Management Decision in re: Complaints of Harassment & Bullying

After a careful consideration done by the Disciplinary Committee and with the assistance
of the Legal Department, the Management has collected and established the following
facts:
From Ms. Chandra Nalaar, her allegations of having suffering from your unwelcome
physical contact is seen from the CCTV footages installed in your office department. The
insistent rating and commenting on your staff’s appearance have been corroborated and
said to be true by the other members of your staff. The corroboration of statements has
been done by the Committee themselves.
From Ms. Liliana Vess, her allegations also of your insistent sexually suggestive words as to
her physical appearance have been regularly observed and have been witnessed by her
fellow staff. The spreading of malicious rumor regarding the sexual orientation of Mr.
Nicol Bolas is rather a below the belt kind of joke. In fact, when Mr. Bolas was interviewed
during the deliberation of this case, he said that despite him doing everything to contribute
in the good performance of the department, he still gets this kind of bullying from a
superior, and that at first, he let it slide being rational and cool-headed, however, when this
bullying has continued and with the malicious rumors having reached other departments,
it started to get in his nerves and eventually affected his focus in work, eventually, barely
making it possible for him to meet the deadlines.
Schultz Corporation is committed to providing a safe environment for all its employees free
from discrimination on any ground and from harassment at work including sexual
harassment. Schultz Corporation operates a zero tolerance policy for any form of sexual
harassment in the workplace, treat all incidents seriously and promptly investigate all
allegations of sexual harassment.
Sexual harassment is unwelcome conduct of a sexual nature which makes a person feel
offended, humiliated and/or intimidated. It can involve one or more incidents and actions
constituting harassment may be physical, verbal and non-verbal.
All sexual harassment is prohibited whether it takes place within Schultz Corporation
premises or outside, including at social events, business trips, training sessions or
conferences sponsored by Schultz Corporation.
Anyone who has been found to have sexually harassed another person under the terms of
the policy is liable to any of the sanctions from verbal/written reprimand or worst, an
employment dismissal.
The nature of the sanctions will depend on the gravity and extent of the harassment.
Suitable deterrent sanctions will be applied to ensure that incidents of sexual harassment
are not treated as trivial.
Schultz Corporation values a safe and inclusive work environment for all staff and expects
that all staff and associates treat others with dignity and respect. This is reinforced in
Values and Behaviors which are embedded within the organization. Schultz Corporation
has a policy of zero tolerance of behavior that is discriminatory and harassing or bullying.
As a result of consolidating and establishing the facts and after giving a fair opportunity
for each side to present their positions, the Disciplinary Committee arrived for a conclusion
that Mr. Will Kenrith, the Marketing Department Supervisor is indeed liable for the
accusations as alleged against him.
The decision is that, the sanction could have amounted to a dismissal, however, upon
consideration of the department’s performance, you will be given another chance to stay
within the company. Your employment will not be severed, however, this should serve as a
reminder that excessive joking is not always openly accepted by your fellow employees,
especially so with opposite employees. And that it is not the only way to build good rapport
between the team, other ways could have been used as your strategy instead.
Moreover, in order to prevent the happening of the same incident again, you will be
suspended without pay for one month starting from April 10, 2021 to May 10, 2021 to
reflect on your self-behavior. Upon your return, you will be transferred to the Procurement
Department located at the warehouse building. The Supervisor of the Procurement
Department is about to retire and you are hereby appointed as his successor.
This order of suspension and subsequent transfer is irrevocable.
