AFFIDAVIT

I, CLARISSA PAGADUAN MARQUEZ, of legal age, single, Filipino

and with postal address at Sinakulay, Pres. Quirino, Sultan Kudarat,
Mindanao, after having been duly sworn in accordance with law, do
hereby depose and state that:

1. I am the niece of Naida Pagaduan who is currently residing in

Germany.

2. I was born on 25 February 1982 of parents Oscar O. Marquez

and Naty C. Pagaduan.

3. In the Declaration De Prise En Charge Formal Obligation

(Affidavit of Support) that my Aunt Naida sent me, I noticed
that my surname is written as “Margues”.

4. The same is purely a clerical error because in truth and in

fact, my surname is MARQUEZ as indicated in my Birth
Certificate and my school ID issued by the AMA Computer
College, photocopies of which are attached hereto as Annexes
“A” and “B”, respectively.

5. I am affirming that CLARISSA PAGADUAN MARQUEZ and

CLARISSA PAGADUAN MARGUES are one and the same
person.

6. I am executing this Affidavit to attest to the truth of the

foregoing and for whatever legal purpose it may serve.

AFFIDAVIT OF LOSS

I, OLAN RAY MANUEL, of legal age, single Filipino, and with postal
address at No. 14 Rainbow Street, Odelco Subdivision, Novaliches, Quezon City,
after having been duly sworn in accordance with law, do hereby depose and state
that:

1. I am a student of Lyceum of the Philippines with Student No. 2003-

11813. As such, I was issued an EAF.

2. Last week, I discovered that my aforesaid EAF is no longer inside

the cabinet where I used to keep it.

3. Earnest efforts have been exerted to locate the said EAF, but the
same proved futile.

4. I am executing this affidavit to attest to the truth of the foregoing for

whatever legal purpose it may serve.

REPLY-AFFIDAVIT

WE, GERALDINE A. ESTENZO and RITCHELLE A. MANGAOANG, both

of legal age, after having been sworn in accordance with law do hereby depose
and state that:

1. The allegations and averments contained in our Affidavit dated 3 rd day of

November 2003, a copy of which is hereto attached as Annex “A”, are
deemed reproduce and reiterated herein;

2. The allegations of Merla Ilagan in her Counter-Affidavit dated June 18,

2004 are mere fabrication and should not be given scant consideration
for whatever purpose said Counter-Affidavit was executed;

3. The signature of Ms. Ilagan, which she alleged as forgery was made by
Ms. Ilagan herself in the 2 February page of my diary in my (Geraldine
Estenzo) presence and for the purpose of acknowledging receipt of the
amount of P10, 000.00. As evidence, attached hereto is a copy of said
page of my diary as Annex “B” hereof;

4. Based on the aforementioned Affidavit (Annex “A”) executed by herein

affiants, there is probable cause to hold Ms. Merla Ilagan liable for illegal
recruitment and/or Estafa, and the averments in her Counter-Affidavit
dated June 18, 2004, are evidentiary matters which should be proven in
a full blown trial;

5. We are executing this Reply-Affidavit to attest to the truth of the

foregoing and for whatever legal purpose this may serve.
