AN ORDINANCE ESTABLISHING AND IMPOSING HEALTH, SAFETY AND

QUARANTINE PROTOCOLS DURING THE COVID-19 PANDEMIC PERIOD,


PROVIDING PENALTIES FOR VIOLATION THEREOF AND REPEALING
PRIOR ORDINANCES PERTAINING THERETO

WHEREAS, sometime in January 2020, our country and nation was attacked by the
indiscriminate and deadly Coronavirus disease (COVID-19);

WHEREAS, the World Health Organization (WHO) has declared COVID-19 as world
pandemic;

WHEREAS, to avoid COVID-19, the Philippine Government, through President Rodrigo R.


Duterte, on March 9, 2020, through Proclamation No. 922, S-2020, has declared the entire
Philippines, under a “State of Public Health Emergency” and took precautionary and remedial
measures, particularly Expanded Community Quarantine (ECQ) imposed in the whole country
especially in the National Capital Region (NCR) with attendant health and safety protocols, rules
and regulations;

WHEREAS, on June 1, 2020, to bring back to normal our nation’s life and economy, make
it alive and kicking to attain pre-set economic goals and enhance national economic growth,
President Duterte, upon the recommendation of the Inter Agency Task Force for the Emerging
Infectious Diseases (IATF-EID), downgraded the Expanded Community Quarantine (ECQ) to
General Community Quarantine (GCQ) in Metro Manila, Davao City, Cagayan Valley, Central
Luzon, Pangasinan and Albay, while the rest of the country will be under the more relaxed
Modified General Community Quarantine (MGCQ);

WHEREAS, General Community Quarantine (GCQ) allows the resumption of works and
operation of establishments as stated in the “Omnibus on the Implementation of Community
Quarantine in the Philippines” issued by the IATF-EID. This is referred to as the NEW
NORMAL;

WHEREAS, from the words of Secretary Harry Roque, the NEW NORMAL, is a
CRITICAL NORMAL. It cannot be the same as the NORMAL where COVID-19 was not yet
around. It is the NORMAL, wherein we put back out national economy (consequently our
provincial economy) to its toes and keep it alive and kicking but we still have to face and tangle
with the indiscriminate, dreaded, deadly COVID-19 which is still in our midst;

WHEREAS, as mentioned above, COVID-19 is indiscriminate, dreaded and deadly. It


chooses no particular places and nor victims to attack. As a result, the number of COVID-19
victims in the Philippines has sporadically increased and keeps increasing;

WHEREAS, the sporadic increase of COVID-19 confirmed cases and deaths is due to lack
of discipline of the people in violating quarantine health and safety protocols, rules and
regulations;

WHEREAS, the Sangguniang Panlalawigan of Ilocos Sur has passed several legislations
imposing rules and regulations on health and safety and quarantine protocols, nevertheless no
stringent penalties such as imprisonment imposed to prevent people from violating the same;

WHEREAS, Section 468, paragraph (iii) of the same code confers the power and duty to the
Sangguniang Panlalawigan, as the legislative body of the province, to enact and approve
ordinances imposing a fine not exceeding Five Thousand Pesos (Php 5,000.00) or imprisonment
not exceeding one (1) year, or both in the discretion of the court, for the violation thereof;
WHEREAS, during the meeting of the government task force in Davao City on July 7,
2020, DILG Secretary Eduardo Ano, has encourage Mayors to pass Ordinances imposing penalty
of imprisonment for violators, the saying, to wit “We have encouraged our mayors to pass
ordinances that the implementation will be uniform and all violators should be punished with
imprisonment so it will serve as a lesson and they will no longer violate (quarantine measures)”;

NOW THEREFORE, upon motion of __________________ be it enacted by the


Sangguaninang Panlalawigan of the Province of Ilocos Sur, in session assembled, that:

ARTICLE I
General Provisions

SECTION 1. TITLE. This piece of legislation shall be known as “Ordinance Imposing


Penalties for Violation of COVID-19 Health, Safety and Quarantine Protocols, Rules
and Regulations”

SECTION 2. DECLARATION OF POLICY. – It is the policy of the Provincial


Government of Ilocos Sur (PGIS) to promote, protect and preserve the health of its
constituents and keep them safe from the COVID-19 pandemic.

SECTION 3. COVERAGE. - This Ordinance shall include in its coverage all the people,
particularly those who visit, come to return to and/or reside in the Province of Ilocos Sur, be
it temporarily or permanently.

