AN ORDINANCE AMENDING THE SECTION 5B.01. OF THE

PROVINCIAL ORDINANCE NO. 037-18, SERIES OF 2018
OTHERWISE KNOWN AS THE REVISED REVENUE CODE OF
THE PROVINCE OF ILOCOS SUR 2018 (AS AMENDED)

I. COMMENTS

1. On the Title of the Ordinance

1.1. Remove the word “THE” after the word “AMENDING”.
1.2 Place a comma (,) after “Series of 2018”
1.3 Enclose in open and close quotation marks the words “THE
REVISED REVENUE CODE OF THE PROVINCE OF ILOCOS SUR
2018 (AS AMENDED”)

AN ORDINANCE AMENDING THE SECTION 5B.01. OF THE

PROVINCIAL ORDINANCE NO. 037-18, SERIES OF 2018
OTHERWISE KNOWN AS “THE REVISED REVENUE CODE OF
THE PROVINCE OF ILOCOS SUR 2018”, (AS AMENDED)

2. On the First WHEREAS

2.1 Change the word “Otherwise” to “otherwise”.
2.2 Place close quotation mark (”) after the word “amended”;
remove the semi-colon (;).
 2.3 Add the words “has so amended the same” after the last
word “amended”.

WHEREAS, Provincial Ordinance No. 037-18, otherwise known

as “An Ordinance Amending Provincial Ordinance No. 13-11, Series of
2013”, otherwise known as the Revenue Code of the Province of
Ilocos Sur, as amended has so amended the same;

3. On the Second WHEREAS

3.1 For purposes of precision and clarity, it must be amended to
read:

WHEREAS, Resolutions No. XVII-088PR and XVII-152PR, both

Series of 2017, have caused the establishment given the genesis of
the Medical Gas Plant for Ilocos Sur Provincial Hospital – Gabriela
Silang generating medical oxygen;

3.1.1 The use of the word “genesis” is not appropriate here as it

is means “origin” or “beginning” and normally has a biblical
connotations.

4. On the Third WHEREAS

4.1 For the purposes of grammatical precision and clarity change
the word “have” to “has”.
 WHEREAS, with its construction and installation, the hospital
have has generated its own medical oxygen and eliminates its
expense of purchasing, receiving and monitoring its hospital’s oxygen
supply;

5. On the Forth WHEREAS

5.1 For purposes of clarity and precision, insert the word
“oxygen” after the word “supply”; change the word “requires” to
“needs” to read:

WHEREAS, with the capacity of the Medical Gas Plant of the

Hospital, it can supply oxygen more than what the hospital requires
needs and can create an economic activity by offering, selling and
distributing to other hospitals and individuals with oxygen
requirements;

6. On the Fifth WHEREAS

6.1 For the purpose of clarity and precision as to the cause of
the amendment of Section 5B.01 of Provincial Ordinance No.
03718, Series of 2018, otherwise known as the “Revised
Revenue Code of the Province of Ilocos Sur 2018 (AS
AMENDED), the said WHEREAS should be amended to read as
follows:
WHEREAS, Chapter V. Service Fees, Article B. Hospital Fees of the
“Revised Revenue Code of the Province of Ilocos Sur 2018 (AS
AMENDED)” does not provide for the prices of oxygen tanks and
accessories thereof;

7. On the Sixth and Last WHEREAS and the part stating “BE IT
ORDAINED XXX”
7.1 They must be amended to become the “enactment clause”
of the Ordinance, to read:

WHEREAS NOW, THEREFORE, premises considered, and on

motion of Hon. Constante T. Oandasan, unanimously seconded by all
the members present, be it enacted by the Sangguniang Panlalawigan
of Ilocos Sur, in session assembled that:

8. On AMENDATORY PROVISIONS (SECTION 1)

8.1 For precision and clarity, it must be amended to read, and to
implement the intended amendment to the “Revised Revenue
Code of the Province of Ilocos Sur 2018 (AS AMENDED)

SECTION 1. AMENDATORY PROVISIONS. Section 5B.01.

Imposition of Provincial/District Hospital Service Fees of the “Revised
Revenue Code of the Province of Ilocos Sur 2018 (As Amended)” is
hereby amended to include the prices of oxygen tanks and
accessories thereof, and to read as follows:

 9. .On the Repealing Clause (Section 2)
9.1 Place hypen after the word “Clause” to read:

Section 2.  Repealing Clause.-All ordinances, resolutions,

memoranda, orders, and other issuances which are inconsistent with
this Ordinance are hereby repealed or modified accordingly.

10. NOTE: There is no. Separability Clause of the Ordinance. There

must be one and it is as follows: to become Section 3 of the
Ordinance:

SECTION 3. SEPARABILITY CLAUSE.- in the event or any reason,

any part, section or provision of this Ordinance is declared
invalid or held to be unconstitutional , the rest which are not
affected thereby and shall continue to be in full force or effect.

NOTE 2: EFFECTIVITY (SECTION 3) NOW BECOME SECTION 4

OF THE ORDINANCCE.
