WHEREAS I am the absolute and lawful owner, well seized and


possessed of well and sufficiently entitled to deal with and dispose off all
that piece and parcel of a commercial premises bearing Shop No.24, at
Ground floor, around 105 sq.ft., in the building popularly known as
FATIMA APARTMENT, block no.168, Room No.84, Vasuli Karyala :
Mumbra, Standing on the land bearing Survey No.82, Hissa No.1, and
Survey No. 126/B, lying being and situated at Village : within the limits of
Thane Municipal Corporation, in the Registration District and sub-
registration District of Thane, which hereinafter referred to as the “SAID
PREMISES” and more particularly described in the schedule written here
under written;

AND WHEREAS by virtue of Sale Deed dated 18.05.2017 I have sold


the said premises to MR.ZAID HAROON MODI, Age: 20 Years, Indian
Inhabitant, R/at :Nabeel Complex, B-Wing, Room No.104, Building No.1,
Dadi Colony, Amrut Nagar, Mumbra, Dist.Thane : 400612, at and for lump
sum consideration and terms and conditions set out thereunder written;

AND WHEREAS the Said Premises is still stands in my name and hence
my presence may require in various matters relating to transfer the same in
the name of said Purchaser and due to my preoccupation I am unable to
attend all the concerned authorities and hence, I have decided to appoint,
nominate and constitute the Said PURCHASER MR.ZAID HAROON
MODI, Age: 20 Years, Indian Inhabitant, R/at :Nabeel Complex, B-Wing,
Room No.104, Building No.1, Dadi Colony, Amrut Nagar, Mumbra,
Dist.Thane : 400612, with all the general and incidental powers relating to
the Said Premises by executing this Power of Attorney so as to facilitate him
and deal with all the concerned Authorities, independently with all the
general and incidental powers to be exercised in my place relating to the
Said Premises, hence this Power of Attorney;

NOW THEREFORE KNOW ALL MEN BY THESE PRESENTS THAT,


I, the said MR. FARHAN ABDUL MAJEED FAKHI, Age : adult, residing
at – Room No.19, Noorani Apartment, Near Alishan Cinema, Mumbra,
Thane - 400 612, DO HEREBY appoint, nominate and constitute Said
Purchaser MR.ZAID HAROON MODI, Age: 20 Years, Indian Inhabitant,
R/at :Nabeel Complex, B-Wing, Room No.104, Building No.1, Dadi Colony,
Amrut Nagar, Mumbra, Dist.Thane : 400612, as my true and lawful attorney
in respect of the Said Premises and to do and execute all the following acts,
things and deeds i.e. to say :-

1. TO LOOK after and take care and manage the affairs of the Said
Premises.

2. TO MAKE the payment of monthly outgoing of the Said Premises


to Concerned Society, the Thane Municipal Corporation, / Local
Authority or any other authority and to take receipt in respect of the
Same.

3. TO DEAL AND CORRESPOND with the office of Concerned


Society, Thane Municipal Corporation, Divisional Office, office
of TMC Prabhag Samiti, Office of M.S.E.D.C.L. and/or other
Govt. & Semi Govt. Authorities, concerned authorities etc. for the
purpose of Transfer of Tax Receipt, Water connection, Electricity
Meter in respect of the Said Premises, in his own name, and for that
purpose sign, execute and submit all the relevant documents, forms,
applications, affidavits, Indemnity Bond, Undertaking, Declaration,
etc.. in my name and on my behalf.

4. TO ISSUE the notices, requisitions and make correspondence etc. in


respect of Said Premises.

5. TO ACCEPT letters, money orders, notices or services of writ of


summons or other legal process that may be served upon me and to
appear and represent me in any court of Justice, Tribunal Offices and

before all the Magistrates, or Judicial or Revenue or tenancy,


competent authorities or other offices whatsoever my attorney may
think, advisable in respect of the Said Premises, if necessary.

6. TO APPEAR on behalf of me and represent me and to lodge, file take


out in any court or courts any suit, dispute case or any proceedings
and to declare affirm verify the plaints, written statements,
applications, disputes, petitions, affidavits and other necessary
documents in such court or Courts and file the same therein, in respect
of Said Premises.

7. TO APPOINT, re-appoint, and/or to terminate the services of any


advocate, solicitor Vakil etc. and to file or defend any such suit, case
or matter, To accept service a of any writ or summons, notices,
tribunals, Magistrate/s etc. to lead evidence, produce documents etc.
in such suits, case, disputes etc. in respect of Said Premises, if
necessary.

8. TO ACCEPT registered and other letters/ notices and to correspond


and reply to any letters/ notices received in respect of all Said
premises.

9. TO RENOVATE Said Premises and for that purpose obtained


necessary permission and no objection from Concerned office of the
Society, the Thane Municipal Corporation. etc. and/or Authority
Concerned.

10. TO REPRESENT and/or CORRESPOND with office of Thane


Municipal Corporation, Divisional Office, office of Prabhag Samiti
and/or other Govt. & Semi Govt. Authorities, Maharashtra State
Electricity Distribution Co. Ltd. and/or concerned authorities etc. in
all matters in respect of the Said Premises, in my name and on my
behalf.

11. TO SELL the said Premises to the prospective PURCHASER/S to

negotiate with them, settle the consideration amount, to receive /

accept token as well as consideration amount of the Said Premises

decided by them.

12. TO SIGN & EXECUTE any Agreement, Agreement for Sale, Sale
Agreement, Sale Deed etc. in favour of the Prospective Purchasers,
sign and execute any supporting documents viz. affidavits, indemnity
bond, undertakings, declarations etc. regarding the transfer the said
premises in favour of the prospective purchasers and represent me
before all the concerned offices mentioned in this Power of Attorney.

13. TO APPEAR, REPRESENT me before the concerned office of


Sub-Registrar, Thane and admit all the execution, which my attorney
executed pursuant to this Power of Attorney.

14. AND GENERALLY to do and execute or cause to be done or


executed all the lawful acts, things and deeds, whatsoever for the
general management and/or sell transaction of the Said Premises and
deal with all the concerned authorities mentioned hereinabove for the
purpose aforesaid, relating to the Said Premises.
15. TO DELEGATE, Sub-delegate, or to sell some or all the power of

this Power of Attorney to the person or persons on the terms and at

the discretion of my said Attorney.

16. I HEREBY agreed to ratify and confirm all the whatsoever shall

lawfully be done by my said attorney pursuant to this Power of

Attorney.