SECTION 4. DEFINITION OF TERMS - The following terms as used in this Ordinance,


shall mean:
1. Epidemic- It refers to a widespread occurrence of an infectious disease in a
community at a particular time.
2. Pandemic- An epidemic occurring worldwide, or over a very wide area,
crossing international boundaries, and usually affecting a large number of
people.
3. COVID-19- From the words of the World Health Organization (WHO)
Director-General in his opening remarks at the media briefing on COVID-
19 on 11 March 2020, it is “a pandemic sparked by a Coronavirus. This is
the first pandemic caused by a coronavirus.”
4. Enhanced Community Quarantine (ECQ)- It is a kind of quarantine
characterized by the following: (a) stringent quarantine measures; (b) public
transportation systems are suspended; (c) only essential businesses and
services are allowed to operate; and (d) subject to further evaluation before
transitioning to General Community Quarantine (GCQ).
5. General Community Quarantine (GCQ)- It is a kind of quarantine
characterized by the following: (a) relaxed quarantine measures; (b) public
transport are allowed but in reduced capacity; (c) 50-100% re-opening of
selected establishments subject to minimum health standards; (d) is no
further deterioration, GQC will be relaxed further for normalization.
6. Modified General Community Quarantine (MDCQ) - A classification of
quarantine which is a level under GCQ. It contains a level called “new
normal” which was introduced sometime in June 2020. An area needs to be
placed under normal measures. It is the most relaxed form of quarantine.
7. Residences - it refers to a building or structure for abode or residential
purposes, whether free, rented or otherwise. It includes dormitories, pension
houses, apartments for rent and the like.
8. Commercial Establishment- It means any income -producing or non-profit,
including but not limited to those used for retail, wholesale, dining, offices,
professional services, automobile services, hotels, motels and restaurants. It
includes sari-sari stores, department stores, coffee shops, canteens, banks,
lending companies, bookstores and the like.
9. Industrial establishment- An establishment involving manufacturing,
assembling, fabrication, processing, bulk handling of products, large
amounts of storage, warehousing and heavy truckings. In addition to lighter
industrial activities consisting of uses involving the processing, handling
and creating of products.
10. LAND TRANSPORTATION OPERATION – refers to the movement of
people and goods from one location to another by land.
11. Open public places or space - An open piece of land both green space or
hard space to which there is public access. It is located outdoor not indoor. It
may be owned by a national or local government, by a public body (e.g., a
non-profit organization and held in trust for the public, or by a private
individual or organization but made available for public use or public
access).
12. Health and Safety Protocols, Rules and Regulations- It refers to standard
requirements and practices that a person or community must do to stay
healthy and be safe from a disease, epidemic or pandemic, such as wearing
of face mask and sanitizing the hands.
13. Social Distancing- It means a distance of three (3) feet or one (1) meter
between two (2) persons in order to avoid the spread of a virus or disease.
14. Frontliner- It refers to people who work on the front line of a disease spread
prevention operation such as prevention of the Coronavirus disease
(COVID-19). They are subject to risk of being infected by the virus or
contracting the disease.
15. MOTOR VEHICLE – shall mean any vehicle propelled by any power other
than muscular power using the public highway, but except road rollers,
trolley cars, street-sweepers, sprinkles, lawn mowers, bulldozer, graders,
fork-lifts, amphibian trucks and cranes if not used on public highways and
vehicles run only on rails and trucks, and tractors, trailers and tractors
engines of all kinds used exclusively for agricultural purposes.
16. OPERATOR – is a holder or grantee of a valid and subsisting Certificate of
Public Convenience (CPC) by the Land Transportation Franchising and
regulatory Board (LTFRB)
17. PRIVATE MOTOR VEHICLE – refers to a motor vehicle that shall not be
used for hire under any circumstances.
18. PUBLIC UTILITY VEHICLE (PUV) – refers to a motor vehicle
considered as a public transport conveyance or common carrier duly
registered with the Land Transportation Office (LTO) and granted franchise
by the LTFRB.
19. Quarantine - is a restriction on the movement of people and goods which is
intended to prevent the spread of disease or pests. It is often used in
connection to disease and illness, preventing the movement of those who
may have been exposed to a communicable disease, but do not have a
confirmed medical diagnosis. It means to put or hold in isolation to put on
hold in isolation to prevent the spread of a disease or pests. It means a strict
isolation imposed to prevent the spread of a disease.

ARTICLE II
Health and Safety Practices, Protocols, Rules and Regulations for Educational
Institutions, Work Places, Commercial and Industrial Establishments, Land
Transportation, Public Places and other places

SECTION 1. HEALTH PRACTICES AND PROTOCOLS. The following are the


minimum health practices that should be observed;
a. When outside one’s residence, one shall maintain a distance of 2 meters from one another
b. The use of face mask is mandatory when person’s leave their residence.
c. No person shall be allowed to enter an establishment without presenting a valid id, non-
wearing of face mask and duly filled up travel history form. All persons must sign in the
company log book before entering the establishment and must indicate clearly and
accurately therein his/her name, contact number and place of residence. Failure of the
person to do so will subject him to a penalty as mentioned in this ordinance

1.1 Border Protocols. The Philippine National Police, Highway Patrol Group, Armed Forces
of the Philippines and the Bureau of Fire Protection shall manned the borders located at the
Municipality of Tagudin, Sinait, Narvacan and Cervantes Ilocos Sur.

