DRAFT ORDINANCE

AN ORDINANCE PROHIBITING KITES NEAR HIGHWAYS AND ROAD

OF COMMERCE THEREOF

WHEREAS, kite flying is a popular sport amongst young children, students and adults,
however, by using thread made out of plastic, nylon or similar such synthetic material including
popularly known “Chinese thread/manja” or “medrom” in iloco or any other thread coated with
glass/metallic components causes a hazardous injury to human beings and birds which many a
times turns out to be a fatal;

WHEREAS, kite flying threads being a non-biodegradable, causes harm to the

environment and sometimes result in flash-over on the power lines and sub-stations thereby
causing power interruptions to consumers, straining and damaging electrical assets, causing
accidents, injuries and loss of life;

WHEREAS, Benedict Tipon Paiste, a resident of Barangay An-annam, Bantay, Province

of Ilocos Sur, while traversing along the Diversion Road of Barangay Cabalangegan, Vigan City,
when the falling string of the kite slit his throat causing him Dead on the Spot last September 20,
2020;
WHEREAS, by prohibiting the act of flying kites near highways and road of commerce
thereof, people will be forewarned of the consequences of such crime thereby serving as a
deterrent to future wrongdoers that could cause danger, injury or alarm to persons, animal
or property.

WHEREAS, it is the avowed policy of the Local Government Unit under Section 16 of
the Local Government Code that every local government unit shall exercise the powers
expressly granted, those necessarily implied therefrom, as well as powers necessary,
appropriate, or incidental for its efficient and effective governance, and those which are
essential to the promotion of the general welfare;

BE IT ENACTED by the Sangguniang Panlalawigan of the Province of Ilocos Sur, that:

Section 1. TITLE. This ordinance shall be known as “An Ordinance Prohibiting

Kites near Highways and Road of Commerce thereof”.
 Section 2. POLICY. This Ordinance shall forewarn of the consequences of flying kites
near highways and road of commerce thereof and hereto penalizes perpetrators of the act
thereby serving as deterrent to future wrongdoers and ensuring wellbeing of the people, animals
and birds.

Section 3. SCOPE AND COVERAGE. This Ordinance covers all acts of perpetrators
flying kites near Highways and Road of Commerce thereof.

Section 4. PROHIBITED ACT. The act of flying kites near highways and road of
commerce within the jurisdiction of the Province of Ilocos Sur.

Section 5. PENALTIES. The following shall be imposed as penalties:

First Offense- Fine of Php 2,000.00;

Second Offense- Fine of Php 3,000.00;
Third Offense- Fine of P5, 000.00 and imprisonment of 10 days.

Section 6. REPEALING CLAUSE. All ordinances, resolutions and other issuances that
are inconsistent with the provisions of this Ordinance are hereby amended, repealed or modified
accordingly.

Section 7. SEPARABILITY CLAUSE. If, for any reason, any part or section of this
Ordinance is declared invalid, no other part or sections of this Ordinance shall be affected
thereby.

Section 8. EFFECTIVITY CLAUSE. This Ordinance shall take effect immediately upon
approval.
