Application for Bail under Sec. 167(2) (a) (ii)


of the Criminal Procedure Code.

This application on behalf of the applicant / accused
respectfully submits as under: -

1. That upon the complaint of complainant Police Constable

________, the accused has been arrested on 05.03.2021 at

about 17.40 by _____________ Police Station under C.R. No.

56 / 2021 for the offence u/s 8 (c), 20(c), 29 of N.D.P.D Act.

The accused have been produced before this Hon’ble J.M.F.C

Court - __________ on 06.03.2021 and were remanded to

police custody till 16.03.2021 and thereafter remanded to Jail

custody. Now applicants are in _________ Jail.

2. The brief story of the prosecution as alleged that, On dated

04.03.2021 at around 19.:10 person name

__________________ came at ____________ Stadium,

__________, to sell the Mephedrone (MD) weighing 34

grams, the complainant came to about the accused through

reliable source and has been arrested the accused is in

contact with the co- accused and along with his associates

conspire to sell Mephedrone (MD). Hence the FIR came to

registered.

3. The applicant / accused submit that, the alleged offence is

punishable for 10 years imprisonment and triable by sessions

Court. However the Investigation Officer of Thane Nagar

Police has not filed charge sheet within 60 days from the first

remand i.e. 06.03.2021 to 04/05/2021.

4. On this background the applicant/accused preferred this


application for bail. There is no any other application is filed of
pending before any court of law for bail u/s 167 (2) of Cr. P. C.
5. The applicant is ready to abide any term and condition as the
Hon’ble court impose while granting bail.
6. In view of the facts of the case and as per provisions of law
the applicant is entitled of suitable order of bail before this
Hon’ble court.
7. It is therefore, prayed that the applicant/accused be released
on bail in the interest of justice.
And for this act of kindness the applicant/accused shall
duty bound forever pray.