1.2. Cargo Vehicles. Cargo Vehicles shall be allowed entry into the province provided they
comply with the following guidelines;
1. Maximum of five persons may operate cargo trucks and delivery by land with or
without load
2. All cargo personnel must present their id to ensure that they are legitimate employees
and must undergo comprehensive health check by the PHO;
3. Disclose relevant information to the persons manning the border
4. Allow inspection procedures of the PNP to ensure that the cargo vehicles are
operating immediately and with no hidden passengers
1.3. Authorized Persons Outside Residence. (APOR). APOR are allowed entry in the
Province provided they comply with the following protocols;
1. Present identification cards, travel authority and other documents showing purposes
of entry into the province;
2. Provide complete information such as government official/employee’s name, contact
number, company name, company’s contact number and duration of stay in Ilocos
Sur
3. All APORS shall undergo RT-PCR test at least one week before their scheduled
entry if available, if not, must undergo a Rapid Antibody Test.
4. Undergo comprehensive health check by the Provincial Health Office
5. Fill up APOR Declaration Form and execute an affidavit of Undertaking
6. Presentation of invitation/appointment of the place of destination which shall be
confirmed by the contact person
7. Shall not bring along travel companion
During his/her stay in Ilocos Sur, he/she must follow strict health protocols failure of
which will subject him/her to a fine as mentioned in this ordinance.

SECTION 2. HEALTH AND SAFETY PROTOCOLS, RULES AND REGULATIONS


FOR PRIVATE EDUCATIONAL INSTITUTIONS - The following health and safety
protocols, rules and regulations shall be observed in all educational institutions:

1. No employee, teacher/professor, and/or student shall be allowed to enter the


school and its premises without wearing a face mask.
2. At the entrance of the school or near it, there must be placed a sanitizing booth
equipped with a large bottle, container off alcohol where all who enter the
school and its premises can sanitize their hands.
3. All schools must have a clinic with medical professional to attend and serve the
health needs of employees, teachers/professors and students.
4. At the entrance of the school, there must be posted a licensed security guards
who will serve as guide to enforce the wearing of face mask and the necessary
health and safety protocols, rules and regulations in the school.
5. There must be a separate comfort rooms for the males and females, which must
be cleaned and sanitized daily with proper and effective leaning sanitizing
agents.
6. The offices of the officers of the school, the door/s and windows, including the
furniture, filing cabinets, shelf, gadgets and like computers/telephones must
also be cleaned and sanitized daily with proper and effective cleaning and
sanitizing agents. So with the classrooms, teachers table, white board/ black
board, and chairs/desks of the students. So with the laboratories of the school,
including the chairs, laboratory tables and equipment. So with the various other
offices of the school such as the accounting department and cashier’s
booth/office.
7. In the Accounting Department and Cashiers booth office, there must be placed
to prevent the spread of the COVID-19 virus, thin paper or plastic barriers on
that part of portion thereof where the students used to transact official business
such as having their tuition and other fees assessed and/or paid.
8. The canteen of the school, if any must also be cleaned and sanitized daily,
including the chairs, tables, kitchen wares such as spoons and forks with proper
and effective cleaning and sanitizing agents.
8.1 There must also be placed at the counter where customers order and pay
their food pack in thin, paper plastic barriers to prevent the spread of the
COVID-19 virus.
9. Social distancing which means a distance of one (1) meter between two (2)
persons shall be imposed and enforced in all parts of the school and its
premises, provided that, in the classroom and laboratories, the students who are
all wearing masks shall be at least be seated one (1) seat or desk apart.
10. Finally, in case there is or there are students, teachers, professors or employees
who has or show flu-like or COVID-19 symptoms, he/she or they must be
immediately separated from the rest and brought immediately to the school
clinic for immediate medical attention.

SECTION 2. HEALTH AND SAFETY PROTOCOLS, RULES AND REGULATIONS


FOR WORK PLACES IN PRIVATE COMPANIES/ENTITIES - The following health and
safety protocols, rules and regulations shall be observed in all work places.
1. No company/business entity officer or employee shall be allowed to enter the
company/business entity and its premises without wearing a face mask.

2. There shall be posted a licensed security guard or guards at the entrance of the
workplace building or buildings who shall serve as frontliners to enforce the
wearing of face masks and the necessary health and safety protocols, rules and
regulations.

3. On personal and company hygiene:


3.1 Management shall establish daily disinfection procedures;
3.2 There must be handwashing stations at the entrance of the building with
proper hand hygiene reminders where officers employed shall be required to
wash their hands with soap and water, or sanitize the same with alcohol.
3.3 Common areas must be cleaned and disinfected at the end of the day and at
the end of each shift.
3.4 Management shall provide proper equipment and materials, i.e., tissue
papers, soap, alcohol, disinfectants, etc., to promote hygiene and prohibit
sharing of tools to minimize the spread of the virus.
3.5 All tools and machinery must be cleaned and disinfected and increase
cleaning and disinfection at the end of the day.
3.6 Clean and disinfect computers and other gadgets and desks keyboards,
mouses and the phones and desktop the end of the day with anti-bacterial
cleaners and disinfectants and leave desks empty.
3.7 Company/business entity officers, including door/s and windows, chairs,
tables, filing cabinets, shelves, computers and other gadgets and telephones
must also be cleaned and disinfected every day with proper and effective
cleaners and disinfectants.
3.8 There must be separate comfort rooms, for males and females complete with
hygiene provisions such as tissue/toilet paper, soap and disinfectants.

4. On Facilities and equipment:


4.1 Stop elevator use whenever possible. If that is not possible, restrict use of
elevators to two (2) people at a time. In the case of escalators, riders must be at
least one (1) meter apart from each other.
4.2 Sharing of items such as pens, pencil, phones, cellphones and etc., must be
stopped.
4.3 Printers and photo copiers after each use or find alternative solutions to their
use.
4.4 Protocols should be established to move in a clockwise direction in
corridors, hallways and narrow spaces.

