim Certificates, Standard Form of Contract
P.W.D. Form 203 (Rev. 1/20i0) within fourteen (14) days from the date any such valuation being made
and subject to the provision mentioned in Clause 28.1, the S.O. shall issue an Interim Certificate stating the

amount due to the Contractor from the Govenrment.

In the process of preparing interim palnnents to the contractors, there are a few things that need to be
accounted for payment and deduction from the nett value of work done. Based on data given in Table 1

and Table 2,prepare evaluation estimates for Interim Payment No. 3:
