DRAFT ORDINANCE

WHEREAS, kite flying is a popular sport amongst young children, students and adults,
however, by using thread made out of plastic, nylon or similar such synthetic material including
popularly known “Chinese thread/manja” or “medrom” in iloco or any other thread coated with
glass/metallic components causes a hazardous injury to human beings and birds which many a
times turns out to be a fatal;
WHEREAS, it is the avowed policy of the Local Government Unit under Section 16 of
the Local Government Code that every local government unit shall exercise the powers
expressly granted, those necessarily implied therefrom, as well as powers necessary,
appropriate, or incidental for its efficient and effective governance, and those which are
essential to the promotion of the general welfare;
Section 3. SCOPE AND COVERAGE. This Ordinance covers all acts of perpetrators
flying kites near Highways and Road of Commerce thereof.
Section 4. PROHIBITED ACT. The act of flying kites near highways and road of
commerce within the jurisdiction of the Province of Ilocos Sur.
Section 6. REPEALING CLAUSE. All ordinances, resolutions and other issuances that
are inconsistent with the provisions of this Ordinance are hereby amended, repealed or modified
accordingly.
Section 7. SEPARABILITY CLAUSE. If, for any reason, any part or section of this
Ordinance is declared invalid, no other part or sections of this Ordinance shall be affected
thereby.
Section 8. EFFECTIVITY CLAUSE. This Ordinance shall take effect immediately upon
approval.