5. On Social Distancing
5.1 Social distancing which means a distance of one (1) meter between two (2)
persons shall be observed in all parts and premises of the work place, including
its buildings.
5.2 Employees gathering in common spaces (entrances) exits, stair-
wells/stairways and inside trailer offices and in-person meetings or in a closed
room shall be avoided.
5.3 Flexy glass panes shall be installed when social distancing cannot be 100%
respected.

6. On Health Concerns and Quarantines.


6.1 The Company/Business entity shall have at least one (1) medical clinic to
service the health needs and concerns of the employees and shall have one (1) or
more doctor/s and nurse/s, depending upon the labor population or number of
employees. The medical staff shall also wear face masks.
6.2 In case an employee/s show any sign of COVID-19 symptoms, he/she or
they shall be taken immediately to the medical clinic to appropriate medical
attention, and be required to undergo quarantine.

7. On Other Matters
7.1The company/business entity shall have a canteen too attend to the meal and
food needs of the employees. It must also be cleaned and sanitized every day,
including the chairs, tables, kitchen wares, with proper and effective cleaning
and sanitizing agents.
7.2 There must also be placed at the counter or that part of the canteen
where the employees/customers pay their food purchased, thin papers plastic
barriers to prevent the spread of the COVID-19 virus.

SECTION 3. HEALTH AND SAFETY PROTOCOLS, RULES AND


REGULATIONS FOR COMMERCIAL AND INDUSTRIAL ESTABLISHMENTS
- The following health and safety protocols, rules and regulations shall be
imposed/observed in all commercial establishments:

1) No employees and customers of the commercial establishment shall be


allowed to enter the same without wearing a face mask.
2) At the entrance of the commercial establishment, there shall be placed, a
sanitizing booth of alcohol where all who enter the establishment are
required to sanitize their hands.
3) At the entrance, there shall also be posted a licensed security guard or
guards who shall serve as frontliner/s to enforce the wearing of facemask
and the necessary health and safety protocols rules and regulations. In the
absence of a sanitizing booth or station, the guard or guards shall sprinkle
the hands of all those who enter with alcohol, requiring them to sanitize
their hands.
4) The security guard or guards shall also take the body temperature of all
those who enter the establishment, using digital thermometer for the
purpose. And those who have or appear to have fever shall not be
allowed to enter.
5) There must be a separate comfort rooms for the males and females,
which must be cleaned and sanitized every day with proper and effective
sanitary agents and equipped with complete sanitized materials such as
hand soap, alcohol and tissue/toilet paper.
6) The floors of the commercial establishment shall also be cleaned and
sanitized daily with proper and effective cleaning and sanitizing agents.
So with chairs and tables at the food court of the establishment.
7) The offices in the commercial establishment such as those of the
manager and other officers, including the tables, desks, chairs, shelves,
computers, telephones, shall also be cleaned and sanitized daily with
proper and effective cleaning and sanitizing agents.
8) Social distancing which means a distance of one (1) meter between two
(2) persons shall be observed in all parts of the commercial
establishment.
9) In the cashiers booths, there must be placed thin papers plastic barriers
between the cashier and the customer to prevent the spread of the
COVID-19 virus.
10) In the case of banks/lending institutions, apart from the foregoing health
and safety protocols and regulations there must be placed in the whole
areas of the New Accounts and Tellers, Counter, thin papers plastic
barriers between the staff and customers who transact business to prevent
the spread of the virus.
11) So, with the case of pawnshops, money/cargo transfer establishments like
Cebuana, LBC, etc. There must be placed the same plastic barriers
between the staff and customers who transact business, to prevent the
spread of the virus.
12) In the case of restaurants, canteens, coffee shops and the like, apart from
the foregoing health and safety protocols, rules and regulations, there
must also be placed at the food counters, said plastic barriers, between
the employee/staff and the customers, who order and pay them foods, to
prevent the spread of the virus.
13) In the class of sari-sari stores, there must be placed the same plastic
barriers between the sari-sari store owner/attendant and the customers
who buy retain, goods, to prevent the spread of the virus.

SECTION 4. HEALTH AND SAFETY PROTOCOLS, RULES AND REGULATIONS


FOR OPERATION OF LAND TRANSPORTATION - The following health and safety
protocols, rules and regulations shall be observed in all land transport:

