a. Give the distinctions between the classical and Neo-Classical Theory. In these
theories what do you appreciate most? Why?

Classical theory which explains that a person always acts in such a way to seek
pleasure and avoid pain. People has the freewill to choose between good or evil, for
example, Mr. A is walking on the Road and he saw a Girl walking also there, no one else in in
that place except to the both of them, Mr. A have no plan to do something by that time but
the opportunity and his motive makes him want to do something, so for the conclusion he
have to choose what he want to do, commit crime or make the right choice, to not do
anything. While Neo-Classical Theory considers the all aspects of a criminal which states
both pain and pleasure therefore must be exempted from criminal liability. In this Theory
stated that not all perpetrators would become guilty, for the reason that theirs a person
who committed a crime but he/she does not know the nature and quality of his act due to
mental disease so they are example of exempted from the punishment.
Between the two theory what I appreciated the most is Classical Theory, because of
the fact that we really have the ability to choose between right or wrong. The choice is with
us if we want to commit crime or be afraid of the punishment and also the conscience. We
are afraid of the consequences if we choose wrong act not just by the punishment but also,
we have fear of God.

b. Read and understand the essay on crimes and punishment by Cesare Beccaria.
What are the insights you learned from it? How do these ideas influence your
views on crimes as a criminology student?

Cesare Beccaria was considered as the father of modern criminal law and the father
of criminal justice. He is well remembered for his Essay on Crimes and Punishments which
condemned torture and the death penalty. The purpose of punishment is to deter the
offender from committing the crime again and to discourage others from ever committing
the crime. Punishment severity should be based primarily on the harm the offense has
caused rather than the intent of the offender, and it should not be more severe than is
required to achieve deterrence. My insights in this essay is that it is not possible to learn
about a person’s intention with certainty and also, how society should set up a justice
system of fair laws and punishments. As a student taking up the Course Bachelor of Science
in Criminology, these ideas influence my views on crimes prevented more by protecting
society from the criminal and the criminal from themselves, create a better society, not
revenge.