A. For Public Utility Vehicles (PUVs)


1. At the entrance of the vehicle, whether at the back or side of the vehicle, there must
be placed in a permanent receptacle or container, a bottle of alcohol, which
passengers boarding on and off the vehicle are required to sanitize their hands. Same
thing in the case of the entrance beside or near the driver’s booth, the permanent
receptacle or container of the bottle of alcohol, being placed on the dashboard beside
the entrance.
2. Drivers and conductors shall wear masks and gloves at all times;
3. Commuters are required to wear masks in order to be allowed to board a PUV;
4. Commuters are required to wear face shields in order to be allowed to board a PUV;
5. When Automatic Fare Collection System (AFCS) is available, PUVs are highly
required to use the AFCS;
6. For those without or have a non-operational AFCS, drivers/conductors shall collect
the payment at the front seat before allowing the passenger to board the PUV;
7. UV Express shall follow the point-to-point operation. Fares shall only be collected at
their designated terminals;
8. All Public Utility Buses (PUBs) shall be equipped with thermal scanners for the
checking of body temperature of all commuters, those with temperature of 38
degrees centigrade or higher will not be allowed to board the vehicle;
9. Vehicles shall be disinfected every end of their trip, on all surfaces;
10. High-touch surfaces of the vehicle such as but not limited to seats, armnests, handles
shall be disinfected at least once every three (3) hours if the vehicle is in continuous
operation;
11. Operators/drivers should provide foot-disinfectants for passengers prior to boarding;
12. Driver compartments of UV Express and PUJs should be sealed off from the
passenger areas using non-permeable, transparent material;
13. In compliance with the one (1) meter physical distancing imposed by the Department
of Health (DOH), PUJ operators may install impermeable barriers between rows of
seats that are less than 1 meter apart if they wish to maximize the 50% passenger
load;
14. All safety officers must regularly examine the drivers’ and conductors’ fitness to
work by checking their temperatures among other measures;
15. Should a driver or conductor show symptoms of COVID-19, he/she shall be
prohibited to report to work and must be endorsed to the nearest medical facility by
the PUV operator;
16. All PUVs are required to post infomercials and posters reminding commuters of
good sanitation practices as required by DOH or the World Health Organization
(WHO).

B. For Private Vehicles – All drivers and passengers of private vehicles must wear face
mask at all times and must comply with the one (1) meter physical distancing.

C. For Terminals.

All public and private transport terminals shall adopt the following sanitary practices:
1. All PUV Terminals shall observe appropriate sanitary measures during the period of
operations, especially in frequently touched surfaces (such as but not limited to waiting areas,
passenger lounges, seats, counters, door knobs and the like). All terminal employees shall wear
face masks at all times and be regularly subjected to medical check-up;
2. All PUV terminals shall provide alcohol and hand washing facility (with water supply
and soap) at the entrance for free usage of passengers;
3. Passengers are required to undergo body temperature checks. In case a passenger
registers a body temperature of 38 degress centigrade or higher, the said passenger shall not be
allowed entry and shall be referred to the nearest medical facility.

Section 4.1. PHYSICAL DISTANCING IN TRANSPORT FACILITIES

A. Capacity of Public Utility Vehicles


a.1. Public Utility Bus (PUB) Passenger Limits: Passenger load shall not exceed 50% or half
of the vehicle’s capacity (excluding driver and conductor); passengers should be seated one seat
apart; no standing passengers shall be allowed;
a.2. Public Utility Jeep (PUJ) Passenger Limits: Passenger load shal not exceed 50% or half
of the vehicle’s capacity (excluding driver and conductor); passengers should be seated one seat
apart; no standing passengers shall be allowed. The passenger seat beside the driver may be
occupied by one (1) passenger when there is no conductor present during the trip.
a.3. UV EXPRESS Passenger Limits: Passenger load shall not exceed two passengers per
row, except for the driver’s row for which there should only be one (1) passenger allowed to
occupy the passenger seat. Portions with side-facing seats shall have passenger load not
exceeding 50% or half of the capacity of side- facing seats where passengers whould be seated
one seat apart in accordance with physical distancing guidelines of DOH.
a.4. Taxi and TNVS Passenger Limits: Passenger load shall not exceed two (2) passengers
per row, except for the driver’s row for which there should only be one (1) passenger allowed to
occupy the passenger seat.
a.5.Tricycle Passenger Limits: Passenger load shall not exceed one (1) passenger in the side-
car. No passenger shall be seated behind the driver.

B. SEAT MARKINGS
All modes of PUVs are required to have markings on seats that are only allowed to be
occupied by the passengers in compliance with the physical distancing measures and passenger
limits stated above.

C. PRIVATE VEHICLES

c.1. Tricycle Passenger Limits: Passenger load shall not exceed one (1) passenger in the
side-car. No passenger shall be seated behind the driver.

c.2. With respect to pillion in motorcycle riding, in compliance with the requirement
imposed by the Government, particularly the Joint Task Force COVID Shield, there shall be
installed in the motorcycle a pillion barrier which consists of either a steel frame with plastic or
flexiglass between the driver and the pillion or a backpack-like barrier worn by the driver. A
pillion is a seat for a passenger behind a motorcyclist or motorcycle driver.

D. TERMINALS
Physical Distancing measures shall be observed at all times within the terminal; all areas for
queuing at the terminal shall have marked positions on the floor where passengers should stand
in order to maintain proper distancing.

SECTION 5. HEALTH AND SAFETY PROTOCOLS, RULES AND REGULATIONS


FOR OPEN PUBLIC PLACES - This refers to public places, squares, through multipurpose
pavements, basketball courts, courts and the like. The following health and safety protocols,
rules and regulations shall be observed therein:

1. There must be placed in a strategic place of the area, a sanitizing booth or station equipped
with hand soaps or a bottle of alcohol where people who go to and fro in the place are
required to sanitized their hands as frequently as possible, depending upon the activity they
do in the place.
2. Every individual person who goes to and fro in the place should wear a face mask.
3. There should be assigned or posted in the area at least one (1) or two (2) licensed security
guard/s who shall serve as frontliners in the place to enforce the wearing of face mask,
sanitizing of the hands and other pertinent health and safety protocols, rules and regulations.
The security guard/s shall have the power to segregate and drive away the occupants or
users of the place without a face mask.

3.1 The assignment or posting of the security guard/s shall be at the expense of the
owner or operator thereof such as establishment.

3.1.1 The same principle applies in the case of the sanitizing booth or station.
3.1.2 Apart from the functions in parts hereof, the security guard/s shall take the
body temperature of occupants/users of the place with a digital thermometer. Those
found out to have fever and/or symptoms of flu-like disease or COVID-19 disease shall
be required by the guard/s to leave the place.
4. Social distancing which means a distance of one (1) meter between two (2)
persons shall be observed in the place. Again, the security guard/s shall
enforce this.

SECTION 6. HEALTH AND SAFETY PROTOCOLS, RULES AND REGULATIONS IN


OTHER PLACES NOT MENTIONED IN THE FOREGOING WHERE GROUP OF
PEOPLE, MAY GATHER OR PASSED BY - This refers to subdivision involves or gateways,
among others. The following health and safety protocols, rules and regulations shall be observed
therein:

1. At the entrance of the subdivision, there shall be a frontliners station, there


shall be one (1) or two (2) licensed security guards and at least five (5) staff
the barangay government who will serve as frontliners to force wearing of
face masks and sanitizing and other health and safety protocols, rules and
regulations.
2. No person shall be allowed to enter into or get out of the subdivision
without wearing a face mask. In the frontlliner’s station, there shall be a
sanitizing booth equipment with at least one (1) large bottle or container of
alcohol where residents and outsiders who enter into or get out from or pass
by the subdivision, shall be required to sanitize their hands. The frontliners
themselves shall enforce and administer the sanitizing.
2.1 All vehicles which enter into or get out or pass by the subdivision shall
also be required to be completely sanitized by spraying thereto with its
windows with proper and effective sanitizing agents and chemicals.
3. The frontliners shall also get the body temperature of all those who enter
into or get out or pass by the subdivision, with digital thermometers.
3.1 All those who are found out to have fever and/or symptoms of the like
disease or COVID-19 disease, shall be refused to entry into or exit from the
subdivision and sent to the nearest clinic or hospital for proper medical
attention and quarantine.

ARTICLE III
QUARANTINE PROTOCOLS

SECTION 1. PERSONS REQUIRED TO BE SUBJECT TO QUARANTINE. – The


following persons are required to be subject to quarantine:
1. Tourist/Visitors;
2. Those on Temporary sojourn, stay or residence in the Province of Ilocos Sur;
3. Residents of the Province of Ilocos Sur returning to the Province from travel
abroad;
4. Residents of the Province of Ilocos Sur who have a history of travel abroad;
5. Persons sick of COVID-19 (confirmed cases);
6. Persons who might be sick or could be sick of COVID-19 (suspected cases);
7. Anyone who has been in close contact with someone who is sick of or who has
COVID-19.

SECTION 2. QUARANTINE RULES AND REGULATIONS FOR


TOURIST/VISITORS. - The following quarantine rules and regulations shall be observed
by all tourists/visitors to the Province of Ilocos Sur:
1. They shall be required to stay in isolation for fourteen (14) days in a duly
registered and recognized or accredited hotel or lodge in the Province of Ilocos
Sur before doing their activity or purpose in coming to the Province of Ilocos
Sur. After the quarantine they shall be obtaining from the President 100% or his
authorized representative a sworn certificate/certification to that effect to be
presented for attestation to the health officer or of the city/municipality where
the tourist/visitor temporarily resides.
2. They shall be required to observe health and safety rules and regulations
imposed and enforced by the Provincial Government.
3. They shall be required to undertake the appropriate requirement or test/s as may
be required them by the proper authority of the Provincial Government.
4. They shall have the Province immediately after doing or accomplishing their
estimates activity or purpose in coming to the Province of Ilocos Sur.

SECTION 3. QUARANTINE RULES AND REGULATIONS FOR THOSE ON


TEMPORARY SOJOURN, STAY OR RESIDENCE IN THE PROVINCE OF
ILOCOS SUR. - The following quarantine rules and regulations shall be observed by all
those on Temporary sojourn, stay or residence in the Province of Ilocos Sur:
1. Request for entry of returning resident. The said request shall be confirmed by the
Punong Barangay, City/Health Municipal Office and the Mayor that the resident
is a bona fide resident of the Province and such resident is accepted.
2. Must secure travel authority from the JTF-CV Shield PNP in their locality
3. Must fill up a Health Declaration Form. Failure of the Returning Residents to do
so will subject him to a fine under this ordinance
4. They shall be required to stay in isolation for fourteen (14) days in a duly
registered and recognized or accredited hotel or lodge in the Province of Ilocos
Sur.
5. They shall be required to observe health and safety rules and regulations imposed
and enforced by the Provincial Government. After the quarantine, they obtain the
same sworn certificate or certification mentioned in Rule No. 1 of Section 2
hereof.
6. They shall be required to undertake the appropriate requirement or test/s as may
be required of them by the proper authority of the Province of Ilocos Sur.
7. They shall be required to leave the Province immediately after their temporary
sojourn, or residence in the Province of Ilocos Sur.

SECTION 4. QUARANTINE RULES AND REGULATIONS FOR RESIDENTS OF


THE PROVINCE OF ILOCOS SUR RETURNING TO THE PROVINCE FROM
TRAVEL ABROAD. - The following rules and regulations shall be observed by residents
of the Province of Ilocos Sur returning to the Province from travel abroad.
1. Request for entry of returning resident. The said request shall be confirmed by
the Punong Barangay, City/Health Municipal Office and the Mayor that the
resident is a bona fide resident of the Province and such resident is accepted.
2. Must secure travel authority from the JTF-CV Shield PNP in their locality
3. Must fill up a Health Declaration Form. Failure of the Returning Residents to do
so will subject him to a penalty under this ordinance
4. They shall be requires to stay in isolation for fourteen (14) days in a duly
registered, recognized or accredited hotel or lodge in the Province of Ilocos Sur.
After that quarantine, they shall also obtain the same sworn
certificate/certification to that effect to be presented for attestation to the health
officer or of the city/municipality where the tourist/visitor temporarily resides.
5. They shall be required to observe health and safety protocols, rules and
regulations imposed and enforced by the Provincial Government.
6. They shall be required to undertake the appropriate requirement or test/s as may
be required of them by the proper authority of the Province of Ilocos Sur.
7. They may be exempted from Rules and Regulations No. 4 if they have
undertaken the same quarantine requirement elsewhere in the Philippines before
returning to the Province, and can show the pertinent and appropriate Certificate
or Certification duly signed and sworn by the President/CEO of the hotel/lodge
and by the proper health and other authority/ties.

SECTION 5. QUARANTINE RULES AND REGULATIONS FOR RESIDENTS OF


THE PROVINCE OF ILOCOS SUR WHO HAVE A HISTORY OF TRAVEL
ABROAD. - The following rules and regulations shall be observed by all residents of the
Province of Ilocos Sur who have a history of travel abroad:

1. They shall be required to have a choice of undertaking the required fourteen (14)
days quarantine at home or in a duly registered and recognized or accredited
hotel or lodge in the Province of Ilocos Sur; provided that, if the quarantine is
done at home, he or she shall stay in isolation for fourteen (14) days in a room or
quarter for the purpose at home; provided further that after undertaking the
quarantine, he or she shall execute to that effect a Joint sworn with his or her
spouse, sibling, relatives, guardian or any other responsible person, of legal age
staying with him/her in the same home who actually witnessed the undertaking
of the required quarantine at the pain of perjury; the same to be presented to the
proper health authority of the city/municipality or from where he/she resides for
acknowledgment of the fact. Said health authority shall on the documents attest
to the fact.
2. They shall be required to observe health and safety rules and regulations
imposed and enforced by the Provincial Government.

SECTION 6. QUARANTINE RULES AND REGULATIONS FOR PERSONS SICK


OF COVID-19 9 (CONFIRMED CASES). - The following rules and regulations shall be
observed by all persons sick of COVID-19 (Confirmed cases):
1. They shall be required to be confined for treatment and proper medical care and
attention at a duly registered recognized or accredited hospital or clinic in the
Province of Ilocos Sur, until he/she gets well from COVID-19.
2. Once he gets well and is released from the hospital or clinic, he/she shall present
to the proper health authority of the municipality, city or Province the pertinent
hospital or clinic release papers duly signed by the hospital/clinic director/head
or proper officer/ authority/representation.
3. At home, he/she shall be required to stay in isolation for fourteen (14) days in a
separate room or quarter provided for the purpose at home. After the quarantine,
he shall be subject to the same requirement of sworn Joint Affidavit mentioned
in Rule No. 1 of Section 5 hereof.
4. He shall be required to observe health and safety rules and regulations imposed
and enforced by the Provincial Government.
5. If the patient happens to be a foreigner or another municipality/city, apart from
undertaking and complying with the requirements mentioned in No. 1, 2, and 4
hereof, he/shall be sent immediately to his/her home country after leaving the
hospital/clinic.

SECTION 7. QUARANTINE RULES AND REGULATIONS FOR PERSONS WHO


MIGHT BE SICK OR COULD BE SICK OF COVID-19 (SUSPECTED CASES). –
The following rules and regulations shall be observed by all persons who might be sick or
could be sick of COVID-19:
1. He/she shall be required to stay in isolation for fourteen (14) days in a room or
quarter for the purpose at home; provided that, after undertaking the quarantine,
he or she shall execute to that effect a Joint Sworn Affidavit with his or her
spouse, sibling, relative, guardian, or any other responsible person, legal age,
staying with him/her in the same who actually witnessed the undertaking of the
required quarantine at the pain of perjury; the same to be presented to the proper
health authority of the city or municipality where he/she resides for
acknowledgment and attestation of the fact.
2. He/she shall be required to observe health and safety protocols, rules and
regulations imposed and enforced by the Provincial Government.
3. If the subject person happens to be a foreigner, he quarantine shall be under
taken at the home, hotel or lodge where he/she temporarily resides or stays;
provided that if the required quarantine is done at home, he/she shall be required
to undertake/observe the requirement stated in Rule No. 1 hereof, provided
further that, if the quarantine is done in the hotel or lodge, where he/she
temporarily resides he shall get the pertinent Certificate or Certification to that
effect signed and sworn to by the President/CEO or authorized person of the
hotel or lodge, to be presented by him to the proper health authority of the
municipality or city where the hotel or lodged is located, for acknowledgement
and attestation of the fact.
4. After undertaking the required quarantine, the foreigner shall be sent out
immediately to his/her home country.

SECTION 8. QUARANTINE RULES AND REGULATIONS FOR ANYONE WHOSE


HAS BEEN IN CLOSE CONTACT WITH SOMEONE WHO IS SICK OF OR WHO
HAS COVID-19. - The following rules and regulations shall be observed by anyone who
has been in close contact with someone who is sick of or who has COVID-19:
1. The following shall count or be considered as close contact:
a. Subject person in this Section of the Ordinance was within a distance of
six (6) fact of someone who has or is sick of COVID-19 for at least
fifteen (15) minutes;
b. Subject person lived or lives is with someone who has or/is sick with
COVID-19;
c. Subject Person provided care at home to someone who has or is sick with
COVID-19;
d. Subject person had direct physical contact with the person who has or is
sick with COVID-19 (touched, hugged, or kissed him/her);
e. Subject person shared eating or drinking utensils with the person who has
or is sick with COVID-19;
f. The person who has or sick with COVID-19 sneezed, coughed or
somehow dropped or transferred respiratory droplets on subject person.

2. Subject person who has been in close contact with someone or the person who
has or is sick with COVID-19 shall be required to undertake the following
remedial measures or steps:
a. Subject person is required to stay in isolation in a separate room or
quarter at home for fourteen (14) days after his/her last contact with the
person who has or is sick with COVID-19; provided that, after
undertaking the quarantine, he/she shall execute to the effect a joint
sworn affidavit with his/her spouse, sibling, relative, guardian or any
other responsible person, of legal age, staying with him/her in the same
home, who actually witnessed the undertaking of the required quarantine,
at the pain of perjury; the same to be presented to the proper health
authority of the municipality or city where he/she resides, for
acknowledgement of the fact. Said health authority shall, on the
document, attest to the fact:
i. If the subject person happens to be a foreigner, after the required
quarantine as described above he/she shall be sent to his/her home
country immediate.

b. Subject person shall be required to watch in himself for fever, cough, and
shortness of breath or other symptoms of COVID-19. If he has any of the
foregoing, he must proceed to the nearest hospital or clinic for proper
medical care and attention.
3. Subject person, if possible shall stay away from others, especially people who
are at higher risk for getting sick with COVID-19 like seniors and little children.

ARTICLE IV
IMPLEMENTATION, MONITORING AND INSPECTION

SECTION 1. IMPLEMENTATION, MONITORING, INSPECTION. - The Provincial


Office of the Department of Health in cooperation with the municipal or City Health Office and
the Offices of the Barangay Chairman/Chairpersons shall be the lead Government agencies in
implementing this Ordinance. They shall held and assign their personnel on a barangay to
barangay basis to conduct surprise, unscheduled, at random visits and inspection of quarantine
facilities, hotels and lodges where the required quarantine may be undertaken as well as
hospitals/clinics where COVID-19 patients any be brought for medical care, attention or
treatment.

(b) In the inspection particularly on the operation of land transport/utility vehicles and
compliance with border protocols, the PGIS-Task Force Bantay Kalsada and the Deputized
Transportation Regulation Officers of the Philippine National Police (PNP) and Provincial
Highway Patrol Group shall assist the aforesaid lead government agencies in implementing this
Ordinance.

ARTICLE V
PENAL PROVISION

SECTION 1. PENALTY. Failure to observe the safety guidelines and protocols under this
ordinance shall be punished by:

1. First Offense – A fine of One Thousand Pesos (Php 1, 000.00) or 10 days


imprisonment

2. Second Offense - A fine of Three Thousand Pesos (Php 3,000.00) and 10 days
imprisonment

3. Third Offense and Subsequent Violations – A fine of Five Thousand Pesos (Php
5,000.00) and one (1) month imprisonment

SECTION 2. In case private establishments (to include educational institutions,


commercial/industrial establishments and companies) failed to observe this Ordinance, the
President, the General Manager or any person with related interest shall be held liable and be
held liable.

ARTICLE VI
Final Provisions

SECTION 1. SEPARABILITY CLAUSE. - if for any reason, any section or part of this
Ordinance is declared unconstitutional or invalid, the rest of it which are most so declared shall
remain valid, binding and of legal force and effect.
SECTION 2. REPEALING CLAUSE. - All ordinances, memorandum orders/circulars,
provincial executive orders rules and regulations and similar issuances inconsistent with this
Ordinance are hereby repealed amended or modified accordingly.

SECTION 3. EFFECTIVITY. - This Ordinance shall take effect fifteen (15) days after its
publication in a newspaper of general circulation in the province of Ilocos Sur.
